1401 RES COP HAS UNDER TITLE VII OF HOUSING ACT OF 1961RESOLUTION NO. 1401
WHERFAS, the City of Paris, hereinafter called Public Body,
has heretofore under Title VII of the Housing Act of 1961, en-
tered into a Contract for Grant to Acquire and/or Develop Land
for Open-Space Purposes under which the Uni ted States of America,
herein&er called Government, agrees to make a Grant to the City
of Paris to aid in finaxicing the project, designated Tex. OSC-80;
and,
WHEREAS, the Government has made the additional require-
ment that the Public Body comply with the Land Acquisition
Requirements of Title III of the Uniform Relocation Assistance
and Real Property Acquisition Policies Act of 1970; and,
WHFREAS, said compliance is required to be in the form of
an amendment to Tex. OSC-80(G) Contract heretofore authorized to
be executed by the Mayor of the Public Body by Resolution No.
1398, dated January 11, 1971; and,
WHIIZEAS, it is necessary that the Mayor of the Public
Body be authorized to execute on behalf of the Public Body such
amendment to said contract; NOW, THER EFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
AS FOLLOWS:
Section l. The City of Paris hereby assures that it has
authority under state law to comply with Section 305 o.f the Act
and agrees that, notwithstanding any provision set forth in
Tex. OSC-80(G):
(1) In acquiring real property in connection with
Tex. OSC-80 the Public Body will be guided to
the greatest extent practicable under state
law, by the land acquisition policies set out
under Section 301 of the Act and the provisians
of Section 302 thereof;
(2) Property owners will be paid or reimbursed for
necessary expenses as specified in Sections 303
and 304 of the Act ;
(3) The costs to the Public Body of providing pay-
ments and assistance hereunder shall be borne
in accordance with Section 211 of the Act; and
(4) Public Body will execute such amendments to
Tex. OSC-80(G) and execute, furnish and be
bound by, such additional documents as the
Secretary of Housing and Urban Development
shall determine necessary to effectuate or
implement the assurances provided hereunder.
Section 2. The Mayor, B. M. Felty, is hereby authori2ed
and directed to execute an amendment to Contract Tex. OSC-80(G),
and the City Clerk is hereby authorized and directed to impress
the official seal of the Public Body and to attest the signa-
ture of the Mayor on such amendment.
Section 3. The Public Body agrees to abide by all of the
provisions, terms and conditions of said contract amendment.
Section 4. This resolution shall take effect this 8th
day of February, 1971.
