BE IT RFSOLVED BY TfiE CITY COU2ICIL 0F =_1 CITY 01' PARIS that T.A. Binn.ion as 2~Iayor
of the Ci+y of Paris, Texas, be and is hereby given full authority to enter into a con-
tract v,rith The Paris Red Peppers, Inc* for the rental of the Paris Lunicipal Baseball
Park for the baseball season of the year 191+7, including the training season, the regu-
lar playing season, and the play-oPf season, upon the follovaing terms and conditions:
l.-The Paris Red Peppers, Inc. shall have full charge of the baseball p ark for the
duration of the season, including the training season, the regular playin.g season
and the play-off season, if any. .
2.-The Paris Red Peppers, Inc. shall pay for all ground maintenance and cleaning of
the entire preriises for and during the entire time the said baseball park is used
by them, or in their charge, whether they be glaying in Paris or elsewhere.
3.-The Paris Red Peppers, Inc* shall pay the City of Faris as rental for the use oP
said baseball park the sum of $900.00, plus Ten Dollars, ($10.00) for each night
game p].ayed in said baseball park by any team or teams. The said $10.00 for each
such night game is to be paid as rental for the use of said baseball park in ad-
dition to the said 0900.00, and shall apply to each night game played in said park
during the time said baseball park is used by or in charge oP The Paris Red Peppers,
Inc., when onp or more innings of baseball are played at night.
4.-The Paris Red Peppers, Inc* shall indemnify, sa4e and keep harmless the City of
Paris from any and all liabilitq of every kind, character and description arising
from or connected with thbir use, control or occunancy of said baseball Aark, and
The Paris Red Peppers, Inc, shall at all times during the term of their use or
control of said baseball park maintain in force a policy or policies of insurance
covering Pull public liability, indemnifying all persons for any and all damage or
personal injury sustained in or upon the premises oP said baseball park or any part
thereoP.
5.-The City of Paris shall pay for the electric lights used at said baseball park.
6•-The City of Paris shall maintain in.force fire and/or tornado insurance upon the
buildings connected with said baseball park in such amount as the City shall de-
termine. The Paris Red Peppers, Inc* shall pay all prmiums on all public liability
insurance, anci the City of Paris shall pay all premiums on fire or tornado insi:rance.

7.-The Paris Red Peppers, Inc. shall receive the entire proceeds of all games
played by their team on said premises, the proceeds of all advertising sold
for display of ads on the fences of said baseball park, and the proceeds of all
concessions.
8.-In addition to the rental above set out of $900.00 plus $10.00 for each night
game, the City of Paris shall receive ten per cent (%10) of the gross gate re-
ceipts, less federal tax, of all games pl.ayed in said baseball park in which
The Paris Red Peppers do not play.
9.-The Paris Red Peppers, Inc. shall have charge of the said baseball park only
during the training season, the regular pl.aying season and the play-off season,
if any, and at all other times during the year the City of Paris shall have
fLll and complete charge and contral of said baseball park. The Paris Red
Peppers, Inc. will be all owed access to the baseball park at all reasonable
and proper tinies to ready and maintain the grounds.
10.-The Paris Red Peppers, Inc. shall promptly surrender said baseball park to the
City of Paris at the end of the plap-off season, if there by a play-off between
The Paris Red Peppers and any other team of the League, and at the end of the
regular playing season if there be no such play-ofY. The said baseball park shall
be returned to the possession of the City of Paris clean and in as Cood condition as
when possession is taken, reasonable wear and tear from proper usage anly being
excepted.
11.-The said sum of $900.00 rental above mentioned shall be paid in ad4ance to The
City of Paris at the time possession of said baseball park is taken for the
trainin.g season by The Paris Red Feppers, Inc. Payment of the amounts due the
City of Paris from playing of night games and/or percentage of gate receipts as
hereinabove set out shall be Made monthly, the payment for each month to be made
betvaeen the lst and lOth of the followin-c- month.
12.-The failure of The Paris Red Peppers, Inc. to fully comply with any of the above
provisions shall ipso facto cancel and terminate any rental agreenent or contract
made in pursuance of this resnlution, and the City of Paris, by or through its
officers, servants, agents or employees, shall be authorized to ij$mediately enter
upon and take possessior_ of said baseball park vritihout liariJ.ity to any person ny
reasori of surh repossession.

The fact that it is necessary for The Paris Red Peppers, Inc. to have a definite
agreement ivith reference to the rental of a baseball park for the 1947 season in
order that they may make immediate arrangements to retain and exercise their baseball
franchise creates a public emergency vThich ks hereby declared, the rules and Charter
provisions prohibiting the passage of a Resolution at the neeting introduced an.d sub-
mitting sar:e to a Corunittee are suspended, and the s2.nne is accordir"ly dor_e, and this
P.esolution tvill take effect from and after its passaCe.
