RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, ACCEPTING A DEED OF DONATION OF PROPERTY
FROM CAROLE L. TOWERS, ATTORNEY-IN-FACT FOR FRANCES C.
MILLER, BEING LOTS 21, 22, AND PART OF LOT 23, BLOCK 1,
GIBBONS PARK ADDITION, BEING LOCATED AT 845 AND 855 E. POLK
STREET; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO
THE SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City of Paris is in receipt of an offer of donation of property from Carole
L. Towers, Attorney-in-Fact for Frances C. Miller as owner of Lots 21, 22, and part of Lot 23, Block
1 of the Gibbons Park Addition, located at 845 and 855 E. Polk Street; and,
WHEREAS, the aforesaid owner of this vacant lot states she is no longer able to care for this
property; and,
WHEREAS, in lieu of the City mowing and clearing said lot and placing a lien on the
property, thereafter to initiate collection proceedings on the property for the lien cost, the property
owner has offered to convey the aforesaid vacant lot to the City tax free, under a General Warranty
Deed, with the City to thereafter mow and clean the lot and utilize the property thereafter as the City
would deem appropriate; and,
WHEREAS, the City Council finds and determines that it would be in the best interests of
the City of Paris to accept the offer of donation of the aforesaid property, to mow and clean the
vacant lot, and to thereafter utilize the aforesaid property as the City Council deems appropriate;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the donation of Carole L. Towers, Attorney-in-Fact for Frances C. Miller,
of Lots 21, 22, and part of Lot 23, Block 1, Gibbons Park Addition, located at 845 and 855 E. Polk
Street, Paris, Texas, by General Warranty Deed in such form as is acceptable to the City Attorney,
be, and the same is hereby, in all things accepted.
Section 3. That this resolution shall be effective from and after its date of passage.

TO WHOM IT MAY CONCERN
This letter is in reference to the property located at 845 and 855 East Polk,
Paris, Texas. These properties are owned by my aunt, Frances C. Miller,
who was never married, has no children, or immediate surviving family. I
have had Power of Attorney of Frances since 1999, before she was admitted
to the Paris Nursing Home, located on Clarksville Street. Frances is
suffering from Dementia and is in the last stages of Alzheimer's and is also
confined to a wheelchair. Frances, will unfortunately always be in a
nursing home until her death. She is not competent due to her condition and
is not able to sell or financially upkeep the properties on East Polk Street.
Each of these properties have houses located on them. Before Frances was
admitted into the nursing home both properties had considerable roof and
rain damage to the inside of the houses. The roofs have now fallen into the
homes and the damage is extensive and the houses are not repairable.
Everything in both yards is in an overgrown state; and large trees that were
damaged in the ice storm last year have fallen onto the houses and property.
There is one other relative, a niece Pam Urbano, and myself who see to
Frances' emotionally needs; but we are not able to help her financially. We
are both divorced and single, and in our 60's, and have a very limited
income.
The city has contacted Pam Urbano about the condition of the properties
and suggested that they would clear the houses away and clean up the land
if ownership of the properties were signed over to the City of Paris. Can the
City of Paris contract a legal agreement stating that the cleating of the
houses, cleaning of the land and ownership of the properties be signed over
to the City. I will sign this agreement through my Power of Attorney for
Frances Miller.
