Re: Bids for 90 HP Tractor for Water Treatment Plant
We will be opening bids on July 2, 2002 for this tractor. This tractor was to
be used in maintenance of the WTP Sludge Disposal Field. We have a BFU (Beneficial Use
Permit) from the TNRCC for this field, which is adjacent to the WTP.
The bids were to be presented to the Council at the July 8, 2002 meeting. At
this time, I propose that we reject any and all bids and possibly place this item into a future
budget. The amount currently budgeted for this tractor is $50,000.00.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, REJECTING ALL BIDS FOR THE PURCHASE OF A 2002
YEAR MODEL 2-WHEEL DRIVE, 90HP (PTO) TRACTOR FOR USE AT
THE WATER TREATMENT PLANT; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, on the 1 lth day of
March, 2002, in Resolution No. 2002-049, approve the advertisement for bids for the purchase
of a 2002 Year Model 2-Wheel Drive, 90 HP (PTO) Tractor for use at the Water Treatment
Plant, which bids were received until 3:00 o'clock p.m., Tuesday, the 2nd day of July, 2002; and,
WHEREAS, the Director of Utilities has recommended that all bids for such equipment
be rejected and that such equipment not be purchased from the current fiscal year funds; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That all bids for the purchase of a 2002 Year Model 2-Wheel Drive, 90 HP
(PTO) Tractor for use at the Water Treatment Plant be, and the same are hereby, rejected.
Section 3. That this resolution shall be effective from and after the date of passage.

Specifications
2002 Current Model 2-Wheel Drive Tractor
Purpose
The equipment described in these specifications will be one ( 1 ) 2002 current model 2-
wheel drive tractor to be used in the Utilities Department at the Water Treatment Plant.
Equipment will be expected to perform under conditions normally found in the Utilities
Department, i.e. occasional flooding, muddy conditions, extended periods of time at low
RPM and extended periods of time under heavy use conditions in all temperatures. These
conditions shall not adversely affect equipment operation.
Bid Requirements
Equipment bid shall be new, current model 2002 2-wheel drive tractor. Demonstrator or
used equipment will not be acceptable. Equipment bid shall meet the following
conditions.
Equipment shall be delivered fully serviced, adjusted and ready for operation. All
repairs or modifications needed for normal operation shall be made to the
satisfaction of the City of Paris.

Replacement parts and service department shall be maintained within 150
Miles of the City of Paris. Service Department shall be staffed with qualified
service personnel, shall stock a representative parts supply (especially fast wear
items), and shall have provisions for securing parts from manufacture.
c)
The successful bidder or manufacture shall provide an instructor for a training
session at the City of Paris Utilities Department. This training shall orient city
personnel on the operation and mechanical features of the equipment.

The City of Paris reserves the right to award the bid to any responding bidder. The
Quality of the equipment supplied, conformity with the specifications, the
suitability to expected use, delivery time, warranty terms and parts availability
may also be a consideration in awarding bid.

The bidder shall include all transportation cost, and demonstration cost on the
price quoted. Equipment shall be F.O.B. City &Paris Water Treatment Plant,
Lake Crook Rd., Pads Texas.
F)
The City of Paris reserves the right to reject any or all bids, to waive information
in bids, to accept such bids as may be deemed in the best interest of the City of
Paris.

Shall be minimum 35 AMP charging capability. Shall have internal or extemaI
regalator. Shall have the capability of running flashing and/or headlights for
extended periods of time at idle speeds. Shall be heavy duty to withstand periods
of time running.
Battery
Shall be single or dual heavy duty with a minimum 800 cranking amps. Battery
shall be secured in such a way that vibration shall not adversely affect battery
durability.

Shall be multi-disc, oil cooled
Cooling System
Cooling system shall be maximum size available. Shall have capability to cool at
100 degrees outside ambient temperature while at full throttle for extended
periods of time. Shall have provisions for external hydraulic cooler in conjunction
with cooling system.
Color
Shall be manufacturer's standard color. Shall be industrial grade paint to
withstand chipping and scratching and shall be fade resistant.
Clutch
Shall be single or multiple disc-wet type.

