Box 9037 Paris, Texas 75461-9037 Re: Follow-up to the Meeting of August 13, 2001 Dear Steve: It was a pleasure seeing you on Monday and Tuesday and discussing the final amendments to the Comprehensive Plan. As I mentioned, we appreciate your leadership in getting this project brought to conclusion. Concerning the map amendments, enclosed is a CD of the finally revised Future Land Use Plan Map. The items listed by Murphy & Associates has been incorporated into the map with the following exceptions: · The institutional designation on the inside of the loop where the orthopedic clinic and cancer institute are located has been retained. The moderate density residential district inside of the loop between 35th Northeast and the loop between Lamar and Pine Mill Road has been retained, This is an area where the neighborhood needs to be expanded and protected from nonresidential development. The 19th Street Northwest corridor has been retained for residential development as shov:n, given the interest in strengthening residential uses in this area. The area along Clarksville Street between 19m and 23~d Streets has been retained for residential on the south and north sides as shown given the need to support the adjacent residential neighborhoods. In summary, the map amendments suggested by Murphy & Associates were well advised and were, in large measure, implemented. In several cases, however, the plan intent is to support the integrity of residential neighborhoods, particular at the "edges." For example, residences in the vicinity of Washington Street south of Clarksville Street back up to the commercial uses that front Clarksville Street. Commercial should be extended along the north side of the Loop between Townwood Addition and Shady Oaks Mobile Home Park, not moderate residential 2. Moderate density residential classification along east side of Stillhouse Road through the Townwood and Dr. Swint frontages does not fit the current zoning nor the actual uses. 3. Elk Hollow is shown as Park area but its green area is twice the actual size and takes in Wildwood Estates. 4. Institutional district should be replaced with Commercial on outside of Loop from FM 195 south to Center street 5. Institutional district should be replaced with Commercial on inside of Loop where Fish Fry is located and across the street on the outside of Loop where Comfort Inn is located. 6. Moderate density residential district should be replaced with Commercial on outside of Loop between 34~ and Ruby Way where Ford dealership is located 7. Moderate density residential district should be replaced with Commercial on outside of Loop and west of single family strip on 34th street where Paris Business Park is located. 8. Moderate density residential district should be replaced with Commercial on south side of Pine Mill south of Holiday Inn where Sharrock air conditioning, old Sharrock nursery and electrical supply company are located and along west side of 35th NE where Victorian Inn and convenience store are located. 9. Moderate density residential district should be replaced with Commercial on inside of Loop between 35th NE and Loop and between Lamar and Pine Mill Road, (the Church of Christ Property). 10. Moderate density residential classification along 20th NE does not fit the current zoning nor the future trends which is certainly towards local type office, light retail, and multi family. 11. Moderate density residential classification along Pine Bluff adjacent and east of 17th NE does not fit the current zoning nor the current trends in use which is certainly towards local type office and light retail uses. 12. Moderate density residential classification along North Collegiate and East Price south of Cherry street does not fit the current zoning nor the future trends which is certainly towards local type office and/or retail commercial on Price, Cherry, and Collegiate and multi family on all of the other land between 25th and Aiken school campus PAT MURPHY & ASSOCIATES 13. Southwest corner of 42na SE and Lamar is the platted and fully developed Mornin~s~d~'Iq'orth Commercial addition which is zoned Commercial and should remain so, and not Planned Development as shown on map. NW Area Map: 1. The future of 19~h NW is Commercial or light industrial not residential as now marked. 2. The future of the inside of the NW Loop north of Graham street is more likely Commercial or light.industrial rather than residential as now marked. SW Area Map Office district classification for south side of Elm street west of 4th SW should be some type of industrial. SE Area Map: 1. Area along north side of Jefferson Road west of fire station and east of 12th SE should be zoned planned development or long term development. Its futura is unclear but single family housing over the whole 100 acres is not it; it will probably be a mixed use with light commercial uses such as office/warehouse facing Jefferson Road south of the drainage ditch and single family or two family north of the ditch. 2. If the park area marked on the south side of US 271 southeast of the Loop is supposed to be Woodall Field, it is wrong and currently appears to be include parts of the Wally Kraft land which is commercial or the Cobb Ranch land which is probably residential. 3. Don't understand Institutional zoning in vicinity of 6th SE and Austin where McClanahan and Holmes, Marshall Dougherty clinic, and vacant lot belong to Mrs. Ethel Abbott are so designated. 