The Historic Preservation Commission meeting was called to order by Paul Denney, Chairman 4:01 p.m. A. The following members were present: Douglas Cox Nancy Anderson Ben Vaughan Britin Bostick Laurie Redus Paul Denney B. The following members were absent: David Stewart C. AppYOVaI of� minutes from February 13, 2013. Motion was made by Ben Vaughan seconded by Nancy Anderson. Motion carried 6-0 3. Consideration of and action on the following Ce�^tificate ofAppropriateness: A. 15 E. Plaza- Dr. Colton Wicks presented the colors he wanted to paint the eagle on the top of the building. The commission reviewed the drawing by Dr. Wicks, and discussed the options for the fabrication of the original design on the metal work covering the windows. He stated he had seen the metal work on the American Legion Building, and would want to have his work fabricated. He asked about constraints on metal used. There was some discussion on powder coating the metal framework. Dr. Wicks was agreeable to bringing back a fabricated sample to be reviewed by the Chairman or Vice Chairman before placing it on the window. A Motion was made to approve the color scheme of the eagle as presented, and to approve the metal fabricated window covering as presented with the stipulation that Paul Denney or Ben i�aughan review a sample before actual installation. Motion made by Laurie Redus, seconded by Britin Bostick Motion Carried 6-0 4. Discussion of and possible action regarding the following structures considered by code inspectors to be in violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and �� 11 Structures," to determine whether such buildings or structures can be rehabilitated and designated on the National Register of Historic Places, as a recorded Texas Historic Landmark, or as historic property as designated by the City Council of the City of Paris. A. 339 W. Kaufinan Code Enforcement recommendation to demolish structures. Douglas Cox had asked this house to be tabled and brought back to the commission from the last meeting. Robert Talley gave a report about the condition of the property, floor rotten and it was unsecure. The commission also heard a report on the property by council woman Sue Lancaster. Sue Lancaster brought up the fact that the house was not on the 1988 National Register nomination. Motion was made by Ben Vaughn, seconded by Douglas Cox to send the structure to the Building and Standards Commission, since it cannot be rehabilitated nor does it have significant historical value. Motion carried 6-0. The commission discussed the use of stucco in the historic district, no action taken 6. Note: Bill Harris joined the meeting at 3:07 p.m. Steve Gilbert told those present that Doug Wehrman, Chairman, was in the hospital with pneumonia and was not able to attend the meeting. The GTech Building has been leased by Winfield Solutions a subsidiary of Land O' Lakes. He passed around the publication "Expansion Solutions" showing the ad promoting J. Skinner Baking Company. He told those present that he would be going to Austin the latter part of the week to start the process of how to obtain grant funding from the USDA/TDA in the amount of $250,000 to $500,000. ln addition, the dates have been set for Lamar County Days in Austin, March 26-28, 2013. Discussion and qossible action to amend the FY 2012-13 Bud�et. Discussion and possible action re�ardin� the 2013 Onerational Priorities and Business Plan Imnlementation Year 2. Toni Clem made a motion that the above two items be discussed at a future meeting or workshop; seconded by Bill Harris. Motion Carried 4-0. �- 13 PEDC Board Meeting Minutes January 15, 2013 Discussion and possible action regarding Aroposed 90-Day agreement with Richard Seline. Steve told those present that Richard Seline has been instrumental in getting our current business plan off the ground and represented us at the U.S. Chamber of Commerce meeting in mid-December 2012. Richard Seline's services are like an advocate or salesman e.g., always represents Paris, Texas to attendees at various functions, planning for the upcoming Lamar County Days, National 4-I I leaders, USDA Rural Development, Water Development Board and unsolicited proposals for funding. Toni Clem made the motion to table this item until the future workshop session on February 4, 2013 from 1:00 p.m. to 5:00 p.m.; seconded by Bill Harris. Motion Carried 4-0. Discussion and possible action to adopt the SEP/IRA Plan administered through Edward Jones for PEDC emqloyees. Toni Clem made a motion to approve the SEP/IRA through Edward Jones; seconded by Bill Harris. Motion Carried 4-0. Discussion and qossible action of the revised Personnel Manual for the Paris EDC. The Board convened into executive session at 3:35 p.m. pursuant to Section SS1.071, Section 551.072, 551.074 and Section 