RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, GRANTING A PETITION FOR ANNEXATION OF
CERTAIN TERRITORY CONSISTING OF 14.310 (CALLED 14.526) ACRES,
MORE OR LESS; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris is in receipt of a Petition for Annexation
for the annexation of certain territory consisting of 14.310 (called 14.526) acres, more or less; and,
WHEREAS, the City Council finds and determines that the petition was signed by all of the
qualified voters residing or owning property in the area requested to be annexed in compliance with
Section 6 of the Charter of the City of Paris; and,
WHEREAS, the City Council further finds and determines that the property requested to be
annexed into the city of Paris is one-half mile or less in width, is contiguous to the existing city limit
line, and is vacant and without residents or has fewer than three (3) qualified voters who reside on
the property, in compliance with Section 43.028 of the Local Government Code; and,
WHEREAS, the City Council further finds and determines that the petition is in proper form
and in all things complies with the requirements of Section 43.028(c) of the Local Government Code
and the applicable provisions of the City Charter; and,
WHEREAS, the City Council further finds and determines that, in accordance with Section
43.028(d) of the Local Government Code, a hearing on the petition was had before the City Council
after the Sth day but on or before the 30th day after the date the petition was filed with the City Clerk
in order to hear the petition and the arguments for and against the annexation; and,
WHEREAS, after hearing such petition and the arguments for and against the same, the City
Council deems it appropriate to grant such petition to annex said territory into the city of Paris,
Texas; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the Petition for Annexation, a copy of which is attached hereto and for all
purposes incorporated herein, for the annexation of the following described property, to wit:
Being all that certain tract of land situated in the City of Paris, Lamar County,
Texas, a part of the Wesley Askins Survey, Abstract No. 7, a part of the 100.0 acre
tract of land conveyed to D. Wayne Brown, et al, by deed recorded in Volume 939,
Page 31 of the Lamar County Real Properly Records, and a part of the 121.76 acre
tract of land conveyed to D. Wayne Brown, et al, by deed recorded in Volume 949,
Page 296 of the Lamar County Real Property Records, and being further described
as follows:
BEGINNING at an iron pin found for corner at the intersection of the
northwest line of F.M. Highway 195 with the northeast line of County Road 42250,
the southwest corner of said 121.76 acres;
THENCE North 58° 00' 45" West with said northeast line a distance of
1264.30 feet to an iron pin found at the southwest corner of a tract of land conveyed
to Michael S. Kennedy by deed recorded in Volume 1007, Page 327 of the Lamar
County Real Property Records and in the northwest line of proposed Abby Lane;
THENCE North 45 ° 3 8' 18" East with the southeast line of said Kennedy tract
and said northwest line a distance of 567.17 feet to an iron pin found at the southeast
corner of the Kennedy tract;
THENCE Northerly with the center of a creek along the east line of the
Kennedy tract the following:
North 14° 36' 50" West a distance of 68.10 feet;
North 43° 52' West a distance of 176.41 feet;
North 11° 23' 50" West a distance of 52.37 feet;
North 30° 26' 55" West a distance of 53.16 feet;
North 04° 48' East a distance of 59.88 feet;
North 17° 42' 20" East a distance of 48.93 feet;
North 19° 31' OS" West a distance of 21.07 feet;
North 31° 18' 40" West a distance of 38.21 feet to an iron pin found
at the northeast corner of the Kennedy tract;
THENCE North 71° 30' East a distance of 149.82 feet to a point painted on
a manhole for corner;
THENCE South 58° 36' 30" East a distance of 203.47 feet to an iron pin set
for corner;
THENCE North 45° 47' 14" East a distance of 294.24 feet to an iron pin set
for corner;
THENCE South 44° 12' 46" East a distance of 58.31 feet to an iron pin set
for corner;
THENCE North 51°OS'37" East a distance of 208.93 feet to an iron pin set
for corner;
THENCE South 38° 54' 23" East a distance of 200.00 feet to an iron pin set
for corner;
THENCE South 51° OS' 37" West a distance of 59.26 feet to an iron pin set
for corner;
THENCE South 38° 54' 23" East a distance of 150.00 feet to an iron pin set
for corner in the north line of Lot 8, Block D of The Hills No. l as shown by plat
recorded in Envelope 354-C of the Lamar County Plat Records, said point being
located in the existing city limit line of the city of Paris as described in Ordinance No.
2001-013, passed and adopted by the City Council of the City of Paris on March 12,
2001;
THENCE South 51° OS' 37" West with said north line and along the existing
Paris city limit line as described in said Ordinance No. 2001-013 a distance of 70.13
feet to an iron pin found at the northwest corner of said Lot 8, in the north line of
Darnell Drive and in a curve to the right having a radius of 384.25 feet;
THENCE Westerly with said existing Paris city limit line and said north line
and curve to the right, long chord bears North 72° 32' West a distance of 2.36 feet,
an arc distance of 2.36 feet to an iron pin found for corner;
THENCE South 17° 33' 3 0 " West with the west line of The Hills No. l and
said existing Paris city limit line, at 50.00 feet passing the northwest corner of Lot 10,
Block C, continuing in all a distance of 241.89 feet to an iron pin found at the
southwest corner of said Lot 10;
THENCE South 56° 53' 12" East with the south line of The Hills No. 1 and
said existing City limit line a distance of 256.24 feet to an iron pin found at the most
southerly corner of Lot 9, Block C, and in the north line of a tract of land conveyed
to Steven G. Shoemake by deed recorded in Volume 1047, Page 221 of the Lamar
County Real Property Records;
THENCE South 49° 10' 30" West with the north line of said Shoemake tract,
at 226.34 feet passing the northwest corner of the Shoemake tract and northeast
corner of a tract of land conveyed to Charles Tonne by deed recorded in Volume
1023, Page 190 of the Lamar County Real Properly Records, continuing in all a
distance of 518.17 feet to an iron pin set for corner;
THENCE North 51° 44' 25" West a distance of 502.23 feet to an iron pin set
for corner in the southeast line of proposed Abby Lane;
THENCE South 45° 38' 18" West with said southeast line a distance of
498.87 feet to an iron pin set for corner;
THENCE South 58° 00' 48" East, at 408.98 feet passing the northwest corner
of a tract of land conveyed to Norman Montgomery, Jr. by deed recorded in Volume
1073, Page 333, continuing with the southwest line of said Montgomery tract in all
a distance of 1201.37 feet to an iron pin found in the northwest line of F.M. Highway
195 at the southwest corner of the Montgomery tract;
THENCE South 42° 23' 33" West with said northwest line a distance of 20.33
feet to the place of beginning and containing 14.310 (called 14.526) acres of land,
more or less,
be, and the same is hereby, granted.
Section 3. That this resolution shall be effective from and after its date of passage.
