1450 RES SECTION 709 OF TITLE VII OF HOUSING ACT OF 1961 PROVIDES FOR MAKING OF GRANTSRESOLUTION NO. 1450 WHEREAS, Section 709 of Title VII of the Housing Act of 1961, as amended, provides for the making of grants of Federal funds by the Secretary of Housing and Urban Development to States and local public bodies to assist in financing the ac- quisition of title to or other permanent interests in areas, sites, and structures of historic or architectural value in urban areas, and in their restoration and improvement for public use and benefit, in accord with the comprehensively planned development of the locality; and, WHER EAS, the City of Paris, Paris, Texas, herein some- times referred to as "Applicant", deems it necessary and in the public interest to undertake an historic preservation project, hereinafter called the "Project", with Federal grant assistance to improve and restore the General Sam Bell Maxey Home for historic preservation located within the corporate limits of the City of Paris, Lamar County, Texas, being a Greek Revival Style two-story home,constructed in 1867, with gardens and grounds, located upon the following described property: FIRST TRACT: A part of the Larkin Rattan Survey within the corporate limits of the City of Paris, de- scribed by metes and bounds as follows in accordance with a survey made by W. R. Abbott, Registered Public Surveyor, on the 27th day of April, 1966: SEGINNING at a stake at the Northeast corner of a brick marker at the intersection of the South Boundary Line of Washington Street with the West Boundary Line of Church Street; THENCE South along the West Boundary line of Church Street, a distance of 256 feet to a stake for corner at the Northeast corner of a tract of land conveyed Paul Franklin by deed recorded in Vol. 361, Page 117, of the Deed Records of Lamar County; THENCE West a distance of 282 feet, a stake for corn er ; THENC E North a distance of 262 feet, a stake for corner in the South Boundary line of Washington Street; THEIVCE East along the South Boundary line of Washington Street a distance of 285 feet to the place of beginning. S DCOND TRACT: A part of the Larkin Rattan Survey within the corporate limits of the City of Paris, de- scribed by metes and bounds as follows in accordance with a survey made by W. R. Abbott, Registered Public Surveyor, on the 27th day of April, 1966: BEGINNING at a stake for corner at the Northwest corner of a tract of land conveyed Paul Franklin by deed recorded in Book 361, Page 117, of the Deed Records of Lamar County; THEIVCE West a distance of 52 .feet, a stake for corner, said point being 262 feet South of the South Boundary line of Washington Street; THENCE South a distance of 90 feet, a stake for corner; THENCE East a distance o.f 52 feet, a stake for corner at the Southwest corner of said Franklin tract of land; THENCE North a distance of 90 feet to the place of beginning. WHER EAS, title to or other permanent interests insaid property have been previously acquired by the Applicant; and, WHEtEAS, it is estimated that the cost of said improve- ment and restoration will be $49,700.00: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: 1. That an application be made to the Department of Housing and Urban Development for a grant in an amount au- thorized by Section 709 of Title VII of the Housing Act of 1961, as amended, which amount is presently estimated to be $24,850.00, and that the Applicant will pay the balance of the cost from funds available to it. 2. That C. L. Walker, City Manager of the City of Paris, Paris, Texas, is hereby on behalf of the Applicant authorized and directed to execute and to file such application, and an assurance of compliance with the Department of Housing and Urban Development regulatio ns under Title VI of the Civil Rights Act of 1964, to execute such contract or contracts as may be necessary for the grant applied for, to provide such information and furnish such documents as may be required by the Department of Housing and Urban Development, and to act as the authorized correspondent and representative of the Applicant in the accomplishment of the Project. 3. That the proposed Project is in accord with the com- prehensively planned development of th e locality, and that, should said grant be made, the Applicant will retain, maintain and preserve said property for public use and benefit and for the historic preservation purposes designated in said applica- tion and approved by the Department of Housing and Urban Development. 4. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the Applicant with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964 and with Federal re- quirements relating to equal employment opportunity. 5. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the Applicant with the Federal labor standards imposed under Title VII of the Housing Act of 1961, as amended.
