w ~ • • <br />RESOLUTION ND. bz6 <br />6'VHEREAS9 it appears to the City Council that there is a necessity <br />for the permanent paving and improvement of East Houston Street from 30th <br />N. E. to 31st N. E. Street, it appearing that concrete curbs and gutters <br />should be constructed along both sides of the paved portion of said street <br />and that said street should be paved from curb to curb with six inch (611) <br />compacted gravel base, with double asphaltic penetration wearing surface; <br />and, <br />WHEREAS, the vepartment of Public Works of the City of Paris has <br />reported to the City Council an estimated cost of $1.50 per front foot <br />for the required curb and gutter and a cost of $3.00 per running foot for <br />the paving; and, <br />WHEREAS, the City Council is willing to apply its existing street <br />paving policy whereby the abutting property owners are required to pay the <br />costs of building curb and gutter and such property owners are further re- <br />quired to pay one-third of the street paving cost for each foot of the <br />street on which said respective properties abut, with the City paying the <br />remaining one-third of snoh street paving costs; and, <br />WHEREAS, all of the persons owning property abutting on said East <br />Houston Street between 30th N. E. and 31st N. E. Streets have made satis- <br />factory arrangements with the administrative officials of the City oi' <br />Paris for the payment of their respective portions of the costs of such <br />pavement and curb and gutters under the application of the foregoing <br />policy, except the followings Guy Vdilliams, owner of Lot 11, Block 1, <br />Hayes Heights Addition to the City of Paris, which lot fronts 100 feet <br />on the South Boundary Line of said street, said curb and gutter being in <br />place for the width of said lot on that side of said street abutted by <br />the Guy VJilliams lot, the pro rata portion of the cost of paving saiij <br />street is $100.00; Dan Sales, owner of Lot 13, Block 1, Hayes Heights <br />Addition, which lot fronts 100 feet on the South Boundary Line of sa:id <br />street, and whose pro rata portion of the cost of suGh paving and cu;cb <br />and gutter is $250.00; M. A. Barber, owner of Lots 14 and 15, Block :L, <br />Hayes Heights Addition, which lots front 200 feet on the South Boundary <br />Line of said street and whose pro rata portion is $500.00; and Rober-t Vi. <br />Ferguson, owner of Lot 7, Block 3, Hayes Heights Addition, which lot <br />fronts 100 feet on the IVorth Boundary Line of said street, which latter <br />person has made satisfactory arrangements for the building of the recxuired <br />curb and gutter, but who has not made satisfactory arrangements for i:he <br />paving, the pro rata portion of the cost of paving said street for said <br />lot being $100.00; and, <br />WHEREAS, the said Dan Sales, M. A. Barber and Robert W. Ferguson, <br />together with their respective wives, have agreed to make, execute ar►d <br />deliver to the City of Paris a mechanic's and materialmen's lien on t:heir <br />said respective properties to secure the payment of their respective pro <br />rata portions of the costs of such street pavement and curb and gutter <br />construction for which satisfactory arrangements have not heretofore been <br />made; and <br />vdHEREAS, the said Guy Williams of Fort Worth, Texas, has failed <br />and refused to pay the pro rata portion of the costs of such pavement for <br />his property, described above, whereby it appears to the City Council <br />that assessments should be made and levied against the said Guy Williams <br />and his said property in the amount of $100.00; NOW, THEREFORE, <br />
