—� —. <br />ORDINANCE N0. �8-049 <br />AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, <br />PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE <br />AMENDED BY REVISING SECTION 16-1 OF SAID CODE; PROVIDING <br />FOR THE REGULATION OF DONATION RECEPTACLE USE AND <br />PROHIBITING PILFERING OF THE SAME; PROVIDING FOR A PENALTY <br />NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS <br />OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN <br />EFFECTIVE DATE OF DECEMBER l, 1988. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS: <br />Section l. That Section 16-1 of the Code of <br />Ordinances of the City of Paris, Paris, Texas, be amended so <br />that such shall read as follows: <br />"Sec. 16-1. Littering prohibited. <br />(a) . . . <br />(b) . . . <br />(c) When property is deposited in or near a <br />donation receptacle on private, semi-public or <br />public property, the donation becomes the property <br />of the agency whose receptacle it is in or near. <br />Any person pilfering through a donation <br />receptacle or property deposited near a donation <br />receptacle is presumed to be doing so f_or the <br />purpose of attempting to convert such to their own <br />use. <br />It shall be unlawful for any person to <br />scatter, dump, pile, leave or lay any I.itter upon <br />any public street, public street right-of-way, <br />sidewalk, other public property, or upon any <br />premises belonging to another person." <br />Section 2. Any person violating any of the <br />provisions of this ordinance shall be guilty of a <br />Misdemeanor, and u on conviction shall be fined in any sum <br />not to exceed �2,000.00, and each and every day's <br />continuance of any violation of the at�ove enumerated section <br />shall constitute and be deemed a separate offense. <br />Section 3. Al1 ordinances or parts of ordinances in <br />conflict herewith are hereby expressly repealed. <br />Section 4.