4. The future of the use along Clarksville between 19th and 23ra street is office or light retail not moderate density residential. PAT MURPHY & ASSOCIATES DRAFT ALICE\ORDWORK\CURRENT\Compreh Land Use Plan Ord September 5, 2001 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND ADOPTING A COMPREHENSIVE ZONING AND LAND USE PLAN FOR THE CITY OF PARIS; APPEALING ALL PRIOR COMPREHENSIVE PLANS IN CONFLICT THEREWITH; PROVIDING A SEVERABILITY CLAUSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 211.004 of the Local Government Code requires that all zoning regulations must be adopted in accordance with a comprehensive plan and must be designed to lessen congestion in the streets; secure safety from fire, panic, and other dangers; promote health and the general welfare; provide adequate light and air; prevent the overcrowding of land; avoid undue concentration of population; or facilitate the adequate provision of transportation, water, sewers, schools, parks, and other public requirements; and, WHEREAS, the City of Paris has previously retained the respected firm of Bucher, Willis & Ratliff Corporation, acknowledged experts in the area of preparation of comprehensive zoning plans, to prepare a new comprehensive plan for the City of Paris; and, WHEREAS, Chapter 219 of the Local Government Code empowers municipalities for the purpose of promoting sound development and promoting public health, safety, and welfare to adopt a comprehensive plan for the long range development of said municipalities; and, WHEREAS, Chapter 219 of the Local Government Code empowers a municipality to define the content and design of a comprehensive plan; and, WHEREAS, Chapter 219 of the Local Government Code provides that a comprehensive plan may: include but is not limited to provisions on land use, transportation, and public facilities; consist of a single plan or a coordinated set of plans organized by subject and geographic areas; and 3. be used to coordinate and guide the establishment of development regulations; and, WHEREAS, Chapter 219 of the Local Government Code further provides that a municipality may define, by ordinance, the relationship between a comprehensive plan and development regulations and may provide standards for determining the consistency required between a plan and development regulations; and, WHEREAS, in accordance with Section 219.003 of the Local Government Code, the City of Paris, by and through its Planning & Zoning Commission, conducted numerous hearings at which the public was given the opportunity to give testimony and present written evidence with regard to the Draft Comprehensive Plan prepared and presented by Bucher, Willis & Ratliff Corporation; and, WHEREAS, following said numerous public hearings, the Planning & Zoning Commission conducted additional public meetings whereby various provisions of the proposed Comprehensive Plan were carefully scrutinized and extensively deliberated; and, WHEREAS, following the process of public hearings and extensive deliberation by the Planning & Zoning Commission, the Commission forwarded said Draft Comprehensive Plan to the City Council with its recommendations for approval thereof, and, WHEREAS, the City Council has subsequently, in public meetings, duly posted, fully discussed and deliberated the proposed Comprehensive Plan as presented by the consultants Bucher, Willis & Ratliff; and, WHEREAS, the adoption of the proposed Comprehensive Plan shall not, in accordance with Section 219.004 of the Local Government Code, limit the ability of the City of Paris to prepare other plans, policies, or strategies related to land use and land use planning as required; and, WHEREAS, the City Council desires to adopt the aforesaid Draft Comprehensive Plan as the new Comprehensive Zoning and Land Use Plan for the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Comprehensive Plan, as the same was prepared by the consulting firm of Bucher, Willis & Ratliff Corporation, and as the same was presented to the City of Paris Planning & Zoning Commission, and considered at numerous public hearings conducted by said Commission, in which the general public was encouraged to give testimony and present written evidence regarding same, which said plan, following further deliberation by the Planning & Zoning Commission, was forwarded to the City Council for consideration along with recommendations for approval made by the Planning & Zoning Commission, and which said plan was further reviewed and revised by the City Council following further public input and hearing in conjunction with the aforesaid consultant, is found to be acceptable to the City Council as the same is attached hereto and for all purposes incorporated herein as Exhibit A, and is hereby in all things approved as the Comprehensive Zoning and Land Use Plan of the City of Paris. Section 3. That approval of the aforesaid Comprehensive Zoning and Land Use Plan as set out herein shall include approval of all maps, exhibits, appendices, text, and other materials associated therewith. Section 4. That approval of said plan is not intended to nor shall it constitute zoning regulations or the establishment of zoning district boundaries, and that any and all maps included in said comprehensive plan, if the same are not already so designated, shall be and are hereafter considered as being marked with the following language: "A comprehensive plan shall not constitute zoning regulations or establish zoning district boundaries," as the inclusion of said language is required by Section 219.005 of the Local Government Code. Section 5. That all ordinances or portions of ordinances adopting prior plans which are in conflict with this ordinance or the Comprehensive Zoning and Land Use Plan adopted herein shall be and are hereafter repealed to the extent of such conflict. Section 6. That if any chapter, section, paragraph, sentence, or other portion of the aforesaid Comprehensive Zoning and Land Use Plan adopted herein shall be or is hereafter determined by a court of appropriate jurisdiction to in any way conflict with or be contrary to the constitution and laws of the United States or the State of Texas, the aforesaid finding of illegality shall render unenforceable only that portion of said plan so determined to be unlawful, it being the intention of the City Council that the terms and provisions of said Comprehensive Zoning and Land Use Plan adopted herein shall be and are hereby severable, and the remaining terms and provisions of said Comprehensive Zoning and Land Use Plan not affected by said determination of illegality shall remain in full force and affect. Section 7. That this ordinance and the Comprehensive Zoning and Land Use Plan adopted thereby shall be effective beginning October 1,2001. PASSED AND ADOPTED this 6th day of September, 2001.
