RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, APPROVING THE PURCHASE OF ONE (1) MODEL YEAR
2002 OIL DISTRIBUTOR TRUCK FOR USE IN STREET DIVISION OF THE
PUBLIC WORKS DEPARTMENT; AUTHORIZING THE EXECUTION OF
A LEASE PURCHASE AGREEMENT AND ANY AND ALL OTHER
NECESSARY DOCUMENTS RELATED TO THE TRANSACTION
APPROVED HEREIN; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, on the 12th day of
November, 2001, in Resolution No. 2001-182, authorize the advertisement for bids for one (1) model
year 2002 oil distributor truck for use in the Parks and Rights-of-Way Division of the Public Works
Department, said bids to be received unti13:00 p.m. on the 4th day of December, 2001; and,
WHEREAS, the best bid for said equipment was made by Conley Lott Nichols of Longview,
Texas, and it should be awarded the bid for the same; and,
WHEREAS, it is further deemed appropriate that the City Manager be authorized to execute
a Lease Purchase Agreement for said equipment for a total purchase price of $95, 849.00, plus interest
at the rate of 5.574% and costs; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the City Manager be, and he is hereby, authorized and directed to execute,
on behalf of the City of Paris, a Lease Purchase Agreement upon such terms and conditions as
contained therein, at the price of $95,849.00, plus interest at the rate of 5.574% and costs, financing
the purchase of one (1) model year 2002 oil distributor truck for use in the Parks and Street Division
of the Public Works Department.
Section 3. That the City Manager, City Attorney, Finance Director, or other appropriate City
official shall be, and they are hereby, authorized and directed to execute any and all other necessary
documents related to the transaction approved herein.
Section 4. That this resolution shall be effective from and after its date of passage.

Attached is the bid tabulation for one (1) Oil Distributor Truck for use in
the Street Division of the Public Works Department. Two (2) bids were
received, only one meeting specifications.
After careful consideration, our recommendation is to award the bid to,
Conley Lott Nichols, 1511 W. Marshall Ave., Dallas, Texas 75604.
The bid submitted by Continental Equipment Company had many
deviations to our general specifications including the requirement for
DOT or ASME certifications to the tank design and construction. The
lack of these certifications represent a safety concern. A copy of the
deviations from this bidder have been included with this memo.
Funds for the purchase of this equipment are allocated in the Street
Division Budget.

on a cash purchase or a mon hly installment option as outlined elsewhere in these
specifications. The quality of the equipment supplied, conformity with the
specifications, the suitabiliry o expeded use. Delivery time, warranty terms and
parts availability may also be a consideretion in awarding bid.
G. The bidder shall include all t ansportation costs, training costs, and demonstration

GENERAL FUNCTION

It is important that the Distributor be capable of returning all material in the spray bar,
hand spray and diztributing lines t the Distributor tank by means of pump suction. This
function is to be accomplished wit iout reversing the asphalt pump.
Provision zhall be made for easily raining the circulating system independently of the tank
and for fluzhing circulating system nd pump with not more than three (3) quarts of fuel
oil so as not to dilute tank content .
