1. The Board of Adjustment meeting was called to order by Rick Hundley, Chairman at 12:00
p.m.

2. Approval of minutes from previous meetings. (July 17, 2012)
Motion was made by Charles Richards, seconded by Nathan V. Bell to approve minutes for
the July 17, 2012 meeting, with corrections. Motion carried 4-0.
3. Public hearing and consideration of and action on the petition of Marx Offutt to grant
variance of Fence Ordinance No. 2008-008, Section 11.5-3(b)(1) which prohibits front
yard fences except (1) on lots zoned Historic Overlay District (HD), (2) on lots in excess of
2 acres in size which are used for single family residential purposes, and (3) on lots which
are zoned and used for LI or HI purposes, to allow a front yard fence in a Commercial
District on Lot 6, City Block 91, being number 610 North Main Street.
Public hearing was declared open.
A. The following individuals spoke in favor of the petition:
Man{ Offutt, 4808 CR 22880, property owner spoke in favor of the petition. Mr.
Offutt stated he is proposing to remove the existing fence and replace it with a pipe
fence to protect the car lot. Mr. Offutt further stated that 90% of the used car lots

have this type of fencing around their properties along North Main. The removal of
the old fence and the addition of the new fence will greatly improve the look of the
lot.
B. No one spoke in opposition.
Public hearing was declared closed.
Commissioner Charles Richards stated that there are similar fences all up and down North
Main Street.
Motion was made by Jerry Haning, seconded by Nathan V. Bell to approve the variance.
Motion carried 4-0.
Bryan Glass arrived at 12:05.
4. Public hearing and consideration of and action on the petition of Temple of Deliverance
Church to grant a variance of Zoning Ordinance 1710, Section 10-103 which provides that
"a church or other place of worship, shall provide one parking space for each three seats
in the main auditorium to allow one parking space for every 6. S seats in the main
auditorium, this would be a reduction in required parking spaces from SS to 25 spaces
which would be a variance of 30 parking spaces, on Lot 1, Block A, Temple of Deliverance
Church Addition, being located in the 500 Block of Graham Street.
Public hearing was declared open.
A. The following individuals spoke in favor of the petition:
Vicky Ladell, 1615 Johnson Street, church member, spoke in favor of the petition.
Ms. Ladell stated she knows that the ordinance requires 55 spaces for a church of
this size; however, they currently only have 19 members in the church and with the
proposed parking of 25 spaces they could support up to 75 members. They will add
parking as the church grows. Ms. Ladell further requested commissioners to grant
the variance.
Randy Reece, 610 39th Street S.E., design professional, spoke in favor of the
petition. Mr. Reece stated the City has granted a 20 percent variance
administratively, however the required parking would still cost the church over
$100,000 dollars. Mr. Reece further stated as the church grows they can add
additional parking.
Betty Gains, 510 7th Street N.E., church member, spoke in favor of the petition.
Ms. Gains stated this is a small church and membership is at 12 members. Ms.
Gains further asked the commissioners to please grant the variance and as the
church grows they will add parking.

Commissioner Jerry Haning stated he has questions regarding special events, were will
people park when there are special services. Ms. Ladell stated they will all be parking on
the property itself, no one will park on Graham Street. Motion was made by Charles
Richards, seconded by Bryan Glass to approve the variance request. Motion carried 5-0.

