RES OLUT I ON N0. 540 0 WHEREAS, The City of Paris, Texas deems it necessary to permanently improve the hereinafter named streets within the City of paris: NOVl, THEREFORE; BE IT RESOLVED BY THE CITY COUPICIL OF TI-E CITY 0=' PARIS; SECTION 1. That the follawing streets; (1) Washington Street from the P1est boundary line of 7th Street S.;V., ;'Yest to a point 780 feet West of such ltiest troundary line of said 7th Street Southwestj (2) Fitzhugh Avenue between Hickory Street and Blake Road) (3) 8th Street R'ortheast betwsen Hickory Street and Blake Road; (4) Blake Raad from its intersection with Fitzhugh, West a distance of 444 f eet; (5) Hickory Street fror., its intersection with Fitzhugh Avenue, 'West to its intersection with 8th Street Northeast; shs 11 be imprrnred in the fo llowing manne r, t o-wit ; (1) That said streets shall be cut and filled so as to bring the sama to grade; (2) That said streats shall be paved fron curb to curb with 6-inch, soil-asphalt base and single asphaltic surface treatment; (3) That concrete curba and gutters shall be constructed along both sides of the paved portions of said streets, provided thqt any eaisting curbs or gutters in place meeting the required speoifications, or which can be utliized, shall be left in plaae, if any, and corresponding credits to the property awners shall be allowed on the assessments; That the City of Pa.ris shall furnish and provide tre labor and materials, and pay the full cost af cutting, f illingend grading such streets, as well as the cost of paving the same, as specified above; that bids shall be tal:en for the oonstruction of the concrete curbs and/utters specified above, and such work shall be done with the rmterials and according to plans, methods and specifications seleoted by the City CotLncil after the bids are opened, and the whole cost of the construction of such curbs and gutters shall be paid by the awners of the property abutting on said streets named above to be paved, in the following manner, to-wit; The cost thereof shall be assessed against said awners and their property, respectively, in accordance with what is known as the`! "Front-Foot Plan", in proportion as the frontage of the property of each owner is to the whole fror..ta ;e improved and shall be payable in monthly installments not to exceed twelve (12) in number, the first of wY~.ich shqll be paye.ble within thirty days fron the date of the completion of said improvements and their acceptance by the City of Paris, and one installment ee.ch month thereafter until paid, together with interost thereon at the rate of nci (0?~) per cent per annum, with the pravision that any of said installments ma~, r be paid at any +imn hrafnrc mo+iirif-- 1—. +tw -.....o«4- ..-A 3-1... _«~.....'-_1 ---i-.- . • • ; i , ~ ' shall be made against an avrner of abutting property in excess of the benefits ' ? to sueh property in enhaneed value thereof Uy means of sueh improvements. For that part of the cost of the i.mprovements that shall be determined to be levied against the awners of abutting property and their property shall be levied by assessmants as herein provided, and said improvements a~y further be , se cured by Meahanic 's Liens to be eaecuted in favor of the City of Paris, provided by law in accordance with the tdrms and provisions of this resolution. : Paving certificates evidencing the assessments shall be issued in favor of the ' City of paris for the amount of the respective assessments, whether the respective praperty owners have executed bechanic's Liens to secure the pay- ment or not, and shall be payable for the use and benffit of the Current Ftuid of the City, established for the purpose of street Tmintenance and repair and other city activities. ~ That the Director of Public Works is hereby directed to prepare at once speaifications and file the same with the City Council for the hereinabbve described improvements. , SECTION 2. The City Council, in initiating this proceeding, is acting under M7 terms and prwisions of the Act passed at the First Called Session of the Fortieth LBgislature of the State of Texas, and lrnawn as Cha,pter 106 of the Acts of said Session, tn-,ether with any amendments thereto, now shown as Article 1105b of Vernon'5 Texas Civil Statutes, which said law, as an alter- native method for the construction of street improvements in the City of Paris, Texas, htts been adopted and made a part of the Charter of said City, being Section 11, Article II, of said Charter.
