A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE TERMINATION OF CUSTODIAL CONTRACT FOR THE MAINTENANCE AND CUSTODIAL SERVICE FOR THE CITY HALL, WATER BILLING OFFICE, CITY HALL WEST ANNEX, CITY HALL NORTH ANNEX, THE PARIS PUBLIC LIBRARY, AND THE MUNICIPAL AIRPORT TERMINAL; AUTHORIZING ADVERTIZING FOR BIDS LABOR, MATERIALS, AND EQUIPMENT AND FOR PERFORMING ALL WORK REQUIRED FOR MAINTENANCE AND CUSTODIAL SERVICE TO INCLUDE ADDITIONAL AREAS OF SERVICE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, in Resolution No.99-041, on Apri129, 1999, award the bid and approve execution of the Custodial Contract for maintenance and custodial service with David Van Noord d/b/a Van Noord 7anitorial Service; and, WHEREAS, the City Council of the City of Paris deems it in the best interest of the citizens of the City of Paris to terminate said Custodial Contract and advertise for bids labor, materials, and equipment and for performing all work required for maintenance and custodial service on specified City of Paris facilities; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the termination of the existing Custodial Contract for maintenance and custodial service for the City Hall Building, Water Billing Office, City Hall West Annex, City Hall North Annex, the Paris Public Library, and the Municipal Airport Terminal with David Van Noord d/b/a Van Noord 7anitorial Service be, and the same is hereby, approved, and the City Manager is hereby authorized to issue notice of termination to the contractor effective sixty (60) days from receipt thereof in accordance with the requirements of the contract. Section 3. That a new Custodial Contract to include enhanced specifications and additional areas of service and in such form as the City Attorney shall approve be advertised for bids to be received after due notice at the office of the City Manager of the City of Paris, City Hall, 13 5 1 st Street S.E., Paris, Texas 75460, on such date as the City Manager shall determine consistent with termination of the existing contract, at which time said bids will be opened in the City Council Chamber, City Hall, 135 lst Street SE, Paris, Lamar County, Texas, and bids will be read aloud, tabulated and referred to the City Council for its consideration. Section 4. That this resolution shall be effective from and after its date of passage. PASSED AND APPROVED this 12th day of August, 2002. Michael J. Schenk, City Attorney RESOLUTION NO. 99-041 WHEREAS, the City of Paris did heretofore, give written nodce that the cunent custodial contract with the Ciry of Paris is being terminated for faiture to perform the services required utider the contract, and pmceeded to advertise for bids for furnishing plant, labor, materials and equipment and performing all work required for the maintenance and custodial service for the following City of Paris buildings: City Hali, Water Billing Office, City Hall West Annex, Ciry Hall North Annex, the Paris Public Library and the Municipal Airport Terminal, which bids were received until 3:00 o'clock P.M., Tuesday, April 27, 1999; and, WHEREAS, the best bid for such maintenance and custodial service was made by David Van Noord d/b/a Van Noord Janitorial Service, and it should be awarded the bid for such maintenance and custodial service; and, WHEREAS, the form of contract for such maintenance and custodial service attached hereto as Exhibit A, should be approved, and the Mayor should be authorized to execute the same; NOW, TfiEREFORE, BE 1T RESOLVID BY TEIE CITY COUNCIL OF TfiE CTfY OF PARIS, that the bid of David Van Noord, d/b/a Van Noord Janitorial Service, for the maintenance and custodial service for the following City of Pazis buildings: City Hall, Water Billing Office, City Hall West Annex, City Hall North Annex, the Paris Public Library, and the Municipal Airport Terminal in the amount of $2,000.00 per month is hereby accepted and let conditioned upon said contractor meeting all of the terrns and specifications included in the bid documents; and, BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, Chazles H. Neeley, be, and he is hereby authotized and directed to ezecute on behalf of the City of Paris the contract with David Van Noord, d/b/a Van Noord Janitorial Service, for said maintenance and custodial service, upon the terms and conditions and in the form shown in Fxhibit A attached hereto. VAN NOORD will not employ persons who have convic6ons for a theft or felony for the work performed under any part of this contract. 5. VAN NOORD will not discriminate against any employee or applicant for employment because of race, religion, wlor, sex or nationai origin. VAN NOORD will take affirmative acHon to insure that applicants are employed and that employees are treated during employment without regard to their race, religion, color, sex or national origin. 3uch action shall include, but is not limited to the following: employmenh, upgrading; demotion or transfer; recruitment or recruitment advertising; layoff; termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. VAN NOORD agrees to post, in conspicuous places available to employees and applicants for empioyment, notices setting forth the requirements of these non-discrimination pmvisions. 6. VAN NOORD must provide insurance as required in the bid documents, certificates of which shall be filed with the City Clerk of the City of Paris. 7. DAILY Vacuum all carpeted.areas with an electric operated vacuum. Empty all trash receptacles and replace bag liners as needed. Mop all restroom floors. - Sweep or dust mop all hard surface floors. Clean and sanitize all restroom fixtures including sinks, commodes, urinals and stall dividers. Clean and shine drinking fountains. Spare toilet paper and paper towels should be placed in each restroom. Supply all restrooms with hand soap. Clean glass on all entrance doors. Dust all office furniture and equipment. WEEKLY Spot clean all carpeted areas that are soiled. Dust all doozs, baseboards, frames, handrails, chair legs, telephones, window sills, window blinds, file cabinets and open areas of book shelves (furniture polfsh shauld be used on wood fixtures). Vacuum and straighten chairs in City Council Room. EEHIBIT B B-1 ADDITIONAL MAINTENANCE SHALL INCLUDE: Strip and wax all hard surfaced areas every 6 months. Clean out ceiling light fixtures once per month. Interior of all windows shall be'cleaned once per month. - Replace burned out light bulbs as needed. The City of Paris will provide all paper supplies, sanitizers, plastic trash bags, soaps and window cleaner. All other supplies will be provided by the contractor including but not limited to vacuum cleaners, buffers, stripping chemicals and any other supplies needed that are not mentioned above. All employees of the Contractor when doing maintenance work under this contract must wear shoes, long pants and shirts at all times. Maintenance wil2 be worked Monday through Friday after 5:00 P.M., except for the weekly, monthly, and additional maintenance listed. This can be accomplished on week-ends if necessary, The Contractor will be responsible for Worlanan's Compensation and insurance for persons under this employment contract. Once a contract is signed, a check for the amount of the contract will be sent to the Contractor by the lOth day of the month.
