00-AGENDACITY COUNCIL AGENDA Notice is hereby given that the City Council of the City of Paris shall meet in regular session at 5:30 p.m. on Monday, October 22, 2012. The meeting will be held at the City Council Chamber, 107 E. Kaufman Street, in Paris, Texas. The matters to be discussed and acted upon are as follows: Opening Agenda 1. Call meeting to order. 2. Invocation. 3. Pledge of Allegiance. 4. Citizens' forum. (Persons desiring to address the Council must limit their presentation to no more than two minutes. Unless an item is posted on the Agenda, the Texas Open Meetings Act prohibits the Council from responding to any comments other than to refer the matter to a future agenda, to an existing policy, or to a staff person with specific factual information. Claims against the City, Council Members, or employees, as well as individual personnel appeals are not appropriate for citizens' forum.) Consent Agenda Items on the Consent Agenda are approved by a single action of the Council, with such approval applicable to all items appearing on the Consent Agenda. A Council Member may request any item to be removed from the Consent Agenda and considered as a separate item. 5. Approve minutes from the meetings on October 8, 2012 and October 15, 2012. 6. Receive reports and/or minutes from the following boards, commissions, and committees: a. Paris Economic Development Corporation (9-13-2012) b. Historic Preservation Commission (9-24-2012) 7. Receive September drainage ditch maintenance report. 8. Receive dilapidated structure report. 9. Discuss possible future amendments to the City of Paris Charter. 10. Approve the Routine Airport Maintenance Program (RAMP) Grant and authorizing the execution of a Grant Agreement for TxDOT Project No. AM2013PARIS. 11. Approve closing out the contract with NCM Demolition in the amount of $47,539.65 for the second phase of Hazardous Materials Remediation of the Grand Theater. 12. Approve the nomination of the "L.O. Hammons" sign as a Historic Sign located in the Downtown Historic District. Regular Agenda 13. Discuss, public hearing, first reading, and possibly act on an Ordinance designating a Historic District Overlay (HD) on Lot 20, City Block 131, located at 726 W. Sherman Street. 14. Discuss, second reading and act on an Ordinance disannexing a 3.00 acre tract and a 10.001 acre tract of land out of the Reddin Russell Survey 3A-786, located off of Stillhouse Road approximately 1.13 miles North of Loop 286, Paris, Lamar County, Texas. 15. Discuss, first reading and possibly act on an Ordinance authorizing the issuance of the City's General Obligation Refunding Bonds; appointing a representative of the City and delegating to the representative certain matters with respect to the sale of the Bonds; establishing parameters for the approval of such delegated matters; approving the use of an escrow agreement and a paying agent/registrar Agreement; engaging bond counsel; providing for the pledge of funds for the payment of the Bonds; and enacting other provisions relating to the issuance and sale of the Bonds. 16. Discuss and provide direction to city staff on a request from Guaranty Bond Bank to allow relocation of their existing billboard. 17. Discuss and act on a Resolution approving an application to the Texas Department of Transportation's statewide transportation enhancement program for funding of a two mile addition to the Trail de Paris; and authorize the City Manager to acquire two parcels of land for the project. 18. Discuss and act on approval of a deduction Change Order # 1 in the amount of $66,305.80, and closing out the contract with Four Thirteen Inc. in the amount of $27,884.93 for the 2011-2012 Water and Wastewater Capital Improvements. 19. Receive report, discuss and possibly act on drainage problem on York Street. 20. Receive and discuss update on the Grand Theater. 21. Convene into Executive Session pursuant to Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about pending or contemplated litigation and/or on matters in which the duty of an attorney to his client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with this chapter, as follows: • Ranger Abbott v. The City of Paris • CPC Coatings Claim 22. Reconvene into open session and possibly take action on those matters discussed in Executive Session. 23. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. 24. Adjournment.
