• <br />RESOLUTION N0. 572 . <br />WHEREASv John H. Capers of Lamar County, Texas has petitioned the <br />City Council for permission to layv construct and maintain a one inch water <br />line along a designated course and direction across City of Paris proper- <br />ties known as the municipal airport property, located on 19th N. W. Street, <br />for the purpose of acquiring water for his private residential use at his <br />home near the City Limits and North West of the City of Paris; and, <br />WHEREAS, it appears that the Water Department of the City of Paris <br />may and should set a meter at the city limit line of the City of Paris on <br />19th N. W. Street for the purpose of delivering metered water into such <br />line and furnishing water to and for the said John H. Capers through the <br />s ame ; NOW, THEREFORE s <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That <br />permission be granted to the said John H. Capers to build and maintain a <br />one inch water line across said municipal airport properties along the <br />following course and direction, to-wits <br />Beginning at a point in the W.B. Line of F.M. Highway No. <br />79 (19th N. W. Street), said point being 234 feet North of the <br />most Easterly South East Corner of said municipal airport <br />properties, as measured along the East property line; Thence <br />in a North Westerly direction across said airport properties <br />944 feet to a point 29 feet West of the South West Corner of <br />the Will Stamper property, same being an inside corner of the <br />said airport property; Thence in a Northerly direction crossing <br />said air port properties 1485 feet to F.M. Highway No. 799 said <br />point being 815 feet West of the rnost Easterly Ilorth East Cor- <br />ner of said municipal airport properties. <br />Provided, however, that such one inch water line may be constructed <br />and maintained by the said John H, Capers with the understanding and agree- <br />ment that such agreement therefor shall be reduced to writing, signed and <br />properly executed by the Mayor of the City of Paris on behalf of said City <br />and the said John H. Caperst the contract and agreement for which shall <br />specify that the said John H. Capers will hold the City of Paris blameless <br />and without liability or obligation for any claim asserted against said <br />City and arising out of the construction and maintenance of such water <br />line by him, and further, that the said John H. Capers shall at his costs <br />remove and relocate the same or any part thereof at any time upon written <br />request from the City of Paris in the event it shall develop or appear that <br />the continued maintenance and use of such line at or along any specified <br />portion thereof will interfere with any proposed construction upon or use <br />of any part or portion of such airport properties. <br />Passed and adopted this 13th day of December, 1954. <br />~ <br />Mayor <br />ATTES T: <br /> <br />City Clerk. <br />APPROVED AS TO FORMs <br />City Attorney. <br />
