06-MINUTES FROM VARIOUS BOARDS, COMMISSIONS, ETCMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, NOVEMBER 19, 2012 3:00 P.M. 1. Don Wilson called the Building and Standards Commission Meeting to order at 3:03 P.M. Roll was called. A, The following members were present: Johnny Norris Ryan Lassiter Zac Saffle Don Wilson Vicky Ballard (arrived at 3:07pm) Wendell Moore (arrived at 3:18pm) g. Staff present: Robert Talley Nicki Brown John Lestock 2. Approval of minutes from previous meetings. (October 15, 2012) Motion was made by Johnny Norris and seconded by Zac Saffle to approve the minutes for the October 15, 2012 meeting. Motion carried unanimously. 4-0 3, Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and/or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures": Vicky Ballard entered the meeting. Request was made by Robert Talley to move to item 3. L., 905 NE 13tn, Lot 1, City Block 7 L. 905 NE 13th, Lot 1, Block 7, Belmont Addition Owner: Rhonda N. Thacker, 859 NE 13th Paris, TX 75460 Present: Rhonda N. Thacker and husband Kenneth Thacker. Mr. Thacker addressed the Commission. Mr. Talley stated that the property at 905 NE 13`h has a rotting floor, it's boarded up, siding is chipping and breaking, several gaps allow nature in, and there are large holes in the siding. Kenneth Thacker spoke, he stated that the house is solid; he has talked to a roofer and is willing to fix the property. At this time there are no leaks in the roo£ Mr. Wilson asked how long the property has been vacant. Mr. Thacker said about a year and a hal£ Johnny Norris asked what Mr. Thacker's time frame in repairs would be and Mr. Thacker asked for 180 days. Mr. Wilson asked what the roof was made of and Mr. Thacker said it was composition. Don Wilson asked when several boards were removed from the structure and Mr. Thacker said about one year ago. Mr. Thacker stopped repairs due to finances. He now would like to live at the property. He stated that they inherited the property and own several more structures in this area. Don Wilson asked what Mr. Thacker considers repairs on this property. Mr. Thacker stated replacing the siding, overlay, water seal, windows, doors, permanent roof, and estimates the cost to be around $12,000. Johnny Norris explained that the Commission can only grant 90 days for repairs. Don Wilson explained that if substantial progress is being made at the end of the 90 days the Commission will work with the property owner. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Zac Saffle to allow Mr. Thacker 90 days to have the property repaired (repairs included roof, siding, windows, and doors) if not the property will be 6rought back to the Building and Standard Commission. Motion carried unanimously. 5-0 Wendell Moore entered the meeting. K. 1605 Van Zandt, Lot 11 & 13, Block 3, Harlan Heights Owner: Michael L. Alexander, 226 6t" NE Paris, TX 75460 Present: Michael L. Alexander Robert Talley showed pictures of a hole were the roof connects to the front porch, the porch is fixing to fall off, rotting, unsecure, roof line deterioration, wood removed or falling off at the foundation, the interior is in disarray, daylight is coming through a hole in the roo£ Mr. Alexander spoke to the commission and said he had two options, one to tear down the house and the other to repair the house. He thinks the structure can be fixed. He would like the time to look into the both options. He has already talked to several people about repairs and he's getting estimates. He asked for 45 days to make a decision on what direction he should take with this structure. Johnny Norris asked if the inside of the structure was dry. Robert Talley stated that due to the two holes in the roof it has to be wet. Don Wilson asked if there is a way to put this property on hold. Robert Talley explained if they table the property he still has to do all the same paper work to bring the property back to BSC. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Zac Saffle to table this item and bring it back to the January 2013 meeting. Motion carried unanimously. 6.-0 p. 408 NE 10�h, Lot 5, 6, 6-A & 6-B, Block 69-B, City of Paris Owner: Arnelle Camster, 715 E Cherry Paris, TX 75460 Present: Arnelle Camster Robert Talley showed pictures of the holes in the porch, lumber deteriorating, front porch holes and is very dangerous, the eave is rotting, unsecure, missing wood, shingles are slipping down, and the shed in the back yard has trees laying on it. Arnelle Camster stated that the property is being repairs already. They have to fix the porch floor first so the workers can get to the other problems. She explained that she lives on retirement income and has to do a little at a time. Robert Talley asked Mrs. Camster what kind of time frame she needed. Mrs. Camster asked for an extension till February 2013. The Commission is concerned with the holes in the roof and Mrs. Camster said they are going to start the roof as soon as the porch is stable. