BACKGROUND:
George Ronald Shannon Sr. has requested a change in zoning to add a Historic District Overlay (HD),
on Lot 26, City Block 131, being number 726 West Sherman Street. Mr. Shannon is requesting the
overlay district to preserve and protect his historical home.
The Historic Preservation Commission recommended approval of this request on September 24, 2012,
by a vote of 4-0, with 1 abstaining.
One individual spoke in favor of the request.
One spoke in opposition to the request.
The Planning and Zoning Commission recommended approval of this request on October 1, 2012, by a
vote of 4-0.
One individual spoke in favor of the request.
No one spoke in opposition to this request.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE N0. 1710 OF THE CITY OF PARIS,
TEXAS, ESTABLISHING A HISTORIC OVERLAY DISTRICT (HD), ON LOT
20, BLOCK 131 BEING 726 WEST SHERMAN STREET, IN THE CITY OF
PARIS, LAMAR COUNTY, TEXAS IN ACCORDANCE WITH THE
RECOMMENDATIONS OF THE PLANNING AND ZONING COMMISSION
AND THE HISTORIC PRESERVATION COMMISSION; PRESERVING THE
EXISTING USE AND ZONING DESIGNATIONS OF THE PROPERTY SO
DESIGNATED; DESIGNATING THE BOUNDARIES OF THE HISTORIC
OVERLAY (HD) SO ESTABLISHED; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER
CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY
CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris, Texas, has received a request from the
Paris Historic Preservation Commission, following notice to the owner and a public hearing
thereon, for an amendment to the zoning ordinance of the City of Paris to establish a Historic
Overlay District (HD) on Lot 20, Block 131, being 726 West Sherman Street in the City of Paris,
Texas; and,
WHEREAS, on September 24, 2012 the Historic Preservation Commission reviewed and
recommended that the Historic Overlay District on this property be approved in accordance with
the City zoning ordinance and State law; and,
WHEREAS, on October 1, 2012, and, the Planning and Zoning Commission did conduct
a public hearing on said proposed amendment to the City zoning ordinance and, following said
hearing, made formal recommendation to the City Council regarding said proposed Historic
Overlay District; and,
WHEREAS, on October 22, 2012 the City Council of the City of Paris did subsequently
conduct a public hearing on the aforesaid proposed amendment to the City zoning ardinance, and
having considered the recommendations of the Planning and Zoning Commission and the
testimony and evidence introduced at said public hearing, found and determined that the house
located on the property is almost 100 years old and represents a historical architectural style from
that period and that a historic overlay district would be appropriate for the property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in all
things approved.
Section 2. That the boundaries heretofore established by City Zoning Ordinance No.
50
1710 of the City of Paris, Texas, as previously amended, is hereby further amended to add a
Historic Overlay District (HD) on Lot 20, Block 131, being 726 West Sherman Street in the City
of Paris, Texas, as recommended by the Paris Historic Preservation Commission and the
Planning and Zoning Commission, while preserving the respective existing use and zoning
regulations of the property previously designated thereon.
Section 3. That the Chief Building Official of the City of Paris be, and he is hereby,
directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes
set forth in this ordinance.
Section 4. That the City's Historic Preservation Ordinance, Art. VII, Chapter 7. City of
Paris Code of Ordinances, the City's Design Standards for Historic Districts located in the City
of Paris Texas and the Secretary of the Interior's Standards for the treatment of Historic
Properties, and incorporated herein by reference and shall apply to the property encompassing
the Historic Overlay district created by this ordinance.
Section 5. That any person violating any provision of this ordinance shall be guilty of
a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of
Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's
continuance of any violation of the above-enumerated sections shall constitute and be deemed
a separate offense.
Section 6. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 7. That the City Council voted by a supermajority vote of the entire
Council to suspend the rule requiring two readings before adoption of ordinances ayes
and _ nays.
Section 8. That this ordinance shall become effective from and after its passage of
the first reading and publication as required by law.
PASSED AND ADOPTED by the City Council of the City of Paris, Texas in regular
session on October 22, 2012.
