02 Council Minutes (07/05/01)MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL JULY 5, 2001 The City Council of the City of Paris met in regular session Thursday, July 5, 2001, 6:00 P. M., Paris Junior College, Applied Technology Building, Room 1016, 2400 Clarksville Street, Paris, Texas. Mayor Michael J. Pfiester called the meeting to order with the following Council Members present: John F. Bell, Joe E. McCarthy, Richard Manning, Kevin Gray, and Benny Plata. Also present were City Manager Michael E. Malone, City Attorney Larry W. Schenk, and City Clerk Mattie Cunningham. Invocation was given by Mayor Michael J. Pfiester of the City of Paris. City Manager Malone presented the minutes of the Planning and Zoning Commission meeting held July 2, 2001, and attached hereto as Exhibit A. Mayor Pfiester declared the public hearing open to consider the petition of Ham and T, Inc., a Texas Corporation, for a change in zoning from a Two-Family Dwelling District (2F) to a Neighborhood Service District (NS) on Lot 4, City Block 33, located at 1331 E. Price Street. Mayor Pfiester called for proponents to appear, and Tom Wagnon, Route 2, Box 800, President of Ham and T, Inc., appeared in behalf of the petition. Mr. Wagnon said that he would like to build an office with secured parking to protect service trucks from vandalism. Mayor Pfiester called for opponents to appear, none appeared, and the public hearing was declared closed. ORDINANCE NO. 2001-042 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A NEIGHBORHOOD SERVICE DISTRICT (NS) ON CITY LOT 4, CITY City Council Meeting July 5, 2001 Page 2 BLOCK 33, ON PROPERTY BELONGING TO HAM AND T, INC., A TEXAS CORPORATION, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A TWO-FAMILY DWELLING DISTRICT (2-F); DESIGNATING THE BOUNDARIES OF THE NEIGHBORHOOD SERVICE DISTRICT (NS) SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE, WAS PRESENTED. A motion was made by Mayor Pro Tem Manning, seconded by Councilman Gray, for adoption of the ordinance. The motion carried 6 ayes, 0 nays. Mayor Pfiester declared the public hearing open to consider the petition of A1 Turinsky for a change in zoning from a One-Family Dwelling District No. 2 (SF-2) to a One-Family Dwelling District No. 3 (SF-3) With Specific Use Permit (39) Mobile Home on Lots 1 through 8, Block 11, Westside Addition, being located in the 2000 Block of West Cherry Street and West Plum Street. Mayor Pfiester called for proponents to appear and none appeared. Mayor Pfiester called for opponents to appear. Sybil Colson, 819 Lamar Avenue, was present as a property owner and stated that she also represented other property owners in the neighborhood who were opposed to the petition. Ms. Colson stated that Mr. Turinsky would be making a mobile home park on this property. Ms. Colson said this would devalue the property in the neighborhood. She said what Mr. Turinsky is seeking to do is place a mobile home park in the middle of a residential neighborhood and this will place a burden on the infrastructure that is in place. Mayor Pfiester asked for a show of hands of those who were opposed to the zoning change, and approximately 95% of those in the room raised their hands. No one else appeared, and the public hearing was declared closed. City Council Meeting July 5, 2001 Page 3 City Manager Malone read the ordinance changing the zoning from a One- Family Dwelling District No. 2 to a One-Family Dwelling District No. 3 With Specific Use Permit (39) Mobile Homes on Lots 1 through 8, Block 11, Westside Addition. After discussion, a motion was made by Councilman McCarthy, seconded by Mayor Pro Tem Manning, to deny the zoning change. The motion carried 6 ayes, 0 nays. Mayor Pfiester declared the public hearing open on the petition of Pat Murehead for a change in zoning from a One-Family Dwelling District No. 2 (SF-2) to a One-Family Dwelling District No. 2 (SF-2) With Specific Use Permit (25) Day Nursery on Lot 4, Block 2, Hillcrest Addition, being number 2380 Beverly Drive. Mayor Pfiester called for proponents to appear and Pat Murehead, P.O. Box 6401, appeared speaking in favor of her petition. Ms. Murehead advised the City Council that she planned to have a child care facility at this location and would have a maximum of twelve children, from infants to four year olds and would operate from 7:00 am until 5:30 pm. She told Council that she would be state monitored. Ms. Murehead advised that the house is in good shape, but the yard would have to be cleaned. Mr. Louis Quisenberry, 2130 Beverly Drive, was present speaking in favor of the petition. Ms. Quisenberry said the fence had been removed in order to mow the yard and will be put back up. Mr. Quisenberry said he has lived on Beverly Drive for twenty years and would welcome this lady to their neighborhood. Mayor Pfiester called for opponents to appear, none appeared, and the public hearing was declared closed. City Council Meeting July 5, 2001 Page 4 ORDINANCE NO. 2001-043 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A ONE-FAMILY DWELLING DISTRICT NO. 2 (SF-2), WITH SPECIFIC USE PERMIT (25) DAY NURSERY ON LOT 4, BLOCK 2, HILLCREST ADDITION, AS REQUESTED BY PAT MUREHEAD, AGENT FOR DONALD L MOON, OWNER, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A ONE-FAMILY DWELLING DISTRICT NO. 2 (SF-2); DESIGNATING THE BOUNDARIES OF THE ONE-FAMILY DWELLING DISTRICT NO. 2 (SF-2) WITH SPECIFIC USE PERMIT (25) DAY NURSERY SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE OF AUGUST 1. 2001, WAS PRESENTED. Councilman Carter entered the council chambers and assumed his seat at the council table at 6:25 pm. A motion was made by Mayor Pro Tem Manning, seconded by Councilman McCarthy, for adoption of the ordinance. The motion carried 7 ayes, 0 nays. City Attorney Schenk presented the following petition for rezoning: Kenny Kammer, Lots 4, 5, 6, 18, 19, 20, and part of Lots 3 and 17, Block I of the Warren Addition. Mayor Pfiester referred the petition to the Planning and Zoning Commission for their study and recommendation at their meeting scheduled for August 6, 2001, and before the City Council August 9, 2001.