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Motion was made by Ryan Lassiter, seconded by Vicky Ballard to allow Mrs. Camster 90 days for repairs. Motion carried unanimously. 6-0 C. 1035 W Houston, Lot 3-A & 4, Block 2, Conner Place Owner: Jackie Jones, 1035 W Houston Paris, TX 75460 Present: Jackie Jones and her sister. Robert Talley showed pictures of the deterioration of the eaves of the house, the gutters are buckled, holes are in the windows, rotting and deterioration on window seals, unsecure, exposed pipes, interior is in disarray, and there is no floor covering. Jackie stated that she didn't realize the property was this bad. Her daughter and three sons were living in the house. She stated that she had the floor covering took out of the house and replaced some boards and sanded them. She has three people interested in buying the property. Johnny Norris asked what kind of shape the roof is in. Robert Talley stated the roof is in place but it is fastly deteriorating. Don Wilson stated that the property needs to be cleaned up and outside repairs need to be done to prevent further deterioration. The Commission explained that if Mrs. Jones sales the property she needs to disclose the conditions set by this commission to the buyer. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Wendell Moore to secure the property in 30 days and make repairs in 90 days. Motion carried unanimously. 6-0 A, 714 Graham St, Lot Pt of 12, Block 52, City of Paris Owner: Kevin B. Kear, 625 Johnson Wood Dr. Paris, TX 75460 Robert Talley stated that HPC pulled this property from the BSC list. No action was taken. B. 1020 W Houston, Lot 14 & 15, Block 46, City of Paris Owner: Johnny & Bertie Butler, 500 SE 9`h St, Waco, TX 76706 Robert Talley has had no contact with the owner. $16,101.12 taxes are owed on this property. Robert Talley stated that the property is unsecure, has holes in the ceiling, insulations is falling out of the ceiling, holes in the roof, rotting inside, and water is entering the structure. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley said the certified letter that was sent out to the property owner came back unopened and marked deceased. Robert Talley showed pictures of the property where the windows were open, unsecure, deterioration and broken windows, deterioration of foundation and shingles coming off the roof. Don Wilson asked if it matters or changes anything if the property is in probate. Mr. John Lestock (City attorney) stated no. Robert Talley stated that there is an indention in the roof that concerns him, the roof is sagging, unsecure, deterioration on roof eave, inside ceiling edge is sagging and swelling, and the inside is leaking. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. The property was gift deeded to them. He talked to Mrs. Bobbie Murray and she agrees that the structure needs to be demolished. They will come and set up a payment plan and sign the necessary papers for the City to demolish the structure. Robert Talley showed pictures of deterioration, missing windows, holes in the house and roof. She stated that she has a buyer. Vicky Ballard stated that this is the second time this structure has come to BSC. Robert Talley stated the properties siding is deteriorating, the ridge line doesn't look right, siding is gone, inside is leaking and tiles are falling off the ceiling, and the property is unsecure. Robert Talley's recommendation: 60 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley has had no contact with the owner and the certified letter came back un-opened. Robert Talley stated that the structure is unsecure, doors are gone, plumbing has been stripped, holes in the floor, and deterioration. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Mr. Lacy inherited this property. He has had no contact on this property. Robert Talley stated that the windows are boarded up, deterioration on foundation and wood, foundation is falling, there is a tree growing in the foundation, unsecure, and the under penning is coming off. