The Planning and Zoning Commission met Monday, December 3, 2001, 5:30
P.M., Paris Junior College, Applied Technology Building, Room 1016, 2400
Clarksville Street, Paris, Texas with the following members present:
1. Reeves Hayter
2. Curtis Fendley
3. Eddie Vincent
4. Cleveland Thomas
5. Marshall Kent
6. Louis Yates, Jr.
7. Bobby L. Myers
Steve Methven, the building official was also present.
The meeting was called to order by Reeves Hayter.
The minutes from the November 5, 2001, regular planning and zoning
meeting were approved with a motion by Curtis Fendley and seconded
by Bobby Myers. Motion carried by a vote of 7 ayes and 0 nays.
Public Hearing to consider the petition of Greg Caton for a change in
zoning from a Commercial District (C) to a Commercial District (C)
With Specific Use Permit (52) Signs and Billboards, Lot 2, City Block
318, being number 3005 NE Loop 286.
The public hearing was declared open.
Greg Caton spoke in favor of the petition stating that he wants to erect
a 10' X 30' billboard on the Texaco service station property.
There was no opposition, the public hearing was declared closed.
Consideration of and action on the petition of Greg Caton for a change
in zoning from a Commercial District (C) to a Commercial District (C)
With Specific Use Permit (52) Signs and Billboards, Lot 2, City Block

Greg Caton, of Tyler, Texas, spoke in favor of the petition requesting
a billboard sign permit for the Texaco service station.
There was no opposition, the public hearing was declared closed.
Consideration of and action on the petition of Greg Caton for a change
in zoning from a Commercial District (C) to a Commercial District (C)
With Specific Use Permit (52) Signs and Billboards, Lot 5, City Block
307, being number 2805 N. Main.
Motion was made to approve by Louis Yates and seconded by Eddie
Vincent. Motion carried by a vote of 7 ayes and 0 nays.
Public Hearing to consider the petition ofRickie Gheen for a change in
zoning from a Multiple-Family Dwelling District No. 1 (MF-1) to an
Office District (O), Lot 5, City Block 109, being number 717 E. Austin.
The public hearing was declared open.
There was no one present to speak in favor of the petition.
Joe Collins, 737 E. Austin spoke in opposition to the petition stating that
he wasn't sure of what the zoning change would do to his property
which is located next door. Mr. Collins stated that he was interested in
purchasing the property but the Realtors were not very helpful.

There was no further opposition, the public hearing was declared
closed.
Consideration of and action on the petition of Rickie Gheen for a
change in zoning from a Multiple-Family Dwelling District No. 1 (MF-1)
to an Office District (O), Lot 5, City Block 109, being number 717 E.
Austin.
Motion was made to deny the petition by Curtis Fendley and seconded
by Louis Yates. Motion carried by a vote of 7 ayes and 0 nays.
Public Hearing to consider the petition of Kevin Powell for a change in
zoning from a Two-Family Dwelling District (2F) to a Two-Family
Dwelling District (2F) With Specific Use Permit (25) Day Care Center,
Lot 30, City Block 61, being number 533 6th Street NE.
The public hearing was declared open.
Kevin Powell, 533 6th Street NE, spoke in favor of the petition stating
that he is seeking the specific use permit for a Day Care Center to help
the neighborhood which is deteriorating. This center will be run by
Mrs. Powell who has 25 years day care experience.
There was no opposition, the public hearing was declared closed.
Consideration of and action on the petition of Kevin Powell for a
change in zoning from a Two-Family Dwelling District (2F) to a Two~
Family Dwelling District (2F) With Specific Use Permit (25) Day Care
Center, Lot 30, City Block 61, being number 533 6th Street NE.
Motion was made to approve by Louis Yates and seconded by Bobby
Myers. Motion carried by a vote of 7 ayes and 0 nays.
Consideration of and action on the recommendation of the Replat, Lots
8, 9, and 10, Lot 1, Fitzhugh Addition, being numbers 1030, 1040, and
1050 Fitzhugh.

Myers subject to the City Engineer's Memo, dated, November 26, 2001.