551.087 of the Texas Government Code to discuss and deliberate on the following: A. P., 327 E Washington, City Block 146, Lot 15 - 17 Vicky Ballard entered the meeting at 4:lOpm. P. 327 E Washington, City Block 146, Lot 15 Owner: Jan O'Brien Dyke, 731 SE 3rd Paris, TX 75460 Present: Jan O'Brien Dyke — owner, Michael Johnson — Renter, and Bruce Shupe — overseer for Mrs. Dyke. Back taxes -$1614.14 Mr. Talley stated that the property at 327 E Washington was brought before the commission in August of 2012. The property owner was given 90 day to repair. A permit was pulled but not enough work has been done. There are still dogs living in the house, the roof is still collapsing, the foundation at the back of the house is sinking into the ground and the windows are not boarded up. Michael Johnson stated that he has replaced a window but it has been broken out by vandals, he has a police report. He is going to try and make the walls more stable before he can fix the roof. Bruce Shupe stated that his son-in-law is a contractor and he is going to have him come and tell them the best way to proceed. They have someone who is going to bring them the materials to fix up the house. Jan Dyke asked the Building and Standard Commission for 60 days to fix the structure. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. The Building and Standard Commission granted a 60 extension stating that there must be substantial repairs to the structure and that the property is to be brought back to the BSC in exactly 60 days for review. Motion was made by Johnny Norris, seconded by Wendell Moore to allow Mrs. Dyke 60 days to have the property repaired. The property will be brought back before the Building and Standards Commission in 60 days to review the repairs. Motion carried unanimously. 6-0 Request was made by Robert Talley to move to item 3. Back Taxes -$408.72 Robert Talley showed pictures of deterioration on the roof, small holes above the windows, rot and termite damage and the siding peeling away from the house. Mrs. Lewis stated that when Mr. Brown passed away the house was inherited by her mother. Her mother passed away in November of 2012 so she is now responsible for the property. She agrees that the house needs to be demolished but cannot afford to do it herself. Mr. Talley stated that he and Mrs. Lewis have spoken and she has agreed to sign the Right of Entry and Indemnification so that the City of Paris can demolish the structure and she will set up a payment plan with the City because she wants to keep the property. l� � ; � Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Back Taxes -$1064.71 Robert Talley showed pictures of the porch falling in, a hole in the roof, deterioration of wood and the roof buckling. Back Taxes $77.25 Robert Talley stated that the owner signed for the certified mail and that he has spoken with Michael Long on several occasions. Mr. Talley showed pictures and stated that the Code Enforcement Abatement Crew recently cleaned the yard, carrying away at least 14 mini-dump loads of junk and rubbish. He showed pictures of boards and pieces of privacy fence on the porch, a large hole in the side of the house, where the property owner cut with a chain saw, wanting to put a window in, there is also a missing window in the back of the house. Pictures were also show of the interior of the house and it is filled with junk and rubbish. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley showed pictures of fire damage throughout the attic, hole in the roof from the fire. The house is unsecure and there is furniture and other junk and rubbish in the front yard. There is fire damage throughout the attic, the roof has collapsed in the middle and the foundation is sinking into the ground. Robert Talley showed pictures of the property where someone has started to demolish it but did not complete it. Windows are missing, wood is deteriorating, there is a hole in the roof and the rafters are starting to poke through the shingles. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley showed pictures of deterioration along the roof line, the front door is unsecure and will not shut, several of the windows have had rocks thrown through them, there is deterioration at the back of the house, and there is water damage and the ceiling tiles are falling due to this. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley showed pictures of deterioration at the front of the house on the roof and the front porch, the rafters are starting to push through the roof, at the back of the house the roof has had some repair but there is still a hole. The foundation is rotting and sinking into the ground, there is missing and deteriorated wood and water damage on the inside. