AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, ABANDONING THE CITY'S INTEREST IN THE FIFTEEN (15) FOOT ALLEY BEGINNING AT 17TH STREET N.W. WEST TO THE EAST BOUNDARY LINE OF CITY BLOCK 200 BETWEEN BONHAM STREET AND MAPLE AVENUE; DECLARING NO NECESSITY OR NEED OF SAID ALLEY FOR CITY USE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it has been brought to the attention of the City Council of the City of Paris by petition of the adjacent property owners that a fifteen (15) foot alley beginning at 17th Street N.W. west to the east boundary line of City Block 200 between Bonham Street and Maple Avenue is of no use as an alley to the City of Paris or to its citizens, and the City Council so finds; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the fifteen (15) foot alley beginning at 17th Street N.W. west to the east boundary line of City Block 200 between Bonham Street and Maple Avenue, described in Exhibit A, attached hereto, is found to be of no use as an alley to the City of Paris or its citizens; therefore, the City's interest in such alley is hereby abandoned. Section 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 4. That this ordinance shall be effective from and after its date of passage. Schenk August 29, 2001 With regard to the City retaining utility and drainage easements in this 1§ foot alley. Steve Methven checked water and sewer maps and determined that there are no existing utilities present. I contacted Acting City Engineer Frank bavis and faxed to him maps, and other documents regarding this alley. He also contacted Terry Townsend. He got back with me and stated that he sees no reason for the City to retain easements in this alley since there are no existing utilities there; also because of the size of the alley (only 15 feet); and because alley has already been encroached on with fences, buildings, etc. over the years. Z also spoke with Terry earlier and he felt that alley should be closed and that there was no need to retain easements. Another plus for this closing, 100% of od joining property owners signed the petition. And 8 pieces of property which have been tax delinquent properties are being purchased enabling taxes to be mode current. The Ordinance, Resolution, and beads of Abandonment have been prepared in draft form for the Thursday, September 6th agenda. Amp