Request to abandon 20 foot alley from 13th St. N.W. to 14th St. N.W. between
Bonham Street and Maple Avenue
I have reviewed the resolution for the above referenced alley abandonment. The alley contains a
sanitary sewer line and is used for drainage, therefore a 20 foot Utility & Drainage easement
would be required. I recommend approval of the resolution with an easement being retained for
the sewer line and drainage.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, REFERRING A PETITION TO THE PLANNING AND
ZONING COM~IISSION REQUESTING THE ABANDONMENT OF A
TWENTY (20) FOOT ALLEY BEGINNING AT THE WEST BOUNDARY
LINE OF 13TH STREET N.W. GOING WEST TO THE EAST BOUNDARY
LINE OF 14TH STREET N.W. LOCATED BETWEEN BONHAM STREET
(U.S. HWY 82) AND MAPLE AVENUE IN CITY BLOCK 189, SUBJECT TO
AND RESERVING THEREON A PERPETUAL TSVENTY (20) FOOT
UTILITY AND DRAINAGE EASEMENT; SETTING PUBLIC HEARINGS;
MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris is in receipt of a petition from adjacent
property owners requesting that the twenty (20) foot alley be abandoned from 13th Street N.W.
west to the east boundary line of 14th Street N.W. located between Bonham Street (U.S. Hwy.
82) and Maple Avenue; and,
WHEREAS, the City Engineer of the City of Paris has recommended the abandonment
of said alley, subject to the reservation of a perpetual twenty (20) foot wide utility and drainage
easement thereon; and,
WHEREAS, it is deemed to be in the best interests of the citizens of Paris that such
request for alley abandonment be reviewed by the Planning and Zoning Commission of the City
of Paris and that a recommendation be made to the City Council for final action; and,
WHEREAS, it is fitting and proper that a public hearing be set before the Planning and
Zoning Commission at 5:30 p.m. on the 7th day of January, 2002, and before the City Council
. at 6:00 p.m. on the 10th day of January, 2002, in the Paris Junior College Applied Technology
Building, Room 1016, 2400 Clarksville Street, Paris, Texas; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That the matter of abandoning the twenty (20) foot alley from 13th Street
N.W. west to the east boundary line of 14th Street N.W. between Bonham Street (U.S. Hwy 82)
and Maple Avenue, subject to and reserving thereon a perpetual twenty (20) foot utility and
drainage easement, be, and the same is hereby, referred to the Planning and Zoning Commission
of the City of Paris for its recommendation.
Section 3. That a public hearing be held by and before the Planning and Z6ning
Commission of the City of Paris at 5:30 p.m. in the Paris Junior College Applied Technology
Building, Room 1016, 2400 Clarksville Street, Paris, Texas, on the 7th day of January, 2002, and
that a public hearing be held by and before the City Council of the City of Paris at 6:00 p.m. in
the Paris Junior College Applied Technology Building, Room 1016, 2400 Clarksville Street, Paris,
Texas, on the 10th day of January, 2002, said public hearings to be held concerning the
abandoning of said alley.
Section 4. That this resolution shall be effective from and after its date of passage.
PASSED AND APPROVED this 6th day of December, 2001.

SUBJECT: Paris Towne Crossing Addition
I have reviewed the plat of the above referenced addition. It appears that the re-plat complies
with the City of Paris subdivision regulations with the following exceptions and/or additions.

A drainage easement needs to be added for the creek on the west side.
The easement to extend from the center line of the creek to the western
boundary of the property and from the center line of the creek 40 feet to
the east.
The portion of sanitary sewer easement on lot 3 needs to be removed; this
will be a private line past the property line.
There is a misprint on lot 1 that shows a 10'xl0' Util. Esmt.; this should
be shown as a 10' Utility easement.
A 30 feet drainage easement is needed for lot 1 for all storm sewer pipe
and for the pilot channel in the detention pond between the two pipes.
In the legal description of the plat there is a call out missing (N 72^ 55'
00") that should be added at the southwest comer across the end of 30th
Street NE.
There is a discrepancy in the call out after the missing call out, the plat
shows a dimension as 27.74 feet and the legal description shows it as
27.73 feet. The Surveyor should determine which one is correct and
change the other one.
I recommend approval of the plat upon completion of the above items.