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley showed pictures of the roof that is starting to collapse; there is also deterioration of the rafters and broken windows. Robert Talley showed pictures of holes in the roof, deterioration and boards breaking along the roof line. The support for the back porch has been removed. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. No back taxes Robert Talley stated that the owner did sign for the certified letter. They have family that lives in Paris and they have been in contact with Mr. Talley. They requested 90 days to have the structure demolished. Robert Talley showed pictures the front porch and all four porch supports leaning, there is rotten and missing wood. The back of the house is sinking into the ground. The roof has holes and is buckling and there are broken windows. Robert Talley's recommendation: 90 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley showed pictures of the house being unsecure, there is missing and deteriorated wood at the foundation. There is also rotted wood and termite damage. In places the siding has been pulled off and the supports under the house 22 are starting to lean. There is also a hole in the floor in the inside of the house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Robert Talley showed pictures of the front door that has been kicked off the frame; the underpinning is starting to come off because the back of the house is starting to sink. There is deterioration of boards and of the foundation. Mr. Talley stated that there are three people staying in the house (squatters) that are starting fires in the house to stay warm, the Paris Police are aware of this and are trying to catch them at the house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. E. lOth, Fitzhugh Addition, Block 1, Lot 1 Owner: Billy Wayne & Mona Emma Smith, 1220 Fitzhugh, Paris, TX 75460. Back Taxes - $1245.45 Robert Talley stated that he has spoken with Mr. Smith as well as Donald Blackburn. Mr. Blackburn sold the house to the Smith's through owner financing. Mr. Blackburn agrees that the property needs to be demolished and will sign the Right of Entry and Indemnification. Mr. Talley showed pictures of a large hole in the roof, the foundation is unleveled. There is missing and deteriorated wood along the foundation and the foundation is sinking. (1) Robert Talley stated that the spreadsheet is not up to date because since the BSC packets went out he has received a bill from Sanitation Solutions so there are seven more structures that have been demolished. So for one calendar year the Building and Standards Commission has seen 145 structures. (2) Robert Talley stated that 24 & 26 Clarksville St, a structure which HPC had pulled in the past, has had a roofing permit pulled. There were some issues on legal heir ship but that has been sorted out and Quality Roofing is going to replace the roof. (3) Johnny Norris asked about Mr. Kammer's building on SW lst St. Mr. Talley stated that Mr. Kammer appealed the decision and it is going before the District Court. (4) Vicky Ballard asked about the progress of 1808 Margaret. Mr. Talley said that he has not been by there but the neighbors are not complaining. He did receive one call saying that the owners are doing a good job fixing the property. (5) Don Wilson asked about 107 Grand Ave. Robert Talley stated that Bobby Smallwood has purchased the property and is trying to decide what the best options are. He was working with Jeanna Scott on this matter but Ms. Scott is no longer with the City of Paris. Mr. Smallwood will work with the new Building Official Joey Sleeper. Mr. Wilson stated that he wants to make sure this is followed up on in a timely manner because the property is still under a BSC order. (6) 134 SW lst — Truby Trust, Richard Hunt is working on this. Currently he is doing work on the inside. (7) Vicky Ballard stated that Main Tire looked very nice. Mr. Talley stated that two of the owners agreed to demolition but that one owner �vanted to repair it. As of right now they are not allowed to have renters under orders of the Fire Marshall. The owner is tr3�ing to repair it. (8) Don Wilson asked about the Harper building next to Swaim Hardware. Mr. Talley stated that they have turned in plans but again they were working with Jeanna Scott and she is no longer with the City. Mr. Talley is not sure what the current progress is. He will get with the Building Official, Joey Sleeper to get an update. (9) Don Wilson stated that he would like for the City Council to adopt an 24 ordinance that directs staff and commissioners of the process to be used concerning property owners who missed or could not attend a Buildings and Standards meeting in which their property was ordered to be demolished, but appear after the meeting and request to repair their property rather than demolish. 5, Future agenda items.
