ZONING CHANGE REQUEST OF FAULK & FOSTER
THE ABOVE REQUEST WAS TABLED BY CITY COUNCIL IN APRIL FOR REVIEWING
OF THE TOWER ORDINANCE AND ZONING. MY RECOMMENDATION TO THE
COUNCIL IS NOT TO CHANGE THE ZONING. THIS PROPERTY IS THE BIG TEX FEED
PLANT LOCATED AT 3720 LAMAR AVENUE. WHEN THE PROPERTY WAS ANNEXED
INTO THE CITY, THE COUNCIL DID NOT WANT TO EXTEND LIGHT INDUSTRIAL
ZONING IN THE AREA. THEREFORE, THE PROPERTY WAS GIVEN PLANNED
DEVELOPMENT-C (PD-C) (INDUSTRIAL PARK). THE PLANNED DEVELOPMENT
ZONING GIVES PLANNING AND ZONING AND CITY COUNCIL THE RIGHT TO
APPROVE SITE PLANS REQUIRED TO OBTAIN A BUILDING PERMIT. IF GIVEN THE
LIGHT INDUSTRIAL ZONING REQUESTED, PERMITS FOR FUTURE DEVELOPMENT
OF THE SITE FOR ANY LIGHT INDUSTRIAL USE COULD BE ISSUED AS A MATTER
OF RIGHT WITH ONLY STAFF APPROVAL.
IF COUNCIL WANTS TO ALLOW THE TOWER, MY SUGGESTION WOULD BE TO
CHANGE THE CITY TOWER ORDINANCE SECTION 28-104 (B) AND ALLOW THE
INSTALLATION OF TOWERS IN PLANNED DEVELOPMENT-C (PD-C) (INDUSTRIAL
PARK). THIS PROPERTY IS THE ONLY PLANNED DEVELOPMENT-C (PD-C)
(INDUSTRIAL PARK) ZONING LOCATED IN THE CITY LIMITS AT THIS TIME.
FAULK AND FOSTER IS ALSO APPEALING THE DENIAL FOR A BUILDING PERMIT
FOR THE TOWER THAT WAS DENIED BASED ON ZONING AND SETBACKS. THE
SET BACK REQUIRES THE TOWER TO BE SETBACK ON ITS OWN PROPERTY AT
LEAST A DISTANCE EQUAL TO THE HEIGHT OF THE TOWER. THE TOWER W~_ OULD,
ALSO, HAVE ENCROACHED ON PROPERTIES ON THREE OF THE FOUR SIDES THAT
IT WOULD BE LOCATED ON.
THE CITY OF PARIS CONTRACTED WITH TROUT COMMUNICATIONS TO DO A
STUDY OF THE FAULK AND FOSTER TOWER APPLICATION. THE FINDINGS HAVE
BEEN INCLUDED IN YOUR PACKET. PLEASE NOTE A TOWER IN THIS GENERAL
AREA IS NECESSARY TO MAKE THE CELLULAR SYSTEM OPERABLE. THERE IS
ALSO ANOTHER AREA THAT YOU NEED TO SEE THAT THE TOWER COULD BE
MOVED TO, WHICH IS GENERALLY WEST.
WHAT NEEDS TO BE CONSIDERED HERE IS THAT WAYNE BROWN, WHO OWNS
PROPERTY ACROSS THE STREET, IN THE STUDY AREA, IS ZONED PROPERLY. THIS
PROPERTY MEETS THE SETBACK OF THE TOWER ORDINANCE WITH NO
CHANGES REQUIRED, AND IS ALSO AN APPROPRIATE LOCATION BASED ON THE
TROUT STUDY. IN OTHER WORDS, THE TOWER COULD BE PLACED ON WAYNE
BROWN'S PROPERTY AS A MATTER OF RIGHT AND THE BIG TEX AREA COULD BE
LEFT AS IS. I HAVE SPOKEN TO MR. BROWN AND HE WELCOMES THE TOWER ON

