1431 RES COP IS PARTICIPATING IN PROCUREMENT OF ROW FOR EXPANSION OF LOOP 286 NER ESOLUTION NO. 1431
WHEREAS, the City of Paris is participating in the pro-
curement of right of way for the expansion of Loop 286 N. E.;
and,
WHEREAS, Parcels 9 and 10, so designated by the Texas
Highway Department, being a part of Project No. RW 8001-1-22,
are among those tracts required to be procured by the City of
Paris, which tracts are owned respectively by Harmon Smith and
Reba J. Smith; and,
WHEREAS, in negotiating for the execution of right of
way deeds, it has come to the attention of the City Cauncil of
the City of Paris, that in conjunction with saici.right of way
procurement, Harmon Smith and wife, Mary Smith, desire to con-
vey the following described property:
Situated within the corporate limits of the City
of Paris, County of Lamar, State of Texas, a part of
the Redding Russell Survey and being a part of the
same property conveyed Harmon Smith by deed xecorded
Book 428, Page 33, Deed Records, Laznar County, Texas,
and being Lot 4, City Block 276, more particularly
described as follows:
Beginning at a point in the North Boundary Line
of Clement Road, said point being the South Ea,st
corn er of Lot 4-A, City Block 276;
Thence N. 88° 51' E. with the North Bounda,ry Line
of Clement Road a distance of 150' to a point;
Thence N. 1° 09' W. a distance of 198' to a point
for corner;
Thence S. 88° 51' W. along the North property
line of Lot 4 belonging to Harmon Smith a distance of
200' to a point;
Thence S. 1° 09' E. a distance of 10' to the
Narth West corner of Lot 4-A, City Block 276, owned
by Reba J. Smith;
Thence N. 88° 51' E. a distance of 50' to the
Nor th East corner of Lot 4-A;
Thence S. 10 09' E. a distance of 188' with the
East Boundary Line of Lot 4-A to the place of
beginning and containing .693 acres, fronting 150 feet
on the North Boundary Line of Clement Road.
and Reba J. Smith desires to convey the following described
property:
Situated within the corporate limits of the City
of Paris, County of Lamar, State of Texas, a part of
the Redding Russell Survey and being the same property
conveyed Reba J. Smith by deed recorded in Vol. 479,
Page 373, of the Deed Records, Lamar County, Texas,
and being Lot 4-A, City Block 276, more particularly
described as follows:
Beginning at a point in the North Boundary Line of
Clement Rd., said point being the South East corner of
Lot 4-A, City Block 276;
Thence S. 88° 51' W. with said boundary line a
distance of 50' to the South West corner of Lot 4-A;
Thence N. 1° 09' E. with the West property line
of Reba J. Smith's property, a distance of 188' to a
point for corner; said point also being the most
South West corner of Lot 4, City Block 276;
Thence N. 88° 51' E. a distance of 50' to the
N. E. corner of Lot 4-A;
Thence S. 1° 09' E. with the East prop erty line
a distance of 188' to the place of beginning and
containing .216 acres, fronting 50 feet on the North
Boundary Line of Clement Road.
in exchange for the City of Paris conveying to Harmon Smith and
Reba J. Smith, jointly, the following described property:
Situated within the corporate limits of the City
of Paris, County of Lamar, State of Texas, a part of
the Redding Russell Survey and being part of the same
property conveyed the City of Paris by deed recorded
Book 238, Page 621, Deed Records, Lamar County, Texas,
being part of Lot 6, City Block 276, and more particu-
larly described as follows:
Beginning at a stake in the proposed south right-
of-way line of Loop Hwy. 286 and also being S. 880 51'
W. a distance of 591 from the present southeast corner
of said City of Paris tract;
Thence S. 88° 51' W. along the south boundary
line of said tract a distance of 235' to a point for
corner; said point being in the north boundary line
of Lot 4, City Block 276, belonging to Harmon Smith;
Thence N. 1° 09' W. a distance of 160' to a
point; said point being in the proposed south right-
of-way line of Loop Hwy. 286 N. E.;
Thence S. 57° 09' E. along said proposed south
right-of-way line of Loop Hwy. 286 N. E. a distance
of 285' to the place of beginning containing .432
acres.
NOW, THEREFORE, BE IT RFSOLVED BY THE CITY COUNCIL OF THE
CITY OF PARIS, PARIS, TF.XAS, That the Mayor of the City of
Paris, James W. Farris, be, and he is hereby author ized to exe-
cute a general warranty deed to Reba J. Smith and Harmon Smith,
conveying the above described .432 acres in exchange for Reba
J. Smith's conveyance of .216 acres to the City of Paris and
Harmon Smith's conveyance of .693 acres to the City of Paris.
