RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, DECLARING CERTAIN PERSONAL PROPERTY
SURPLUS; APPROVING AN AUCTIONEER SERVICE AGREEMENT;
MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the several departments of the City of Paris have furnished the list of personal
property, attached hereto as Exhibit A, which no longer serves a useful purpose for the City of Paris
and its operation, and it would be appropriate that said personal property be declared surplus
property; and,
WHEREAS, it would be appropriate to dispose of said surplus property by auction duly
advertised and conducted by Reggie McDowra Auctioneer Service, Texas Auctioneer License
AUCTNR00011499, which firm has heretofore been approved for use by State of Texas agencies;
and,
WHEREAS the form of the Auctioneer Service Agreement, attached hereto as Exhibit B,
should, in all things, be approved, and the Mayor should be authorized to execute the same; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the personal property described in Exhibit A, attached hereto, be, and the
same is hereby, declared to be surplus property of the City of Paris, and the same may be disposed
of in accordance with the laws of the State of Texas and the Charter of the City of Paris.
Section 3. That the form of the Auctioneer Service Agreement with Reggie McDowra
Auctioneer Service, attached hereto as Exhibit B, be, and the same is hereby, approved.
Section 4. That the Mayor be, and he is hereby, authorized and directed to execute, on behalf
of the City of Paris, the Auctioneer Service Agreement with Reggie McDowra Auctioneer Service,
under the terms and conditions and in the form shown in Exhibit B, attached hereto.
Section 5. That this resolution shall be effective from and after its date of passage.

EXHIBIT A
AUCTIONEER SERVICE AGREEMENT
This agreement is entered into by REGGIE McDOWRA AUCTIONEER SERVICE,
hereinafter referred to as Seller, of Paris, Texas, and the CITY OF PARIS, PARIS, TEXAS,
hereinafter referred to as Owner, under the following terms and conditions:
1. Seller agrees to conduct a public auction sale or to otherwise sell the property described in
Exhibit A, attached hereto, belonging to Owner, trustees, creditors, or secured parties. The auction
sale to be conducted at Lewis Equipment Service located on F.M. 1508, Paris, Texas, beginning on
the 29th day of September, 2001.
2. Owner will furnish Inventory with serial numbers to be attached to this contract.
3. Seller agrees to prepare all advertising material and publicity necessary to properly advertise
and promote the attendance of buyers at no cost to Owner.
Owner agrees to pay Seller for the services rendered by Seller a commission of nine and three-
fourths percent (9.75%) of the total income from all sales made during the period of this contract
whether such sales are made at public auction, by private sale or in any other manner.
This contract and agreement shall be binding upon the parties for a period of sixty (60) days
after the execution hereof.
Executed this 17th day of September, 2001.
