A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, DECLARING AS SURPLUS PROPERTY ONE (1) MODEL YEAR 1997 FORD F350 TYPE 1 AMBULANCE; FINDING A PUBLIC NEED AND NECESSITY IN TRANSFERRING SAID SURPLUS PROPERTY TO THE LAMAR COUNTY CHAPTER OF THE AMERICAN RED CROSS; ACCEPTING THE DONATION FROM THE LAMAR COUNTY CHAPTER OF THE AMERICAN RED CROSS AND THE CONTRIBUTION FROM LAMAR COUNTY, IN ACCORDANCE WITH THE CURRENT AMBULANCE CONTRACT WITH LAMAR COUNTY, TO DEFRAY A PORTION OF THE VALUE OF THE VEHICLE AS A TRADE-IN TOWARDS THE PURCHASE OF A NEW AMBULANCE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City EMS Ambulance Service has identified an existing model year 1997 Ford F350 Type 1 Ambulance, designated Medic 4 by the City Ambulance Service, as a vehicle and piece of equipment, because of age, mileage, and use, no longer considered necessary for ambulance purposes and thereby considered surplus equipment; and, WHEREAS, the City Council of the City of Paris, Paris, Texas, desires to designate said ambulance as surplus equipment; and, WHEREAS, the practice of the City in the past has been to utilize such surplus ambulance equipment for its trade-in value in acquiring new ambulance equipment; and, WHEREAS, the Lamar County Chapter of the American Red Cross by and through its Executive Director , Ms. Lisa McAllister, has petitioned the City Council of the City of Paris to transfer said equipment to the American Red Cross for subsequent use as a disaster relief vehicle; and, WHEREAS, the aforesaid surplus vehicle has value to the City of Paris only as a trade-in vehicle for purposes of acquiring a new ambulance, and the trade-in value of said vehicle has been established as $15, 503 .00 based on prior Resolution No. 2001-184, adopted on November 12, 2001, and the City Council authorized the City Manager to utilize said surplus vehicle as a trade-in to the Houston-Galveston Area Council of Governments at the value of $15,503.00; and, WHEREAS, to the extent a portion of the value of said vehicle as a trade-in should be reimbursed to the City, the Lamar County Chapter of the American Red Cross has offered $7,000.00 to defray in part the value of the vehicle as a trade-in; and, WHEREAS, the Commissioners Court of Lamar County likewise has petitioned the City, on behalf of Lamar County, to act favorably on the request of the Lamar County Chapter of the American Red Cross for transfer of the aforesaid surplus vehicle to be used as a disaster relief vehicle by the Red Cross, and in so doing, Lamar County has authorized payment of forty percent (40%) of the remaining value of the trade-in after the adjustment for the $7,000.00 contributed by the Red Cross, or forty percent (40%) of $8, 503.00, to be paid pursuant to the County's current contract with the City of Paris for ambulance service, whereby Lamar County pays forty percent (40%) and the City of Paris pays sixty percent (60%) of the unreimbursed cost of the expenses of said ambulance service; and, WHEREAS, the Red Cross has indicated such a disaster vehicle would be used to treat local victims of the city and the county in a disaster; would be used as a canteen to serve food, provide blankets, and other basic necessities during a disaster; would be used in the city and the county as a first aid station for a variety of community purposes; and would be used to replace an existing disaster vehicle currently in a state of disrepair; and, WHEREAS, the City Council finds and determines that the transfer of said surplus vehicle to the Lamar County Chapter of the American Red Cross, and the purposes to which it would be utilized as a disaster relief vehicle, constitute a public purpose and use to the betterment of the public health, safety, and welfare of the citizens of the city of Paris; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That a model year 1997 Ford F350 Type 1 Ambulance, Vehicle Identification Number IFDKF3FOVEBI8087, currently designated by the City EMS Service as Medic 4, because of its age, mileage, general condition, and extensive use, shall be and is hereby designated as obsolescent and surplus property no longer appropriate for use as an ambulance by the City of Paris EMS Ambulance Service. Section 3. That the offer of a$7,000.00 contribution by the Lamar County Chapter of the American Red Cross to defray a portion of the value of the Medic 4 ambulance as a trade-in towards the purchase of a new ambulance is hereby accepted. Section 4. That the offer of Lamar County to defray forty percent (40%) of the value of the Medic 4 ambulance as a trade-in vehicle towards the purchase of a new ambulance, the same being forty percent (40%) of $8,503.00, or $3,401.20, said amount to be paid by Lamar County pursuant to and in accordance with the County's current contract with the City of Paris whereby Lamar County pays forty percent (40%) and the City of Paris pays sixty percent (60%) of the unreimbursed expense of operating the emergency ambulance service, is hereby accepted. Section 5. That because of the overwhelming public purpose to be served as specified in this resolution by using said surplus vehicle as a disaster relief vehicle, the aforesaid surplus vehicle is hereby authorized for transfer to the Lamar County Chapter of the American Red Cross. Section 6. That this resolution shall be effective from and after its date of passage. PASSED AND APPROVED this 14th day of January, 2002. Michael J. WHEREAS, the City EMS Ambulance Service has identified an existing model year 1997 Ford F350 Type 1 Ambulance, designated Medic 4 by the City Ambulance Service, as a vehicle and piece of equipment, because of age, mileage, and use, no longer considered necessary for ambulance purposes and thereby considered surplus equipment; and, WHEREAS, the City Council of the Ciry of Paris, Paris, Texas, has heretofore authorized the exchange of said surplus vehicle as a trade-in towards the purchase of a new ambulance, with a trade-in value of $15,503.00; and, WHEREAS, the Lamar Counry Chapter of the American Red Cross, by and through its Executive Director, Lisa McAllister, has petitioned the City Council of the City of Paris to transfer said equipment to the American Red Cross for subsequent use as a disaster relief vehicle; and, WHEREAS, the Lamaz County Chapter of the American Red Cross has offered a donation in the amount of $7,000.00 to defray a portion of the value of the aforesaid surplus vehicle as a trade-in for a new ambulance; and, WHEREAS, in order to support the City of Paris and the American Red Cross in the endeavor to provide the Red Cross a disaster relief vehicle, the Lamar County Commissioners Court desires the expenditure by Lamaz County of forty percent (40°l0) of the remaining trade-in value of the surplus vehicle, that is, forry percent (40%) of $8,503.00, or $3,401.20, as said forty percent (40%) represents the County's shaze of the unreimbursed expense of operating the ambulance service pursuant to the existing ambulance service contract between Lamaz County and the City of Paris; NOW, THEREFORE, BE IT RESOLVED BY THE LAMAR COUNTY COMMISSIONERS COURT: Section 1. That the findings set out in the preamble to this resolution are hereby in all tttings approved. Section 2. That Lamaz County does hereby endorse and support the transfer of an existing model year 1997 Ford F350 Type 1 Ambulance, designated Medic 4 by the Ciry of Paris Ambulance Service, to be transfened by the City of Pazis to the Lamar County Chapter of the American Red Cross for subsequent use as a disaster relief vehicle. Section 3. That in support of such transfer of said vehicle, Lamar County does hereby authorize the expenditure of $3,401.20, which represents forty percent (40%) of the unreimbursed cost of the trade-in value of the aforesaid ambulance, to be paid to the Ciry of Paris, consistent with and in accordance with the County's existing contract with the City of Paris for emergency ambulance service whereby Lamaz County pays forty percent (40%) and the City of Paris pays sixty percent (60%) of the unreimbursed expense of operating the ambulance service.