FOSTER AND THEY HAVE THE IMPRESSION THAT MR. BROWN'S PROPERTY
WOULD NOT MEET THE ZONING REQUIREMENTS. I SPOKE WITH BELINDA BODIE
REGARDING MR. BROWN'S PROPERTY ON FRIDAY, JUNE 17, 2002. I ASSURED MS.
BODIE THAT MR. BROWN's PROPERTY MEETS ALL THE REQUIREMENTS OF THE
TOWER ORDINANCE. BECAUSE FAULK AND FOSTER IS REQUESTING
EXTRAORDINARY RELIEF IN THE APPROVAL OF THEIR REQUEST I BELIEVE THEY
SHOULD BE REQUIRED TO EXPLAIN WHY THE HAVE NOT CONSIDERED THE
BROWN PROPERTY AS AN ALTERNATIVE SITE.
Sec. 28-103. Applicability.
(a) New W&F and Support Structures. All new WCF or Support Structures
in the City of Paris shall be subject to these regulations, except as provided herein.
(b) Amateur Radio Station Operators/Receive Only Antennas. This
ordinance shall not govern any WCF or support structure or the installation
thereof, that is under seventy (70) feet in height and is owned and operated by a
federally licensed amateur radio station operator or is used exclusively for receive-
only antennas. Such installation shall comply with any other applicable provisions
of the City Zoning Code or other ordinances.
(c) Preexisting WCF and Support Structures. Preexisting WCF or Support
Structures shall not be required to meet the requirements of this ordinance other
than the requirements of Section 28-110 and 28-111.
(d) Exemptions for Governmental Entities. This ordinance shall not govern
any WCF or Support Structure, or the installation or construction thereof, which
is installed or constructed by a Governmental Entity as that term is defined in this
ordinance, provided the primary purpose or use of said WCF or Support Structure
is in furtherance of the functions of the Governmental Entity, and not for
commercial use or fmancial gain.
Sec. 28-104. Wireless Communication Facilities Prohibited.
(a) Areas designated historically significant. From and after the effective
date of this ordinance, no WCF's shall be permitted in any area that shall be
hereafter designated by the City as a historically significant area or district.
(b) Permitted areas. From and after the effective date ofth~s ordinance ne
WCF's shall be permitted only in areas bearing a zoning designation of
Agricultural (A), Commercial (C), Light Industrial (LI), or Heavy Industrial (HI~;
the siting of new WCF's; in areas zoned other than as designated herein, including
Residential Districts (SF-1),(SF-2), (SF-3), (2F), (MF-1), (MF-2), Planned
Development Districts (P.D.), and other non-Agricultural, non-Commercial, and
non-Industrial Districts, including Parking Districts (P), Office District (O),
Neighborhood Service District (NS), General Retail District (GR), and Public
Lands and Institutes (PL&I), shall be and is hereafter prohibited.

Sec. 28-105. Permit Required.
Frbm and after the effective date of this ordinance, no person shall install
or construct any WCF unless and until a Tower Use Permit (TUP) has been issued
pursuant to the requirements of this ordinance.
Sec. 28-106. General Requirements.
(a) Platted Lots. Each WCF, including the support structure and any
related equipment facility, shall be located on a platted lot.
(b) Height Standards.
(1)
Attached WCF. The total height of an existing building or structure
to which a WCF has been attached shall not exceed two hundred
sixty (260) feet, subject to the other terms and provisions of this
ordinance.
(2)
WCF with Support Structures. WCF with Support Structures shall
have a maximum height of two hundred sixty (260) feet, subject to
the other terms and provisions of this ordinance.
(c) Setback Standards. All WCF shall be set back from any adjoining lot
line or adjacent street curb line a distance equal to the height of the WCF itself,
including any support structure and antenna array. In determining the setback
requirement, the distance shall be measured from the base of the support structure.
(d) Separation from off-site uses/designated areas.
(1)
WCF including Support Structures and antenna array shall be
separated from all lands zoned SF-1, SF-2, SF-3, 2F, MF-1, or MF-
2 by a minimum of two hundred sixty (260) feet. ~
(2)
Separation ofa WCF from such off-site uses shall be measured from
the base of the WCF to the lot line of the off-site use following a
straight line from the base of the WCF to the closest point of the
designated zoned property.
(e) Compliance with existing City ordinances regarding preservation of trees
and other vegetation. All WCF facility installations shall comply in full with the
City's requirements regarding the preservation of trees and other vegetation
incident to any construction activity.

