POLICY ISSUE(S): Report BACKGROUND: The first attachment is a brief accounting of what has been done this year. The second attachment is the Buildings and Standards Commission (BSC) spreadsheet on dilapidated structures. A flow chart and description of the process are also attached. This flow chart describes the process that code enforcement follows in dealing with substandard structures. Substandard structure is identified and tagged by Code Enforcement. (Sec 7-48) 2. Substandard structure is sent to Historic Preservation to determine if the structure can be sent through to Buildings and Standards Commission (BSC)(Sec. 7-50) A. HPC determines whether or not a structure is historically significant. If the structure is deemed historically significant, HPC can stop the structure from being demolished. If the structure is deemed not to have historical significance, HPC will send the structure to Buildings and Standards for demolition. HPC may also send a historically significant structure through to Buildings and Standards with the int:ention of only REPAIRING the structure. 3. Substandard structure is sent to BSC (Sec 7-49) A. Structure is researched on the appraisal district website and County Courthouse website to determine ownership and lien holders. B. Violation Notice is sent to property owner and lien holder. Violation Notice states nature of violation, address of violation, notice of hearing, actions necessary to correct violation, etc. Violation Notice is sent out ten (10) days prior to BSC rneeting by certified mail. C. Structure(s) is posted in the Paris News. Posting includes address of structure, owner information, time and date of ineeting, nature of violation, etc. This is done at least ten (10) days prior to BSC meeting. D. Structure(s) are taken before the BSC. 1. Structure is presented to the BSC by Code Enforcement. Owner may also present their intentions to the BSC at this time. 2. BSC deliberates and votes on structure. 3. Orders are placed on the structure. Orders state the necessary actions, and amount of time given, to bring the structure/property into compliance. 4. Orders are signed by BSC and Assistant City Attorney E. Orders are sent to owners and lien holders by certified mail. Orders are also posted in the Paris News and filed at the County Clerk's Office. This is done within ten 1(10) days after the BSC meeting. 1. If the Orders of the BSC are not followed: Code Enforcement sends a non- compliance notice to owners and lien holders stating that City can now take action against the structure/property (Sec 7-54) a. Demolition- Code Enforcement requests utility services removed, which can take up to 6 weeks. Once services have been removed, work orders are generated and given to demolition contractor. Once the structure is demolished, Code Enforcement files a lien against the property at the County Clerk's Office. b. Legal Action- Civil penalties may be assessed, or owners could be taken to municipal court. 2. If the Orders of the BSC are followed: Case closed. .11.