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. J. 519-529-530 NE 13`h, Lot 13, Block 70-A, City of Paris Owner: Mary Dee Lacy, 631 W Austin Paris, TX 75460 Robert Talley has had no contact on this property. Robert Talley stated that the structure is deteriorating in the SE corner, boards are falling off, windows are broken, deterioration of siding on foundation, eave of roof has holes, window seals are breaking and the ceiling is leaking. Don Wilson has a problem with the roof not being bad on this house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. They asked for 60 days to repair the structure. Robert Talley stated that the property has been boarded up, the front porch is swelling, and he found no leaks. Robert Talley said the son asked for 60 days to find out what needed to be done to the property. Robert stated that the house is sinking, the foundation is deteriorating, unsecure and the shed is full of junk and trash. Robert Talley's recommendation: 60 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley stated that the property has missing wood, on one side of the house the house is curving in and the other side it is curving out, deterioration around doors, eave is missing, house starting to buckle and there is an old shed in the back of the property. She agrees the structure needs to be demolished. She's going to try to make arrangement to make payments with the City of Paris to demolish the house. Robert Talley stated that the house is unsecure, has broken windows, house is sinking, inside ceiling is leaking, porch wood is deteriorating, and the front porch is dangerous. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Mr. Moore requested 90 days to repair the structure. Robert Talley stated that the house has a hole in the roof, broken windows, hole in the porch, rotting wood, and the shingles are deteriorating. Robert Talley's recommendation: 90 days to repair if not the property will be brought back to BSC. Tibbs, 3445 Reno Dr. Paris, TX 75462 Robert Talley talked to Mrs. Tibbs and she agrees that structure need to be demolished. Robert Talley stated the structure is bowing, cracking, sinking, leaning, missing wood, under penning is popping off due to the structure sinking into the ground, broken windows and the inside is leaking. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Motion carried unanimously. 5-0 q, Discuss procedure concerning issuance of building permits on condemned structures. Robert Talley stated that in the past the BSC has condemned 47 NE 9th and 933 Connor. Harold the property owner came in to the City and wanted to repair the structures so Robert allowed the permit department to issue permits for the work. How would the Commission like to handle this? After a structure is condemned would the Commission like to vote before permits to repair are issued? Vicky Ballard stated that anytime a property owner wants to re-hab a property that's a good thing. Don Wilson asked what if we give the property owner 90 days to repair and they don't do anything for two years? Mr. Wilson thinks the property owner should go through the process of coming to BSC. Zac Saffle and Vicky Ballard agreed. Robert Talley did state that building permits are only good for six months now. In the past they did not have an expiration date. The order still stands. If the BSC orders state demolish in 30 days and the works not done then the City has a right to demolish the property when the permit expires. The BSC orders override the six month permit. Don Wilson stated that a process needs to be established for the future. 5, Future agenda items. (1) Don Wilson stated that the BSC and HPC need to meet again. (2) Don Wilson also addressed that there needs to be something we can do if a property is occupied and there's a four foot hole in the roo£ It's unsafe and people are living in it. They should be forced to move out. Can the Fire Marshall do this? KAUFMAN STREET PARIS, TEXAS MONDAY, NOVEMBER 5, 2012 5:30 O'CLOCK P.M. The regular meeting of the Planning and Zoning Commission on Monday, November 5, 2012, was called to order at 5:30 p.m. by Dennis Chalaire, Chairman. A. The following members were present: Dennis Chalaire James Price Mike Folmar Richard Hunt Keith Flowers B. The following members were absent: Holland Harper Jerry Akers C. Also present were Shawn Napier, Director of Engineering, Planning and Development; and Sue Lancaster, Council Liaison. 2. Approval of minutes from previous meetings. (October 1, 2012) Motion was made by James Price, seconded by Mike Folmar to approve the meeting minutes for October l, 2012. Motion carried 5-0. 3. Public hearing and consideration of and action to consider petition of Lee Wilson for a change in zoning from a Commercial District (C) to a Commercial District (C) with a Specific Use Permit (54) mini storage warehouse, on Part of Lot S-A, City Block 307, being number 2685 North Main Street. Public hearing was declared open. A. No one spoke in favor. Don Shelton, P.O. Box 183, Petty, represented the property owner, spoke in favor of the petition. Mr. Shelton stated he is here as a friend to Mr. Wilson. Mr. Shelton further stated when they originally built the first storage building they put in a fire hydrant, which was required at the time and now they were told they needed the zoning change. Mr. Shelton further stated he is here to help move the process forward and is asking the commission to approve the zoning change. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Keith Flowers, seconded by James Price to approve the petition. Motion carried 5-0. 4. Consideration of and action on the Preliminary Plat of Lots 1& 2, Block A, T& K Machine 355 Addition, being number 2220 Park Street. Shawn Napier reviewed the preliminary plat with commissioners. Mr. Napier stated enclosed you will see an updated preliminary plat memo, all issues have been corrected. Chairman Chalaire asked if the ten foot easement noted on the plat is sufficient for the power company. Mr. Napier stated yes they have met all requirements. Motion was made by Mike Folmar, seconded by Richard Hunt to approve the preliminary plat subject to the City Engineers recommendations. Motion carried 5-0. 5. Consideration of and action on the Final Plat of Lots 1& 2, Block A, T& K Machine 355 Addition, being number 2220 Park Street. Shawn Napier reviewed the final plat with commissioners. Mr. Napier stated there were two additional comments on the memo for the final plat which will have to be addressed. Motion was made by Keith Flowers, seconded by Richard Hunt to approve the final plat, subject to the City Engineer's recommendations. Motion carried 5-0. 6. Meeting adjourned at 5:51 p.m. APPROVED THIS 7`h DAY OF JANUARY, 2013 �)�nn/� � ' Dennis Chalaire, Chairman Minutes Traffic Commission City of Paris The Traffic Commission met on Tuesday, November 06, 2012 at 5:15 P.M. in the Municipal Courtroom with the following members present: 1. Jean Schweers 2. Barry Shiver 3. Jon McFadden 4. Joe McCarthy (via phone) The city staff was represented by Asst. Chief Randy Tuttle. Councilman Aaron Jenkins was present as Council liaison. Mr. McFadden called the meeting to order at 5:23pm. A quorum was established with three members present and one via telephone. Mr. McFadden moved to item #2 to approve minutes September 04, 2012 meeting. Ms. Schweers made a motion to approve minutes and was second by Mr. Shiver. Motion carried 4-0. Mr. McFadden then moved to item #3 regarding the discussion and possible action regarding installation of No Parking Zones on the east and west sides of Johnson Woods Drive for the installation of a bicycle lane. Mr. Tuttle informed members that all residents on Johnson Wood Drive affected by this were sent a letter notifying them of this meeting. Mr. Tuttle informed members that this is part of the Safe Route to Schools project and introduced City Engineer Shawn Napier to explain this item. Mr. Napier explained to members that as part of this project a five foot bicycle lane has been proposed on each side of Johnson Woods Drive from Carson Lane north to Clark Lane. Mr. Napier said a No Parking Zone on each side has been requested with certain times to coincide with school hours. Mr. Napier also presented an proposal to members which would allow for a five foot lane on the west side of Johnson woods and a 12 foot lane with parking allowed on the east side of Johnson Woods. Mr. Napier said this option would make the traffic lanes smaller also. After discussion Mr. Shiver made a motion to recommend the five foot bicycle lanes on each side of Johnson Woods Drive with No Parking Zones. Mr. Shiver's motion also included the recommended hours of the No Parking Zone as follows; Monday — Friday in the morning, thirty minutes before the beginning of the school speed zone around Crockett Intermediate School until thirty minutes after the end of the school speed zone. In the afternoon thirty minutes before the beginning of the school speed zone until 5:OOpm. This motion was second Ms. Schweers and it carried 4-0. Mr. McFadden moved to item #4 regarding any future agenda items. There were none. At 5:47pm Mr. Shiver made a motion to adjourn the meeting and was second by Ms. Schweers. Motion carried 4-0. Minutes Traffic Commission City of Paris The Traffic Commission met on Tuesday, January 8th, 2013 at 5:15 P.M. in the Municipal Courtroom with the following members present: 1. 