PROJECT: Consider a resolution authorizing the purchase of one (1) model year 2002, 4 wheel drive
loader/backhoe for the Water/Sewer Division of the Public Works Department from the Houston-Galveston
Area Council of Governments/Cooperative Purchasing Program (HGAC).
BACKGROUND: This purchase was approved by the City Council at its November 12, 2001, regular Council
meeting. After the purchase was approved, the HGAC revised its vendor specifications and bids for said
equipment which failed to meet the City's minimum specifications.
DESCRIPTION: Approval ofthe proposed resolution will repeal the prior resolution approving the purchase
of the equipment through the HGAC and authorize the City to advertise for bids.
RECOMMENDED ACTION: Approve the proposed resolution.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, REPEALING RESOLUTION NO. 2001-183 AND
AUTHORIZING THE ADVERTISEMENT FOR BIDS FOR ONE (1) MODEL
YEAR 2002, 4-WHEEL DRIVE BACKHOE/LOADER FOR USE IN THE
WATER AND SEWER DIVISIONS OF THE PUBLIC WORKS
DEPARTMENT; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, on the 12th day of
November, 2001, in Resolution No. 2001-183, authorize the City Manager to execute a purchase
order to the Houston-Galveston Area Council of Governments (HGAC) for one (1) Model Year
2002, 4-Wheel Drive Backhoe/Loader for use in the Water and Sewer Divisions of the Public Works
Department; and,
WHEREAS, after said purchase was approved, the HGAC revised its vendor specifications
and bids for said equipment, and said revisions failed to meet the City's minimum specifications;
therefore, it is deemed appropriate that the City repeal said Resolution No. 2001-183 and advertise
for bids for the purchase of said equipment; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That Resolution No. 2001-183, passed and adopted by the City Council of the
City of Paris on November 12, 2001, be, and the same is hereby, repealed.
Section 3. That the purchase of one (1) Model Year 2002, 4-Wheel Drive Backhoe/Loader
for use in the Water and Sewer Divisions of the Public Works Department be advertised for bids
to be received after due notice at the office of the City Manager of the City of Paris, City Hall,
135 1 st Street S.E., Paris, Texas 75460, unti13:00 o'clock p.m. on the 8th day of January, 2002,
at which time said bids will be opened, tabulated, and then presented to the City Council for the
purpose of letting such bid.
Section 4. That this resolution shall be effective from and after its date of passage.

PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A PURCHASE
ORDER FOR ONE (1) MODEL YEAR 2002 4WHEET, ARIVE
BACKHOE/LOADEB FOR USE IN THE WATER AND SEWER DIVISIONS
OF THE PUBLIC WORKS DEPARTMENT THROUGH THE HOUSTON-
GALVESTON AREA CpUNCIi, OF GOVERNMENTS; MAKING OTHER
FINDINGS AND PROVISIONS RELA'I'ED TO THE SUBJECT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Paris has been a member of the Cooperative Purchasing Program
through We Houston-Galveston Area Council of Governments since October 1, 1990; and,
WHEREAS, it is deemed appropriate that the City of Paris purchase a backhoe/loader for
use in the Water and Sewer Divisions of the Public Works Department through said Houston-
Galveston Area Council of Governmenis; and,
WHEREAS, it is further deemed appropriate that the City Manager be authorized to
execute a purchase order for one (1) Model Year 2002 4-Wheel Drive Backhoe/Loader for a total
purchase price of $66,061.51, which represenu the cost of the backhoe/loader, which is
$64,989.19, plus the cost of the Houston-Galveston Area Council of Governments fee, which is
$1,072.32; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That the City Manager be, and he is hereby, authorized and directed to execute,
on behalf of the City of Paris, a purchase order for one (1) Model Year 2002 4-Wheel Drive
Backhoe/Loader for use in the Water and Sewer Divisions of the Public Works Department for
a total purchase price of $66,061.51, which represents the cost of the backhoe/loader, which is
$64,989.19, plus the cost of the Houston-Galveston Area Council of Governments fee, which is
$1,072.32.
Section 3. That this resolution shall be effective from and after its date of passage.
