09-TXDOT ENHANCEMENT PROGRAM APPLICATIONItem No. 9 Memo�andum TO: City Council John Godwin, City Manager FROM: Shawn Napier, P.E., Director of Engineering, Planning & Development SUBJECT: TEXAS DEPARTMENT OF TRANSPORTATION STATEWIDE TRANSPORTATION ENHANCEMENT PROGRAM APPLICATION DATE: 1-8-2013 BACKGROLTND: The Texas Department of Transportation (TxDOT) announced the call for nominations in September this year for communities to apply for federal highway funding assistance made available through the Transportation Enhancement Program. The City of Paris has an opportunity to expand the Trail de Paris in parts of West Paris. The project is proposing to provide a transportation corridor between Heritage Park, the Justice Elementary Safe Routes to School project, Leon Williams Park, the Boys & Girls Club, Red River Valley Fairgrounds and T.G. Givens School. This project is part of the overall master plan for the Trail de Paris. City Council approved an initial application at the October 22, 2012 CiTy Council meeting. The project has changed twice since that initial approval. The grant requires all Right-of-Way (ROW) to be acquired or include a commitment letter from current property owners. The owners have been unwilling to work with the City on the project. After the first plan did not work it was revised to relocate the project to cross Kiamichi railroad ROW. The grant also requires a right- of-entry letter for all railroad encroachments. The railroad is in the process of being sold to another railroad and the legal department did not want to deal with any new permits during the sale. The plan that is before you will cross Bonham Street and go north on both sides of NW l ltn Street. STATUS OF ISSUE: Approve the TxDOT application and submit to the state for consideration. If awarded the City will have several options: The first option would be to try and acquire the two parcels of land and build the project as originally proposed. The second option moved the project to the west and would go north on NW 12t" Street crossing the railroad which would require an encroachment agreement from Kiamichi Railroad or its new owner. The third option would be to go north on NW l lth Street as proposed with this application. The least costly of all the projects is option #1. The last option would be not to approve the application. BUDGET: The project estimate has been increased from $533,259.72 to $696,207.00. The grant requires at least a 20% match. The City match portion is estimated at $181,014.00, this match would not be required until the 2013-2014 budget year. The grant does not include the engineering cost that is estimated at $90,000.00, which means the estimated cost is $271,014.00. Mr. Earl Erickson has had $43,000 pledged to the project if it is selected by TxDOT. The pledges would help offset City cost. The pledges have been made by the following: RAM Foundation $25,000, $5,000 from the Lennox Foundation, Guaranty Bond Bank and Keep Paris Beautiful and Next Era Energy has pledged $3,000. Campbell Soup has made a request to its corporate office for a donation to the project. RECOMMENDATION: Approve a Resolution repealing Resolution No. 2012-089 and approving an application to the Texas Department of Transportation's statewide transportation enhancement program for funding of a two mile addition to the Trail de Paris. Draft RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS AUTHORIZING APPROVING AN APPLICATION TO THE TEXAS DEPARTMENT OF TRANSPORTATION FOR A STATEWIDE TRANSPORTATION ENHANCEMENT PROGRAM FOR FUNDING OF A 2.36 MILE ADDITION TO THE TRAIL DE PARIS FROM HERITAGE PARK TO THE RED RIVER VALLEY FAIRGROUNDS; MAHING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT AND DECLARING AN EFFECTIVE DATE. WHEREAS, The Texas Department of Transportation issued a call for project nominations in September 2012 for communities to apply for federal highway funding assistance made available through the Transportation Enhancement Program; and, WHEREAS, a 236 mile addition to the existing Trail de Paris from Heritage Park to the Red River Valley Fairgrounds in the City of Paris will provide improved access and safety for bicyclist and pedestrians to join neighborhoods, schools, parks, fairgrounds and the local boys & girls club further depicted in the aerial map attached hereto as Exhibit "A"; and, WHEREAS, the City proposes repealing Resolution 2012-089 because of changes in construction estimates and hereby submits a revised nomination requesting federal funding for assistance in the amount of $696,207.00; and WHEREAS, the program requires a minimum 20% local funding match from the City of Paris which in this case is calculated to be approximately $181,014.00 plus 100% of any overruns above the total project estimate of $696,207.00. The City of Paris supports funding this project as shown in the nomination budget (including the minimum 20% local match) and commits to the project's development, implementation, construction, maintenance, management and financing. The City is willing and able to enter into an agreement with TxDOT by resolution or ordinance should the project receive funding; and, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: SECTION 1. That the City Council hereby repeals Resolution 2012-089 adopted October 12, 2012 and adopts Resolution approving the submission of the project nomination; and the support and funding of the project should it receive federal funds. SECTION 2. The City of Paris supports funding this project as shown in the project nomination budget and commits to the project's development, implementation, construction, maintenance, management, and financing (including the local matching funds). The City is willing and able to enter into an agreement with TxDot by resolution or ordinance; SECTION 3. That the City Manager is hereby authorized to act on behalf of the City in all matters relating to this funding nomination and to execute all necessary applications, assurances, certifications, and other documents, relative to the submission, later acceptance, and administration of such funds. SECTION 4. That it is hereby officially found and determined that this meeting at which this resolution is passed is open to the public as required by law, and that public notice of the time, place and purpose of said meeting was given as required.