Main Street Advisory Board
Regular Meeting Tuesday, October 16, 2012

Meeting called to order at 4:03pm by Chairman Matt Coyle.
Roll call by Jeanna Scott filling in for Main Street Manager Cheri Bedford
Present: Casey Ressler, Matt Coyle, Britin Bostick, Jill Drake, Fred Green, Becky Semple and Jeanna Scott
Absent: Karie Raulston, Ashlea Mattoon
September minutes were approved as presented, motion made by Casey, seconded by Jill.
Main Street Manager's Report (read by Matt Coyle in Cheri's absence):
• Festival of Pumpkins has 82 vendors currently. Info is on website and board members need
to help spread the word about streets being closed Friday night through Saturday night. The
Main Street booth will be on the southeast corner of the Plaza and will serve as info central.
Volunteers can sign up with Casey. Maps of vendors, prizes and lost kids will be located at
this booth. Matt Coyle and Paul Denney will guide tours of the Grand Theater. Get your shirt
size to Jeanna for Festival t-shirt. Zombie Walk will be at the YWCA. Charlie Robison will play
a concert at Bywaters afterward with Uncle Lucius as the opener. There will be camel rides,
games, a labyrinth — spread the word!
• Christmas Tree Lighting November 10th. Thanks to Paris Area Art Alliance, Turner Pipe, Parks
& Rec and Main Street for making the 30 foot tree happen. There will be carolers and other
fun stuff going on that evening.
• Matt is going to training in Wichita Falls November 6-7 so let him know if you want to go
also.
• New business — Ewe...nique Creations of Paris. Furniture on the Plaza has closed.
• We need to update the Downtown Map
• TMSP report is in the packet and covers the visit by Leslie Wolfenden.
Committee Reports:
Organization — Casey reported on Main Street tent for Festival of Pumpkins. Jill and Britin have
offered to be there for the day. Casey will send out an email about that.
Design — No report as Karie was absent.
Promotions — Britin reported on the progress of the pumpkin patch. As of close of day Monday 679
pumpkins had been sold with total sales of $2,530 and a profit to Main Street of $632.50. Another
truckload will be delivered at noon on Sunday October 21 so all hands on deck! Half of pumpkins sold
are $1 pumpkins and decorating has been very popular. Funds will go toward downtown Christmas
decorations and hopefully a light show at Bywaters Park next year. Downtown Trick or Treat will be
on October 315Y from 5 till the candy runs out. Main Street has been asked to split $175 in advertising
costs with PDA. Dog Dash will be Saturday, December 8t" at 10:00 am at the courthouse. This year
we are looking to have the race timed and will provide long-sleeved shirts, Santa, red carpet, etc. We
need volunteers for directing runners on the course. Wassailfest will be the same day from 1-4pm
and businesses will provide their own Wassail for tasting. Voters must go to several stores for their
ballot to count, and we are trying to get a large basket together as a prize for the ballot drawn.

Winning business will be named "Wassailmeister°. Becky recommended they get a crown for the
year.
Economic Restructuring — Britin reported that the meeting is this Thursday at 6:OOpm at Time Flies.
Committee will be finalizing the Building Improvement Grant application. So that it can be sent on to
the City Attorney and we can start handing out money, hopefully at the start of the year. Fred
suggested we look at USDA and EDA grants for matching with what we have been able to raise
through Wine Fest and Movies in the Park, as well as PDA's contribution.
Historic Preservation Commission — Britin reported that HPC has approved new signage and are
working with the owner of a building intended for climate-controlled self-storage to design a new
portico that will match the style of her building. HPC is also reconsidering their grant and will look at
Main Street's grant application so that they can be working together to encourage investment.
VCC/Chamber — Becky reported that Party on the Plaza was a huge success and the visiting group
Girls on the Fly was very impressed. We owe a huge thanks to Janet Green who organized the
Antique Fair and encouraged this event to draw visitors to shop and eat downtown on Friday night.
Shop Local will begin on October 27th and will end December 17th. Drawing will be at 6:OOpm on
December 18th on the Plaza. The historic trolley tour will be December 15t at 1& 3pm and the
Historic Churches tour will be December 8th at 1:30pm. Carriage rides will be after the parade on
December 15t and 2-5 on December 8th. The Chamber Banquet is on November 15L and tickets are $30
— call Judy at the Chamber to reserve yours. It will be good fun and good food.
Election of vacant committee chairs: Jill made a motion to elect Britin as the Promotions Committee Chair
and Fred as the Economic Restructuring Chair. Casey seconded.
Future Agenda Requests: Matt requested ongoing downtown restrooms and removal of Skate Park, as well as
discussion of Bywaters light show for next year and Christmas tree sales. Jill asked for 4:15 meeting start time
as agreed in last meeting. Fred would like to see the 2013 budget and consideration on education on sign
ordinances.

3. Public Hearing to consider presentations by City of Paris Code Inspectors and
owner(s) and/or lien holder(s) of the below properties who have been given notice of
a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris,

Mr. Talley stated that the property at 1203 SE 16th has deterioration of the
foundation, insulation is hanging out, has some rotting of the foundation, and
deterioration of the wood.
Joyce Freeman spoke, she stated that the house doesn't leak and its wiring was
good. She asked for 90 days to repair the property and at this time the property
is not occupied.

Robert Talley's recommendation: Repair within 60 days City has the right to
apply a$1000 per day civil penalty.
Motion was made by Wendell Moore, seconded by Chris Brown to allow
Mrs. Freeman 90 days to have the property repaired if not the property will
be brought back to the Building and Standard Commission.

