Move to repeal Resolution No. 2012-089 and approve an application to the Texas Department of
Transportation's statewide transportation enhancement program for funding of a two mile addition to the
Trail de Paris and authorize the City Manager to acquire two parcels of land or two right-of-entries from
Rail America (Kiamichi Railroad) for the project should the City of Paris be awarded the grant.

BACKGROUND:
The City of Paris has an opportunity to expand the Trail de Paris in parts of West Paris. The project is
proposing to provide a transportation corridor between Heritage Park, the Justice Elementary Safe
Routes to School project, Leon Williams Park, the Boys & Girls Club, Red River Valley Fairgrounds
and T.G. Givens school. This project is part of the overall master plan for the Trail de Paris.
The Texas Department of Transportation announced the call for nominations in September this year for
communities to apply for federal highway funding assistance made available through the Transportation
Enhancement Program. October 22, 2012, the City Council approved this application by Resolution No.
2012-089. Since that time, the project estimate has been increased from $533,259.72 to $619,926.00.
The route has changed to include additional sidewalk from T.G. Givens to the Fair Grounds. The route
has also been re-routed around the two privately owned properties at the south end of the project. The
original estimate was based on TP&W standards, but the TxDOT standards require additional width for
sidewalks. The grant requires at least a 20% match. The City match portion is estimated at
$123,986.00, this match would not be required until the 2013-2014 budget year. The grant does not
include the engineering cost that is estimated at $80,500.00, which means the estimated cost is
$204,486.00. The grant requires all ROW to be acquired or include a commitment letter from current
property owners. The owners have been unwilling to work with the City on the project. It also requires
a right-of-entry letter for all railroad encroachments
Mr. Earl Erickson has had $40,000 pledged to the project if it is selected by TxDOT. The pledges would
help offset City cost. The pledges have been made by the following: RAM Foundation $25,000 and
$5,000 from the Lennox Foundation, Guaranty Bond Bank and Keep Paris Beautiful.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS TO CERTIFY LOCAL FUNDING AND SUPPORT OF THE
TRAIL DE PARIS PROJECT TO THE STATEWIDE
TRANSPORTATION ENHANCEMENT PROGRAM FOR FUNDING
COMPETITION IN THE TEXAS DEPARTMENT OF
TRANSPORTATION 2012 PROGRAM CALL FOR PROJECTS;
REPEALING RESOLUTION NO. 2012-089 AND REPLACING SAME
WITH RESOLUTION NO> 2012- ; AUTHORIZING THE CITY
MANAGER TO ACQUIRE TWO PARCELS OF LAND FOR THE
PROJECT SHOULD THE CITY OF PARIS BE AWARDED THE
GRANT; MAKING OTHER FINDINGS AND PROVISIONS RELATED
TO THE SUBJECT AND DECLARING AN EFFECTIVE DATE.
WHEREAS, The Texas Department of Transportation issued a call for
nominations in September 2012 for communities to apply for federal highway funding
assistance made available through the Transportation Enhancement Program; and,
WHEREAS, on October 22, 2012 Resolution 2012-089 was approved by the City
Council for a request of $533,259.72 with a local funding match of $106,651.94; and,
WHEREAS, due to an increase in the project cost, staff requests City Council
approval to repeal Resolution 2012-089 and approve the Grant for the amount of
$619,926.00; and
WHEREAS, the proposed extension of the Trail de Paris project will provide
improved access and safety for bicyclist and pedestrians to join neighborhoods,
schools, parks, fairgrounds and the local boys & girls club for a total distance of 2.0
miles in the City of Paris; and the City proposes to submit a nomination requesting
federal funding for assistance in the amount of $619,926.00; and
WHEREAS, the program requires a minimum 20% local funding match in the
amount of $123,986.00 plus 100% of any overruns above the total project estimate of
$619,926.00. The City of Paris supports this funding this project as shown in the
nomination budget (including the 20% local match) and commits to the
project's development, implementation, construction, maintenance,
management and financing. The Grant does not include the engineering cost
that is estimated at $80,500.00, which means the estimated cost is $204,486.00.
The City is willing and able to enter into an agreement with TxDOT by
resolution or ordinance should the project receive funding:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:

SECTION 1. City of Paris, Texas Resolution No. 2012-089 is hereby repealed in
its entirety and replaced by this Resolution.
SECTION 2. The City of Paris supports funding this project as shown in the
nomination budget and commits to the project's development, implementation,
construction, maintenance, management, and financing. The City is willing and able to
enter into an agreement with TxDOT by resolution or ordinance;
SECTION 3. That the City adopts Resolution approving the
submission of the project nomination; and the support and funding of the project should it
receive federal funds.
SECTION 4. That the City Manager is hereby authorized to act on behalf of the
City in all matters relating to this funding nomination and to execute all necessary
applications, assurances, certifications, and other documents, relative to the submission,
later acceptance, and administration of such funds.
SECTION 5. That it is hereby officially found and determined that this meeting at
which this resolution is passed is open to the public as required by law, and that public
notice of the time, place and purpose of said meeting was given as required. The regular
meeting of the Paris City Council was called to order at 5:30 P.M. on December 10, 2012
in Paris, Texas by A.J. Hashmi, M.D., Mayor.