An alternative technology that does not require the use of Support
Structures, such as a cable micro-cell network using multiple low
power/receivers attached to awire iine system, is unsuitable. Costs
of alternative technology that exceed new Support Structure or
WCF development shall not be presumed to render the technology
unsuitable.
(b) As part of the process of consideration as to whether or not existing
Support Structures or WCF would be suitable for an Applicant's needs, any owner
of any existing Support Structure or WCF may participate in any application or
permitting process by submitting evidence contrary to that produced by the
Applicant indicating that the owner of said existing structure has the capability of
providing the necessary Support Structure and WCF access for the applicant.
See. 28-108. Administrative approval.
(a) General. The following provisions shall govern the approval of
applications for Support Structures and WCF under this ordinance:
(1)
The Director may administratively approve the Support Structures
and WCF listed herein.
(2)
Each Applicant for approval shall apply to the Director providing
the information set forth in Section 28-109 of this ordinance and a
non-refundable fee in the amount of five hundred dollars ($500.00)
to reimburse the City for the cost of reviewing the application.
(3)
The Director shall review the application and determine if the
proposed use and application for WCFeand Support Structure
complies with this ordinance.
(4)
The Director shall respond to each such application within six.[y
(60) after receipt of same by either approving or denying the
application.
(5)
If approval of an application is denied by the Director, the
Applicant may at his choice file an appeal of said decision to the
City Council, provided such application for appeal is filed in
writing within ten (10) days following the denial of the application
by the Director.
(b) List of acceptable Applications. The following applications for WCF
and Support Structures may be approved by the Director after conducting an

zoning change would be consistent with the comprehensive plan of the City of Paris, consistent

REPORT ON LOUISIANA UNWIRED PROPOSED TOWER AT MIRABEA
The firm of Trott Communications Group, Inc. ("TCG"), Irving, Texas, has been retained
by the City of Paris, Texas to analyze a proposed tower ("Tower") location by Louisiana
Unwired, LLC ("LU") for a 180' communications tower located southeast of the
intersection of Lamar Avenue and Loop 286 SE. The Tower is to be added to the LU
PCS system to enhance the coverage of the wireless telephone network to include the
eastern portion of the downtown area.
TCG has been asked by the City to investigate an alternate tower location for the
subject Tower.
For the analysis, LU supplied TCG with the parameters of the existing sites surrounding
the proposed Tower. These sites are:
Reno (Reno)
Paris Downtown (PDT)
Campbell (CBL)
Stone (STO)
The parameters (Exhibits TCG-2 through TCG-5) were used to develop propagation or
coverage plots of the above four sites so that a determination of whether a relocation of
the Tower will affect the overall system design.
Propagation Model
TCG uses EDX's Signal TM RF Propagation Tool for coverage predictions. TCG has
used this tool and its updates for over six years. We have found it to be extremely
reliable for the level of detail required for the design of cellular and PCS systems. The
computer model is based on industry standard techniques, including digital terrain
factors, that are similar to the various suppliers of propagation software.
Exhibit TCG-1 is a color plot of the predicted coverage of the 3 sectors of each of the
above 4 sites. For clarity, the predicted coverage from the Tower was not included. This
allows depiction of the void in the coverage without the Tower. The coverage of each
sector is shown by different colors. This a "best server" plot where areas shown for
each sector depict the strongest signal. Thus, any overlap of sector coverage would not
be shown.
Results
The design of wireless telephone systems, e.g., cellular and PCS, involves controlling
the propagation (coverage) of each cell such that a small area (cell) can be covered
efficiently and, at the same time, minimize interference to other cells utilizing the same
frequency groups. Controlling the signal levels at the perimeters of each cell is also very
important because of the requirement that when a subscriber passes from one cell to
another, the call is uninterrupted because of Iow signal levels. This is called, "hand-off'.
Because of this, the layout of the cells becomes very location-critical.
The analysis was conducted considering only the coverage of each sector and did not
include capacity, interference or hand-off analyses.
In order to maintain the integrity of the design of the system, it appears that the Tower
should be located within the area shown on the plot (Exhibit TCG-1). This area is
approximately 1 mi X .6 mi. There was no effort by TCG to determine whether or not
there was availability of a tower or property for a tower in this area.
Conclusion