Ryan Lassiter recused himself from items R. and S. Don Wilson made a
motion to recuse Ryan Lassiter from the discussion and Zach Saffle seconded

Robert Talley showed pictures of the holes in the roof, warping boards, rotting
boards, boards coming loose from the structure, and shingles buckling.
John House spoke to the commission and plans on tearing down the structure and
asked for 120 days. Don Wilson explained to Mr. House that the commission can
only give 90 days.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a$1000 per day civil penalty.
Motion was made by Zach Saffle, seconded by Chris Brown to allow Mr.
House to demolish the property in 90 days, if not the City has the right to
demolish and apply a$1000 per day civil penalty to the property. Motion
carried unanimously. 4-0

Present: John S. House
Robert Talley showed pictures of the deteriorating wood, windows broken,
unsecure, interior destroyed, front of the house has dropped, and there is
deterioration of the roof.
John House told the commission that he had planned on tearing the house down
and asked for 90 days to demolish the house.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a$1000 per day civil penalty.
Motion was made by Chris Brown, seconded by Zach Saffle to allow Mr.
House 10 days to secure the property and 90 days to demolish the property, if
not the City has the right to demolish and apply a$1000 per day civil penalty
to the property. Motion carried unanimously. 4-0
A motion was made by Chris Brown and seconded by Wendell Moore to

Present: Sheryl Larking Wood and Bill Wood
Robert Talley stated that the Woods have replaced the wood, some areas are in
bad shape but they are addressing the areas. They have torn down the old porch
and are working on the property. The Woods have also finished the roof. Robert
and the Fire Marshall have inspected the property.
Bill Wood addressed the commission and asked if they would take the front
structure off the condemned list so they could focus on the back structure.
Discussion on the removal of the front structure off the condemned list took place.
Mr. Wilson stated that the structure couldn't be taken off the list until all the work
is completed. Mr. Saffle stated that the Woods have completed all the work.
Robert Talley agreed that the Woods have completed the work they were asked to
do. The Wood's showed pictures taken today on all the work that's been done.
Randy Roam of 1750 Margaret St. spoke to the commission. He explained that
the owners have done an outstanding job in a short amount of time on the
property. Mr. Moore asked if the privacy fence that was put up helped with the
security of the back structure. Everyone agreed it did. Mr. Brown stated that he
agreed that the commission should release the front structure and focus on the
back structure now. Mr. Moore and Mr. Lassiter commended the property owns
for a job well done.
Robert Talley's recommendation: The front structure: 90 days to have the
property repaired if not the property will be brought back to the Building and
Standard Commission. The back structure: 30 days to demolish if not the City has
the right to demolish and apply a$1000 per day civil penalty.
Motion was made by Ryan Lassiter, seconded by Zach Saffle to allow 90 days
to demolish or repair the back structure on the property, if not the property
will be brought back to the Building and Standard Commission. Motion

Present: Connie Justice was present but she did not speak.
Robert Talley showed pictures of the overgrowth around the house, there is a hole
in the roof, the porch is falling in, missing wood, foundation sinking, water
damage, unsecure, missing sheetrock, and rotting wood. The side structure has
missing wood. Don Wilson asked if the structure is sound. Robert Talley stated
that when Mrs. Justice applies for permits that the inspection department will
have to determine if the structure can be repaired. He stated that it's up to the
owner to determine if they want to repair or not and if they fail to do so or if the
building inspectors do not pass the structure it will be brought back to the
commission.
Robert Talley's recommendation: 90 days to have the property repaired if not the

are bowing, has damage on the roof, there are brealcs in the wood, water damage,
and has missing wood.

to demolish and apply a$1000 per day civil penalty.

Robert Talley spoke with both Martin and Carmen today at the property. The
property owner agreed that the back structure needs to be demolished. The front
structure has no moisture, a new roof, and has new wood on it. The property
owners are working on it.
The commission had a discussion about what repair means and if it matters if the
property is habitable or not.
Robert Talley's recommendation: 90 days to have the front structure on the
property repaired if not the property will be brought back to the Building and
Standard Commission and 30 days to demolish the back structure and if not the
City has the right to demolish and apply a$1000 per day civil penalty.