1on McFadden 2. Barry Shiver 3. Susan Hamby 4. Ken Kohls The city staff was represented by Chief Bob Hundley as Asst. Chief Tuttle was ill Mr. McFadden called the meeting to order at 5:15 PM. A quorum was established with four members present. Mr. McFadden moved to item #2 to approve the minutes from the November 6th 2012, meeting. Ms. Hamby made a motion to accept the minutes as presented. That motion was seconded by Mr. Kohls and the motion carried 4-0. Mr. McFadden moved to item #3 regarding a complaint of a problem intersection at NW 4th Street and West Provine Street. Chief Hundley briefed the commission on the complaint regarding the intersection's SE corner. This corner has an elevated yard with a privacy fence and partially obstructs the vision for traffic northbound on NW 4`h street approaching W. Provine. The staff recommendation was to provide stop signs for north and southbound traffic in effect creating a 4-way stop as stop signs were already in place for east and westbound traffic on W. Provine. Information regarding a vehicle crash at the intersection was shared with the commission. Ms. Hamby made a motion to install stop signs for north/southbound traffic on 4`h NW at the intersection of W. Provine. The motion was seconded by Mr. Shiver and passed on a 4-0 vote for. Mr. McFadden moved to the 4`h item on the agenda and asked for any items that needed to be placed on a future agenda. Mr. Kohls asked for an update from the Texas Department of Transportation regarding the letter for options dealing with the crossover on the SE Loop. The Historic Preservation Commission meeting was called to order by Paul Denney, Chairman at 12:00 p.m. A. The following members were present: Paul Denney Douglas Cox Nancy Anderson Ben Vaughan David Stewart Britin Bostick Lauri Redus C. Also present; Robert Talley, Code Enforcement Supervisor and Cheri Bedford, Main Street Manager, Historic Preservation Officer, Mary Ann Campbell 2. Approval of minutes from previous meetings. (January 12, 2012) Motion was made by Ben Vaughn seconded by Nancy Anderson to approve the meeting minutes for December 12, 2012. Motion carried 7-0. 3. Consideration of and action on the following Certificate ofAppropriateness: A. 4071 S` Street S. W. — Mary Ann Campbell proposed placing a sign on the North side of her building covering an existing blanked window opening of the building and brought a sample of materials to be used. Commission viewed a sample model sign with size of lettering- 5 inch letters. Paul asked if the sign dimensions would meet the criteria for the sign ordinance. It was determined it would meet the criteria. Price A clarification about the address of item G was brought up by Ben Vaughn, it was determined the structure to be demolished was clarified by the picture, and before demolition the actual address and property will be worked out by the Lamar County Appraisal District and Code Enforcement and listed in the public notices. Ben Vaughn asked about the property item H, whether just the house or the all structures would be demolished. Robert confirmed the all structures will be removed. Motion was made by Ben Vaughan, seconded by Laurie Redus to send all structures to the Building and Standards Commission, since they cannot be rehabilitated nor do they have significant historical value. Motion carried 7-0. 6. Paul Denney led the discussion on the following items and suggested a research committee be developed in response items 1, 2 and 3. Britin Bostick, Paul Denney, and Nancy Anderson volunteered to serve on the committee. Motions made by Paul Denney to table items 1, 2, and 3 and form the committee to bring back to the Commission with more specific wording on this amendments-Ben Vaughn made the motion, Douglas Cox Second. Amendment of the HPC Design Guidelines to allow 5%2' nominal width V-Groove vertical painted wood siding blanker panels on side or rear portions of Downtown Historic District buildings. Paul recommended filler panel for sides and rears and NOT primary facades. Least historically correct. 60% of the buildings are vacant and storage, revitalization very slow- only comment was from Ben Vaughn, with no objections. Amendment of the HPC Design Guidelines to allow painted black or dark gray plywood blanker "pane-panels" to be used in lieu of glass panes in existing above-canopy transom windows and/or multi-pane sidelights in the Downtown Historic District. Discussions: Incentive to building owners to bring back the look of the transom windows to make a step toward historically correct windows and give the historic look and feel and be a tool for preseroation. Amendment of the HPC Design Guidelines to allow heavy-duty black or white fencing vertical pipe or steel tubing fences and/or gates at the entrances to existing alleys in the Downtown Historic District. City owned/ private ownership? Needs more investigation? Clarification on access. 4. Cheri Bedford included in the agenda packet the National Parks Service Preservation Brief 31 on Mothballing techniques for the commission to be aware of all the specifics that it would include if someone would be interested utilizing this as a tool to preserve their historic structure for future use.- Ben made a note about the procedures in Mothballing and how they coincide with the Demolition by Neglect ordinance that HPC is very interested in pursuing. 7.
