<br />WHEREAS, heretofore, by instrument dated August 4, 1955, recorded
<br />in Vol. 345, Page 220, Deed Records of Lamar County, Texas, Charles M.
<br />Johnson of Galveston County, Texas, and Mrs. Virginia Hocker and husband,
<br />Otis B. Hocker, of Harris County, Texas, owners of certain properties
<br />embracing several hundred acres of land, located in the eastern part of
<br />the City of Paris, corn[nonly known as Johnson's Woods, granted and conveyed
<br />to the City of Paris a certain easement tract for right of way for sani-
<br />tary sewer purposes, extending for a distance of several hundred feet
<br />over, along and across a portion of said Johnson's Woods, which grant and
<br />conveyance was by the City of Paris duly accepted and filed for record in
<br />the office of the County Clerk of Lamar County; and,
<br />WHEREAS, said above described instruaaent of conveyance recites a
<br />nominal formal consideration of $1.00, together with the further and
<br />additional consideration of the contract and agreement of the City of
<br />Paris to give and make for and to the said grantors, their successors or
<br />assigns, "without making the usual and customary charge therefor, 40 sewer
<br />line taps or connections as requestsd at and along the sanitary sewer line
<br />to be built, layed and constructed over and along the easement tract" de-
<br />scribed in such conveyance; and,
<br />WHEREAS, since the making and acceptance of such instrument of
<br />conveyance, most of the lands and premises ont of and across which said
<br />right of way tract was granted have been by the said grantors conveyed t o
<br />the Paris Independent School District, so that grantors, their successors
<br />or assigns will havelittle or no need or requirement for sewer taps or
<br />connections at or along the sanitary sewer line being constructed pursuant
<br />to such easement and grant; and,
<br />WFIEREAS, the City of Paris is in need of a further and additianal
<br />easement for sewer line purposes along and across the remaining portion of
<br />said Johnson's Woods which is owned by said grantors, and said grantors
<br />have agreed to make, execute and deliver the desired and requisite easement
<br />and instrument of conveyance for no consideration other than the contract,
<br />agreement, committment and obligation adopted and enacted by the Governing
<br />Body of the City of Paris wherein and whereby said grantors, their
<br />successors or assigns, shall be entitled to receive and have of and from
<br />the City of Paris such specified 40 sewer connections or sewer taps without
<br />the usual and customary charge at any point or place in or upon the sewer
<br />system of the City of Paris where such grantors, their successors or
<br />assigns shall elect; NOW, THEREFORE,
<br />BE IT RESOLVED BY THE CITY ODUNCIL OF THE CITY OF PARIS, That as
<br />payment for and in consideration of and for the grants and conveyances of
<br />sanitary sewer line easements by and from the said Charles M. Johnson,
<br />Virginia Hocker and husband, Otis B. Hocker, such grantors, their
<br />successors and assigns shall at any time in the future be entitled to re-
<br />ceive of and frora the City of Paris without any charge therefor the 40
<br />sanitary sewer line taps or connections to be made at any point or place
<br />in the City of Paris at and along its sanitary sewer system at such lo-
<br />cations, points and times as said grantors, their successors or:assigns,
<br />shall elect or direct. -a
