RESOLUTION NO. 1109 . <br />WHEREAS, construction of the Pat Mayse Dam and Resp-xvoir on <br />Sanders Creek, Texas, has been authorized by Public Law 87-874, approved <br />23 October 1962; and, <br />WHEREAS, under the provisions of the Water Supply Act of 19_58 (Title <br />III, Public Law 85-500),as amended by Section 10 of Public Law 87-88, the <br />Corps of Engineers may include water supply storage for municipal or in- <br />dustrial uses in any reservoir project, provided that before construction is - <br />initiated, State or local interests shall agree to pay for the cost of such pro-» <br />visions, and provided further that not to exceed 30 per cent of the total esti- <br />mated cost of any project may be allocated to anticipated future demands <br />where State or local interests give reasonable assurances, and there is <br />reasonable evidence, that such demand for the use of such storage will be <br />xnade within a period of time which will permit paying out the cost allocated <br />to water supply wi.thin the life of the project; and, <br />WHEREAS, the provisions of the aforesaid Acts are recognized by tla.e <br />City of Paris, Texas, as being applicable to the Pat Mayse Reservoir pro•• <br />ject; and, <br />WHEREAS, on the 30th day of November, 1964, the City of Paris, <br />Texas, signed a contract with the United States Government to utilize and <br />commence payment on 21, 900 acre-feet of storage space in Pat Mayse <br />Reservoir at the time the project is completed, said storage being equal to <br />20 percent of the conservation storage in the project; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, TEXAS: <br />1. That the City of Paris is fully cognizant of the provisions of the <br />Water Supply Act of 1958, as amended, and the requirements for payment <br />of the allocated costs of the water supply storage, including interest during_ <br />construction and interest on the unpaid balance, annual operation and main.. <br />tenance co sts, and replacement costs. <br />2. That the City of Paris is fully cognizant of the plan, so far devel- <br />oped, for the construction and operation of the Pat Mayse Reservoir insofar <br />as water supply provisions are concerned and the water supply services to <br />be provided by the project, and agrees that the City's plan for future water <br />supply will be directed toward utilizing the project water supply services <br />under suitable repayment arrangements. <br />3. That the City of Paris does -hereby request the Corps of Engineers <br />to include approximately 87, 700 acre-feet of water supply storage in Pat <br />Mayse Reservoir (which is estimated to yield 44 million gallons per day at <br />the project site) for its future water supply needs. <br />4. That the City of Paris recognizes the responsibility of repayment- <br />to the United States of all costs allocated to the requested municipal and in-. <br />dustrial water supply storage. <br />5. That the City of Paris hereby gives assurance that demand for the <br />use of such storage will be made within a period of time which will permit <br />paying out the cost allocated to water supply within the life of the project. <br />
