601 RES CITY COUNCIL, CHAMBER OF COMMERCE AND INTERESTED CITIZENS AND GROUPS REQUESTED TX ST PARKS BOARD TO DEVELOP ST PARK• • RESOLUTION N0. 601 _r WHEREAS, the City Councilt the Chamber of Comnerce and other in- terested citizens and groups have requested the Texas State Parks Board to develop a State Fark on City of Paris roperties known as the Lake Crook areag embracing approximately 2,717~ acrest including water and water shed areas; and, WHEREdS, the City Council, pursuant to such purpose and request, heretofore adopted Resolution No. 588, the language and provisions of which contained an initial proposal for submission to the Texas State Parks Board; and, WHEREiAS9 the Texas State Parks Board has reviewed and considered such resolution and heard the request and suggestions of representati.ves of various interested Paris and Lamar County groups, in response to vahich the State Parks Board has agreed to accept such offer of the Lake Crook area by Western Union wire dated October 17, 19559 addressed to the Honorable A. M. dlikin Jr., State Senator, at Parisg Texas, 5uch agreement and wire being in the following language, to-wits "STATE PARKS BOARD AGREES ?0 ACCEPT OFFER OF LAKE CROOK AREA (2717.5 ACRES) PROVIDED THERE ARE NO LIMITATIONS OR RE- STRICTIONS AS TO USE, OPERATION, MAINTENAIVCE OR DEVEIAPMENT; PROVIDED THAT STATE PARKS BOARD HAS RIGHT TO SELECT TWO HUIvDRED ACRES WHICH CITY WILL CONVEY IN FEE SIMPLE FOR FU?URE PERMNNENT IMPROVEMENTS; 9WD PROVIDED THAT STATE PARKS BOARD AiSO SHlILL HAVE AIV UNDIVIDED OAtE-HALF INTEREST IN HIINERALS IN THE REMAINIIVG TRACT OF 2517.5 d1CRES. HDWSLEY, CHAIRlNi11v TEXAS STAT& PARKS BOARD" NOW9 THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CI'IY OF PARIS, That the Texas State Parks Board be assured and infornaed of the continued purpose and desire of this Council that the Lake Crook area be offered and made available to the Texas State Parks Board for develoi;pment as a State Park on the following terms and conditions, to-wits (1) The City of Paris vrill lease or otherwise grant possession of the area to the State Parks Board for such term or such right of possession as it may desire. (2) There shall be no limitatimns or restrictions as to use* operationg maintenance or developiaent of any properties made available to the Texas State Parks Board; providedg howeverg that any grant or conveyance to the Texas State Parks Board zhall reserve unto the City of Paris the absolute and exclu-• sive use of the water of Lake Crook for water consumption purposes and shall obligate the Texas State Parks Board to use its best efforts to prevent contamination of the public water supply located at said Lake Crook and to comply with all recomnendations made by the Texas Health Department relative! to such public water supply. (3) The City of Paris will convey to the Texas State Parks Board in fee simple not to exceed two hundred (200) acres, for the use of the Board in making permanent improvementso such acreage to besalected by the Board. (4) The City Council is agreeable to the proposal that the State Parks Board shall be vested with one-half of the minexal rights as per their proposal.