Robert Talley stated that the structure is unsecure, the front porch has collapsed,
wood has rotted, has deteriorated plywood, the structure is leaning, and there is a

Robert Talley's recommendation: 30 days to demolish if not the City has the right

contacted someone to look at the property.
Robert Talley stated there is a hole in the roof, shingles are coming off, the
property is unsecure, the roof is deteriorated, and facial boards are rotting and the
foundation and under penning are sinking.
Robert Talley's recommendation: 90 days to demolish if not the City has the right
to demolish and apply a$1000 per day civil penalty.
Motion was made by Wendell Moore, seconded by Johnny Norris for the
property owner to secure the property in 30 days, and make a decision to
demolish or repair the property in 90 days, if not the property will be
brought back to the Building and Standard Commission. Motion carried

Owner: Renford Holmes, 1090 34'h SE Paris, TX 75460
Robert Talley met the owner at the property. Mr. Holmes wants to repair the front
structure and claims the back structure is not his.
Robert Talley stated that the structure in the back shows to be on Mr. Holmes
property but Mr. Holmes claims it's not. Robert will have to investigate this
property and bring it back to the commission. Mr. Talley showed the commission
pictures of the front structure and the structure is unsecure, has water damage, and
support beams are missing. Robert Talley stated after talking to the property
owner he went back by the property later and the property is secure and repairs
have been started.
Robert Talley's recommendation: 90 days to repair the property and if not the
property will be brought back to the Building and Standard Commissiori.

Robert Talley has talked to the neighbors and the house is vacant.
Robert Talley stated that the property is unsecure, has deterioration, is buckling,
has gaps in the structure, and has lots of storage that is being pulled out into the
yard by vandals.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a$1000 per day civil penalty.

Robert Talley talked to Mr. Holmes.
Robert Talley said there is no ridge cap on the top of the house but that a metal
roof was put on the house after the damage. The carport has fallen in and is
unsecure. Robert said there is no damage to the inside of the house but it is
abandoned. Mr. Holmes wants to repair the structure.
Robert Talley's recommendation: 90 days to repair the property and if not the
property will be brought back to the Building and Standard Commission

them demolish the structure. Since she received the letter from the City the bank
is trying to work with her. The property is unsecure, broken windows, holes in the

Meeting Minutes
August 23, 2012
In Attendance: Jon Landers, Mary Lou Coe, Bobby Walters, Melissa Cook, Carolyn Patterson, Becky
5emple, Sue Lancaster, Roy Gwinn, Nelen Short, Derald Bulls.
Chairman Bobby Walters calied the meeting to order and welcomed guests Stephanie Connot with
Lamar County Coalition of Education, Business, and Industry, and Shawn fVapier and Cheri Bedford with
the City of Paris.
Melissa Cook presented financial reports for May, June and Ju(y 2D12 for Visitors and Convention
Council. The financial reports were presented and approved as amended on a motion made by Derald
Bulls and seconded by Roy Gwinn.
In new business, minutes from the V&CC May, 2012 meeting were presented and approved tin a motion
by Roy Gwinn and seconded by Mary Lou Coe.
Funding requests for Cox Field Fly-In sponsored by the City of Paris Airport Advisory Board for $2500,
was submitted, and after scoring criteria was reviewed, a recommendation of $1250 was made. Mad
Max Mud Run sponsored by Lamar County Coalition for $25Q0 was submitted, and after scoring criteria
was reviewed, a recommenda#ion of $1500 was made.
The recommendatio� for these two funding request was approved on a motion made by Roy Gwinn and
secpnded by Helen Short.
Election of Officers was conducted and the floor was opened for nominations. A motion was made by
Roy Gwinn and seconded by Mary Lou Coe that Bobby Walters serve as Chairman. Motion was
approved. Boblay Walters made a recommendation that Deraid Bulls serve as Vice Chairman of V&CC,
and Roy Gwinn moved to approve the recommendation, and seconded by Mary Lou Coe. Motion was
approved. Qerald Bulls made a motion that nominations cease, and Roy Gwinn made the second.
On Future-New Business: On funding requests that are submitted in between regufar V&CC meetings,
the Chairman recommended that the Executive Committee review and score the request, and submit
their recommendation to the baard for approval or disapproval electronically.

President Cook recommended that the Chair or Vice Chair af V&CC be authorized to co-sign aH checks
related to V&CC business, and also recommended that the �ove Civic Center and V&CC accounts be
set up at the sarrie bank. On a motion by Mary I.ou Coe, and seconded by Roy Gwinn, recommendations
were approved.