Shall be equipped with rear differential lock..

Engine shall be diesel fueled 6 cylinder design, normally aspirated or
turbocharged. Block shall be parent metal bore or wet sleeve. Engine shall be

dual dry type. Shall have "spin on" full flow oil filter, if available. Engine shall be
equipped with high temperature, low oil pressure warning system or shut down, if

shredder operation. Shall be equipped with federally approved, factory-installed
cab. Seat shall be equipped with a seat belt.

Shall be constructed of cloth material. Capable of forward/reverse settings. Shall
be equipped with a federally approved seat belt.
Service Manuals
Shall be furnished at the time of delivery of equipment. Manuals shall consist of
one (1) complete set, i.e. operator, repair, parts and electrical wiring. Manuals
shall be in heavy-duty vinyl covered" loose leaf" type 3-ring binders. If binders
are not availably, covers shall be heavy duty flexible plastic.

Each warranty term begins on the date of product delivery to the purchaser (except for certain agricultural tillage, planting, cultivatin!
and harvesting products which may have a delayed warranty start date, but only if established by John Deem and noted by the deale~
on the purchase order).
Sweeps, Shovels, Plow Shams and Disk Blades - A replacement part will be furnished without charge if the following John Deem
items break during the applicable warranty term, subject to these conditions:
SWEEPS & SHOVELS - When breakage occurs on items which do not show appreciable wear.
PLOW SHARES - When breakage occum before the plow share reaches the tolldwing wear limits (labor not included - wear to be
measured perpendicularly acroas the middle of the front bolt hole): INCH DIMENSION SHARES: 1/2 inch of wear (3½ inches remaining);
METRIC DIMENSION SHARES: 15mm ot wear (lOOmm remaining).
DISK BLADES - When warrantable breaks occur as shown in the operator's manual on blades that have worn less than 10 pemant ot

dealer for details. (3) Any product that has bean altered or rnodifiad in ways not app~ovad by John Deem: including, but not h~ted to,
setting injection pump fuel delivery above John Deem specifications; (4) Dapmciation or damage caused by norrnal wear, lack ot masone!31e
and proper maintenance, failure to fallow the product's Operator Manual recornmandetions. (5) Normal maintenance parts and se~ce
including but not limited to oil filtem coolants and condit~3ners cutting parts, belts, brake and clutch linings. (6) Use of t~ct~rs other than
8000 Sehas wheel and track units, 9000 Sedas wheel and 9320T, 9420T or 9520T tractors in certain industrial-type app icabons such as,
but not limited to, land planing or scraping, whether commemial or pdvate, will timit warranty coverage. .
D. SECURING WARRANTY SERVICE - To secure warranty service, purchaser must (1) report the product defect to an authorized (~e~.ler
and request repair within the applicable warranty term, (2) present evidence of the warranty start date, and (3) make the product avalabie
to the dealer or service center within a reasonable period of time.
E. NO IMPEED WARRANTY OR OTHER REMEDY - AGRICULTURAL PRODUCTS - Where permitted by law, neither John Deem or any
company afflliatad with it makes any warranties, mprasentatK~qS, or promises, express or tmPliad as to the quality or performexx:e, or
freedom from defect of its agricultural products other than those set forth above, aod NO IMPLIED WARRANTY OF MERCHANTABILITY OR
FITNESS IS MADE. IN NOEVENT WILL THE DEALER, JOHN DEERE OR ANY COMPANY AFFILIATED WITH JOHN DEERE BE LIABLE
FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. The onty mmediea the purchaser has in connection with the breach of
performance of any warranty on John Deem agricultural products are those set forth above.
F. MMITATION OF IMPUED WARRANTIES OR OTHER REMEDIES - COMMERCIAL & CONSUMER EQUIPMENT - To the extant permitted
