A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, RATIFYING AN APPLICATION FOR A U.S. FIRE ADMINISTRATION 2002 ASSISTANCE TO FIREFIGHTERS GRANT FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA); AUTHORIZING THE EXPENDITURE OF FUNDS; ACCEPTING SAID GRANT AWARD UPON NOTICE THEREOF; AUTHORIZING THE EXECUTION OF ANY AND ALL DOCUMENTS NECESSARY FOR ACCEPTANCE AND IMPLEMENTATION OF SAID GRANT UPON NOTICE THEREOF; MAHING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUB.TECT; AND DECLARINGAN EFFECTIVE DATE. WHEREAS, the Federal Emergency Management Agency provides funding far the U. S. Fire Administration 2002 Assistance to Firefighters Grant Program; and, WHEREAS, the City Council of the City of Paris is desirous of processing a grant application for the Assistance to Firefighters Program, at a total cost of $168,000.00, with $151,200.00 to be provided by grant and $16,800.00 to be provided by the City of Paris in the form of local matching funds; and, WHEREAS, the deadline for actual filing ofthe grantapplication occurred priar to the date of the next regular City Council meeting, and a timely application has been filed, subject to City Council ratification; and, WHEREAS, the City Council desires to authorize the Mayor, City Manager, Fire Chief, and other appropriate City staff to accept and implement said grant (if same is received) without further action of City Council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the filing of an application to the Federal Emergency Management Agency for a U.S. Fire Administration 2002 Assistance to Firefighters Grant in the amount of $151,200.00, being approximately 90% of the estimated cost of the Assistance to Firefighters Program, with the City of Paris providing $16, 800.00 in funds, a copy of which is attached hereto as Exhibit A and for all purposes incorporated herein, is hereby in all things ratified. Section 3. That the City Manager be, and he is hereby, appointed as the Authorized Official of said project and is authorized and directed to execute, on behalf ofthe City ofParis, the application for grant under the terms and conditions and in the form shown in Exhibit A, attached hereto. Section 4. That the Fire Chief be, and he is hereby, appointed as Project Director and is hereby authorized to execute and deliver, on behalf of the City of Paris, all reports, communications, assurances, and documents necessary for the completion of said project. Section 5. That the Director of Finance be, and he is hereby, authorized and directed to serve as the Financial Officer for said project and to receive and distribute funds for purposes of the Assistance to Firefighters Program. Section 6. That the Mayor, City Manager, Fire Chief, and the Finance Director be and they are hereby authorized and directed to execute, on behalf of the City of Paris, any and all documents necessary for acceptance and implementation of said grant upon notice of award thereof by the Federal Emergency Management Agency, under the terms and conditions and in the forms approved by the City Attorney, and to proceed with use of said funds upon receipt thereof far the purposes stated herein and in accordance with the grant conditions. Our project request is for funding to purchese (60) SCBA's with (60) extra cylinders. We believe that this department is very weak in this area and that our current models are lacking in these (3) specific safety areas. Those areas are: no cross contamination prevention, no redundant low air alarm device, and no tag line and/or buddy breathing capability. The total number of SCBA requested would aliow for one unit per person capabiliry. This is very important, due to the fact that during major fireground operations it is not uncommon for this department to require most of its members to respond to an all-call, for assistance. We need the capability to provide for the safety of each member. The request for the additional cylinders will allow for changability at emergency incidents withour having to depend solely on refilling capabilities. The department first purchased SCBA in 1975. The SCBA of choice, at the time was the MSA brand, belt mounted regulator with the 2216 psi steel bottles. These units, up-graded as was possible over the years, have proven to be a necessary tool in our response mRigation efforts. The SCBA has become one of the mainstays in our equipment inventory. We literally use these units, in some capacity, almost every day. As our application shows, we responded to 179 structure fires this past year. That averages to a little over three calis per week: When you combine that total with the other response totals, and realizing that SCBA's are utilized in most of these responses as weil, it is not hard to see how reliant we are on their use. The SCBA is one of the most important components in our overall PPE package. My staff and I have been doing research directed towards the need for this department to complete an upgrade/change-0ver