RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, SETTING THE DATE OF A SECOND PUBLIC HEARING
ON LEVYING AN ASSESSMENT ON BENEFITTED PROPERTY TO PAY
A PORTION OF THE COST OF THE EXPANDED SCOPE OF THE
SANITARY SEWER EXTENSION FOR THE COPE ADDITION,
SUBURBAN ESTATES ADDITION, GOLDEN ACRE ADDITION, AND
CERTAIN TRACTS IN THE E. CROW SURVEY ALONG MEADOWLARK
STREET, MOCKINGBIRD STREET, COPE STREET, PINE MILL ROAD,
THOMAS DRIVE, AND WELCH CIRCLE; MAKING OTHER FINDINGS
AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A
REPEALER; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, on the 12th day of July,
1999, in Resolution No. 99-085, approve the Pro Rata Sanitary Sewer Extension for the Cope
Addition along Meadowlark, Mockingbird, Cope and Pine Mill Streets, thence southerly to tie
into existing City collection systems, which could be best served by a pro rata sanitary sewer
extension, containing 8" PVC sanitary sewer line and appurtenances; and,
WHEREAS, by approving Resolution No. 99-085, the City Council determined it was
necessary for the protection of the health and welfare of the Cope Addition along Meadowlark,
Mockingbird, Cope, and Pine Mill Streets within the city of Paris for the City of Paris to extend
the existing eight inch (8") sanitary sewer line and to act in the capacity of sponsor under the
terms of Section IX of Subdivision Ordinance No. 1315 of the City of Paris with any refunds
due under the pro rata charges being paid to the City of Paris Water and Sewer Fund; and,
WHEREAS, at the time of approval of Resolution 99-085, the City Council found and
determined that, upon receipt of the request of the citizens for the aforesaid project, preliminary
plans, specifications, and an estimate of the total cost of the project were prepared and delivered
to the City Manager and considered at the regular Council Meeting of the City of Paris on the
14th day of June, 1999, and a public hearing concerning the same was set for the 12th day of
July, 1999, at which time such public hearing was held; and,
WHEREAS, after hearing the matters presented at the public hearing, the City Council
was of the opinion that it was in the best interests of the citizens of Paris, and particularly the
citizens in the vicinity of the proposed project, that the City of Paris act as sponsor for said
project which was necessary for providing adequate sewer service and for protecting the health,
safety, and welfare in the aforesaid area; and,
WHEREAS, the City Council finds and determines that the prior considerations and
determinations by City Council as contained in Resolution No. 99-085 as to the public necessity
and need for the aforesaid project have remained unchanged; and,
WHEREAS, the City Council finds and determines that, subsequent to the original
review of the aforesaid project, it has been determined by engineers on behalf of the City that
the aforesaid sanitary sewer extension for the Cope Addition project needs to be expanded to
accommodate additional properties in the Cope Addition, Suburban Estates Addition, Golden
Acre Addition, and certain tracts in the E. Crow Survey along Meadowlark Street, Mockingbird
Street, Cope Street, Pine Mill Road, Thomas Drive, and Welch Circle not within the scope of
the original project, such expanded project being consistent with the original considerations
regarding providing adequate sewer to the affected citizens in protecting the health, safety, and
welfare; and,
WHEREAS, the prior estimate for the cost of the project has now been escalated to a
total cost of $ plus engineering costs to accommodate the expanded scope
of said project; and,
WHEREAS, as a consequence, in order to comply with State law and City ordinance,
it is necessary to conduct a subsequent public hearing concerning the estimate of the project
cost, the public need and necessary for said project, to consider passing an ordinance levying an
assessment on benefitted property, and to receive input from the affected citizens and the
citizens in general regarding the aforesaid project; and,
WHEREAS, the City Council did heretofore, on August 13, 2001, in Resolution No.
2001-130, approve setting a public hearing concerning the same at the regular Council meeting
on October 8, 2001; and,
WHEREAS, due to scheduling conflicts the October 8, 2001, regular Council meeting
was consolidated with the Thursday, October 4, 2001, regular Council meeting, and the October
8, 2001, public hearing was changed by prior Resolution No. 2001-144 to the October 4, 2001
date; and,
WHEREAS, it would be right and proper to have a second public hearing concerning the
same at the regular Council meeting on Monday, November 12, 2001, at which time the City
Council will consider whether or not the project expansion and accompanying assessment
should be had; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That the City Council finds and determines that there is a public necessity in
order to preserve and protect the health, safety, and welfare of the citizens of the City of Paris
to construct the aforesaid project as currently proposed.
Section 3. That the estimate of the total cost for said project is now at $ for
engineering cost and $ for construction cost, for a total estimated cost of
$
Section 4. That a public hearing be held by and before the City Council of the City of
Paris in regular session convened on the 12th day of November, 2001, at 6:00 o'clock p.m., in
the Paris Junior College Applied Technology Building, Room 1016, at 2400 Clarksville Street,
Paris, Texas, at which time the matter of levying an assessment on benefitted property to defray
a portion of the cost of the expansion of the sanitary sewer line extension for the Cope Addition,
Suburban Estates Addition, Golden Acre Addition, and certain tracts in the E. Crow Survey
along Meadowlark Street, Mockingbird Street, Cope Street, Pine Mill Road, Thomas Drive, and
Welch Circle, thence southerly to tie into the existing City collection system will be considered.
Section 5. That any and all other resolutions in conflict herewith are hereby in all things
repealed.
Section 6. That this resolution shall be effective from and after its date of passage.
