RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, AUTHORIZING THE EXECUTION OF DEEDS OF
ABANDONMENT TO THE ADJACENT PROPERTY OWNERS OF A 20
FOOT ALLEY ABANDONED BY ORDINANCE NO. 2002-
BEGINNING AT THE WEST BOUNDARY LINE OF 13TH STREET N.W.
GOING WEST TO THE EAST BOUNDARY LINE OF 14TH STREET N.W.
LOCATED BETWEEN BONHAM STREET (U.S. HWY 82) AND MAPLE
AVENUE IN CITY BLOCK 189; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, it has been called to the attention of the City Council of the City of Paris
that there is a twenty (20) foot alley running east and west, BEGINNING at the west boundary
line of 13th Street N. W. going west to the east boundary line of 14th Street N. W. located in City
Block 189; and,
WHEREAS, it has been called to the attention of the City Council by petition of the
property owners that the alley is not desired by the property owners adjacent to said alley but
that said alley is of use and necessary to the City of Paris and its citizens for drainage and utility
easement purposes; and,
WHEREAS, the City Council, by prior Ordinance No. 2002- adopted January 10,
2002, has authorized the City to abandon the City's interest in the aforesaid alley; and,
WHEREAS, it is deemed appropriate that the City's interest in said alley be conveyed
to the adj acent owners on either side of said alley and that drainage and utility easements be
retained; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That the Mayor of the City of Paris, be, and he is hereby, authorized and
directed to execute, on behalf of the City of Paris, deeds of abandonment conveying to the
adjacent owners on either side of said alley, in accordance with the laws of the State of Texas,
the City's interest in the abandoned twenty (20) foot alley located between Bonham Street (U. S.
Hwy 82) and Maple Avenue in City Block 189, beginning at the west boundary line of 13th
Street N.W. going west to the east boundary line of 14th Street N.W., it appearing that the real
and true owners of the hereinafter described lots are as follows:
Lots 1& 2, City Block 189
Lot 4, City Block 189
Lots 5, 6, & 7, City Block 189
Lot 8, City Block 189
Lot 9, City Block 189
Nita Aiken, Owner
Louise Roth, Owner
Kevin Clarkson, Owner
R. J. Brannon, Owner
George Jennison, Owner
Section 3. That the City of Paris retain drainage and utility easements in the area to be
abandoned as described in the above-referenced deeds of abandonment, with such conditions,
restrictions, and reservations unto the City of Paris as established by prior Ordinance No. 2002-
Section 4. That this resolution shall be effective from and after its date of passage.