from our current SCBA's to a model that provides a greater level of safery and which more closely follows the recommendations of NIOSH and OSHA as outlined in the OSHA Standards - 29 CFR. NARRATIVE 2"Please provide a detailed description of your planned uses of the grent funds." The primary function of the above mentioned equipment is for performing interior structural search/rescue/recovery and firefighting activities. Secondary use shail include but not limited to the following activfties: training, haz.mat., confined spaces, oxygen deficient atmospheres, etc... . NARRATIVE 3 "Why this program would be beneficial to your community andlor to your department " By purchasing these new SCBA, the City of Paris Fire Department could do a wholesale change-over to a newer and better designed SCBA. This would work to better ensure that our firefighters are provided the safest and highest quality equipment as is possible. The protection of our firefighters and our constituents are of the utmost importance. We are simply a smaN city. Funding for this project is very difficult because of the enormity of the overall cost. Besides the benefits as listed above, our plans are to donate our "old" SCBA's to the local volunteer departments for distribution. Though they are woefully behind in technology, they are better than nothing and that is what most of the volunteer departments around our area have - nothing. The Texas Forestry Service has a program whereby cities can donate their equipment to them for tax credit and the equipment is in tum inspected and donated to volunteer departments. We are currently investigation this possibility. NARRATIVE 4"Why this project cannot be funded solely through local funding" The City of Paris has long provided for the fire department in tax based funding. However, with the continued needs of all the departments within the city and especially in lieu of the fact that the city has currently obligated itself for the funding and construction of a new Police station facility, the probability of the city being able to meet all the needs without increasing the tax rate to even a greater degree is almost nonexistent. The city is struggling to keep its tax rate at a level that would not overburden its citizens. The city has actually lost some of its tax base with the closing of (3) of its major indistries here within the last few years and the continued threat of plant closure of one of its largest contributors. Simply put, we see this grant as being possibly the only way of accompiishing this much needed change. NARRATIVE 5 "Additional Imformation" Having researched the possibility of up-grading/changing SCBA's and having communicated to several persons employed by the various vendors, we have determined that the project could be completed in its entirety with a grant of $168,000.00. The City of Paris has obligated itself to the completion of this project, as much as is possible, by allocating an additional $5,000.00. This will bring the cities share to $21,800.00 towards the purchase price of the new SCBA's. With this sum being targeted and used strictly for the purchase of new SCBA's, the total federal share for the project would be $146,200.00, instead of $151,200.00. Drug-Free Workplace (Grantees other than individuals) As required by the Drug-Free Workplace Act of 1988, and implemented at 44CFR Part 17, Subpart F, for grantees, as defined at 44 CFR part 17, Sections 17.615 and 17.620: (A) The applicant certifies that it will continue to provide a drug-free workplace by: (a) Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in the grantee's workplace and specitying the actions that will be taken against employees for violation of such prohibition; (b) Establishing an on-going drug ftee awareness program to inform employees about: (1) The dangers of drug abuse in the workplace; (2) The grantees policy of maintaining a drug-free workplace; (3) Any available drug counseling, rehabilitation and employee assistance programs; and (4) The penalties that may be imposed upon employees for drug abuse violations occurring in the workplace; (c) Making it a requirement that each employee to be engaged in the perfortnance of the grant to be given a copy of the statement required by paragraph (a); (d) Notifying the employee in the statement required by paragraph (a) that, as a condition of employment under the grant, the employee will: (1) Abide by the terms of the statement and (2) Notify the employee in writing of his or her conviction for a violation of a criminal drug statute occurring in the workplace no later than five calendar days after such conviction. (e) Notifying the agency, in writing within 10 calendar days after receiving notice under subparagraph (d)(2) from an employee or othenvise receiving actual notice of such conviction. Employers of convicted employees must provide notice, including position title, to the applicable FEMA awarding office, i.e. regional office or FEMA office.
