00-AgendaCITY COUNCIL AGENDA Notice is hereby given that the City Council of the City of Paris shall meet in regular session at 5:30 p.m. on Monday, May 13, 2013. The meeting will be held at the City Council Chamber, 107 E. Kaufman Street, in Paris, Texas. The matters to be discussed and acted upon are as follows: Opening Agenda 1. Call meeting to order. 2. Invocation. 3. Pledge of Allegiance. 4. a. Citizens' forum. (Persons desiring to address the Council must limit their presentation to no more than two minutes. Unless an item is posted on the Agenda, the Texas Open Meetings Act prohibits the Council from responding to any comments other than to refer the matter to a future agenda, to an existing policy, or to a staff person with specific factual information. Claims against the City, Council Members, or employees, as well as individual personnel appeals are not appropriate for citizens' forum.) If necessary, the City Council may convene into Executive Session under Chapter 551 of the Texas Government Code regarding any item on this agenda. b. Proclamation declaring the month of May as National Bike Awareness Month- Project Bike. c. Proclamation declaring the month of May as Motorcycle Awareness Month. Consent Agenda ltems on the Consent Agenda are approved by a single action of the Council, with such approval applicable to all items appearing on the Consent Agenda. A Council Member may request any item to be removed from the Consent Agenda and considered as a separate item. 5. Approve minutes from the meeting on Apri122, 2013. 6. Receive reports and/or minutes from the following boards, commissions, and committees: a. Paris Public Library (3-20-2013) b. Planning and Zoning Commission (3-4-2013 and 4-1-2013) c. Paris Board of Adjustment (1-8-2013) 7. Proclamation recognizing Emergency Medical Services Week. 8. Proclamation declaring the month of May as Building Safety Month. 9. Approve the Final Plat of Lot 1, 2, 3, and 4, Block D, Hilltop Subdivision #2, located in the 400 Block of 25`" Street N.E. 10. Approve the Final Plat of Lot 1, Block A, Robinson Addition CB 79, located in the 200 Block of West Provine Street. 11. Approve the Final Plat of Lot 1 and 1-A, Block C, Morningside North #3, located in the 4300 to 4400 Block of Lamar Avenue. 12. Approve the Final Plat of Lots 1 and 2, Block A, Paris Habitat Addition 112-F, located at 1435 East Washington Street. 13. Approve the Final Plat of Lot 1, Block A, Lakes Regional MHMR Addition CB 78, located at 22 West Cherry Street. 14. Approve the Final Plat of Lot 1, Block A, Potters Industries, LLC Addition 355, located at 1607 19th Street N. W. 15. Approve the Replat Plat of Lot 1-20, Block A, Martin Block Addition, located in the 600 Block of 7t" Street N.W. 16. Approve a mutual aid agreement between the Paris Fire Department and the Hopewell Volunteer Fire Department. 17. Approve an Ordinance changing the speed limit on certain portions of 19th Street S.W. (FM 137) as requested by TxDOT. Regular Agenda 18. Conduct a public hearing, discuss and act on a Resolution nominating JS Baking LLC (Skinner Bakery) as an Enterprise Project. 19. Conduct a public hearing and take action on an Ordinance changing the zoning from Agricultural District (A) to a Commercial District (C) on Lot 3, City Block 345, and Tract 26 of the J. Bourland Survey A#69, located at 2965 South Church Street. 20. Conduct a public hearing and take action on an Ordinance changing the zoning from a Heavy Industrial District (HI) to a Commercial District (C) on Lots 2, 3, 4 and 5, City Block 154, located in the 600 to 1000 Block of West Washington Street. (The applicant has withdrawn this zoning change request) 21. Conduct a public hearing and take action on an Ordinance changing the zoning from a General Retail District (GR) to a Commercial District (C) on Lots 19, 20, 21, 22, 23 and west half of 24, Sperry's lst Addition Block 8, located at 24 N.W. 28t" Street, 2750 and 2780 Bonham Street. (The applicant has withdrawn this zoning change request) 22. Presentation of the 2013 Water and Rate Study. 23. Discuss and act on policies and plans for annexation/disannexation requests. 24. Discuss criteria and guidelines for creation of a residential tax abatement program. 25. Receive and discuss quarterly report from Paris Economic Development Corporation. 26. Convene into Executive Session pursuant to Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about pending or contemplated litigation and/or on matters in which the duty of an attorney to his client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, clearly conflict with this chapter, as follows: Ed Darnell v. Union Pacific Railroad and City of Paris; Cause No. 81476, 6th Judicial District Court, Lamar County, Texas. 27. Reconvene into Open Session and possibly take action on those matters discussed in Executive Session. 28. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. 29. Adjournment.
