3. Consideration of and action on the petition of Mack Ross for a change in
zoning from a One-Family Dwelling District No. 2(SF-2) to a One-Family
Dweiling District No. 3(SF-3), Lot 5, City Block 294, being the 3000 Block of
Aikin Drive.
4. Consideration of and action on the recommendation of the Replat, Lot 3, Block
1, Lane Place Addition, being number 1501 Martin Luther King, Jr. Drive.
Consideration of and action on the recommendation of the Finai Piat, Stone
Ridge Phase III.

JULY 1, 2002
The Planning and Zoning Commission met Monday, July 1, 2002, 5:30 P.M.,
Paris Junior College, Applied Technology Building, Room 1016, 2400
Clarksville Street, Paris, Texas with the following members present:
1. Reeves Iiayter
2. Cleveland Thomas
3. Barbara Forest
4. Eddie Vincent
5. Marshall Kent
6. Curtis Fendley
7. Louis Yates, Jr.
8. Bobby L. Myers
Steve Methven, the building official was also present.
The meeting was called to order by Reeves Hayter.
1. The minutes from the June 3, 2002, regular planning and zoning
meetings were approved with a motion by Curtis Fendley and
seconded by Bobby L. Myers. Motion carried by a vote of 8 ayes and
0 nays.
2. Public Hearing to consider the petition of Donna Swindle for a change
in znning from a Two-Family Dwelling District (2F) to a Neighborhood
Service District (NS), Lot 5, City Block 226-A, being number 664 22"a
Street SE.
The public hearing was declared open.
Donna Swindle, 664 SE 22"d, spoke in favor of the petition stating that
she wants to build a beauty shop there. Ms. Swindle stated that she
would use parking at Thomas Food Mart for overflow. The hours of
operation would be unti19:00 p.m. Ms. Swindle stated that her drive
would accommodate 3 cars.

Melissa Jackson, 654 SE 22"d, spoke in opposition and presented a
petition against the change. She had parking concerns because the
neighborhood is already overcrowded. Ms. Jackson expressed concern
about the location of the building to her residence. Ms. Jackson
opposed the hours of operation stating that this would be a distraction
to the neighborhood. Ms. Jackson was concerned about construction
standards and did not like the fact that if zoning is changed, it would be
permanent.
Patsy Wynn was concerned about parking. Ms. Wynn's husband has
already had a wreck with Mr. Swindle.
Randy Jackson, 654 SE 22°d, ezpressed the same concerns and does not
want the zoning changed.
There was no further opposition, the public hearing was declared
closed.
3. Consideration of and action on the. petition of Donna Swindle for a
change in zoning from a Two-Family Dwelling District (2F) to a
Neighborhood Service District (NS), Lot 5, City Block 226-A, being
number 664 22"d Street SE.
Motion was made to deny the petition by Curtis Fendley and seconded
by Louis Yates, Jr. Motion carried by a vote of 8 ayes and 0 nays.
4. Public Hearing to consider the petition of Earl Posey for a change in
zoning from a One-Family Dwelling District No. 2(SF-2) to a Two-
Family Dwelling District (2F), Lots 2& 3, City Block 300, being the 500
Block 24" NW.
The public hearing was declared open.
Tommy Posey, 815 3311 NE, spoke in favor of the petition stating that he
wants to build a duplex on the property. Mr. Posey stated that

Kimberly Clark, McCuisition Hospital, and TaMolly's were all cow
pastures before they became the successful businesses that they are
today. He presented a document with 87 names that were in favor of
the duplezes. Mr. Posey presented a document from Janice Wortham,
Community Development, Administrative Assistant, stating that she
never said the proposed dupleges would be low income.
Mr. Posey stated that he was born and raised in West Paris and would
not do anything to hurt the area.
Perry Hanley, 2345 W. Cherry, spoke against the petition stating that
Mr. Posey said in the first meeting that he would build more duplezes
if the one was successful. Ms. Hanley spoke with 15 people in the area
who are against the petition and does not want the area to change. Mr.
Hanley said that renters do not clean up their lots and Mr. Posey has
enough land to build a lot of rental property. Drainage problems in the
area were also mentioned.
Bill Dalton, 2460 24`h NW, presented pictures of the lot showing flagging
of future plan to build more lots and duplexes. Mr. Dalton stated that
landowners make better neighbors than renters. Iie stated that he liked
the neighborhood just like it is and does not want the change. Mr.
Dalton asked those who were opposed, at the meeting, to stand up. Five
stood up.
Tommy Posey returned and stated that 87 names were from West Paris.
Mr. Posey presented pictures of neighboring dilapidated structures
until Chairman Hayter stopped the presentation.
There was no further opposition, the public hearing was declared
closed.
5. Consideration of and action on the petition of Earl Posey from a change

the 500 Block 24`n NW.
Motion was made to deny by Curtis Fendley and seconded by Eddie
Vincent. Motion carried by a vote of 6 ayes and 2 nays.
6. Public Hearing to consider the petition of Mack Ross for a change in
zoning from a One-Family Dwelling District No. 2(SF-2) to a One-
Family Dwelling District No. 3(SF-3), Lot 5-A, City Block 294, being
the 3000 Block of Aikin Drive.
The public hearing was declared open.
Mack Ross, 3475 Reno Drive, spoke in favor of the petition and
presented a plat of property showing the lots. He gave a history of
property. Mr. Ross would like to build affordable housing on the
property. He stated that he might do a Primrose type subdivision but
needs One-Family Dwelling District No. 3(SF-3) zoning so he can get
smaller lots. Mr. Ross stated that big lots will not be needed next to the
school and since many people now days do not like to mow big lots, he
is requesting Single Family zoning. ,The houses would be a minimum
of 1200 square feet. Sewer would have to be built to serve the lots.
Wayne Kerby, 360 30`h NE, stated that the north side of Ross's property
abuts his south property line and he has concerns about drainage from
his property to Ross's property.
Mr. Ross stated that the street was designed to handle the water and he
will take care of the drainage.
There was no opposition, the public hearing was declared closed.
7. Consideration of and action on the petition of Mack Ross for a change
in zoning from a One-Family Dwelling District No. 2(SF-2) to a One-

Motion was made to approve by Eddie Vincent and seconded by Bobby
Myers. Motion carried by a vote of 8 ayes and 0 nays.
Motion was made by Bobby Myers to ezcuse Curtis Fendley from
consideration of the negt item, seconded by Louis Yates, Jr. Motion
carried by a vote of 7 ayes and 0 nays.
8. Public Hearing to consider the petition of Leann Sartor for a change in
zoning from a General Retail District (GR) to a General Retail District
(GR) With Specific Use Permit No. (3) Auto Laundry, Lot 21, City
Block 249, being number 2926 Lamar Avenue.
The public hearing was declared open.
There was no one present to speak in favor of the petition.
Fred Eatherly, 2925 Margaret, spoke in opposition to the petition
stating that he did receiye the notification letter and had spoken with
neighbors who did not want the car wash there.
Ms. Eatherly stated that the car wash would be in her back yard and
she does not want it there. Ms. Eatherly stated that the car wash will
create noise and she is upset with the ezisting car wash. Another car
wash would only create more noise. She stated that when she bought
the lot she knew something commercial would go there.
Russell Gifford, 2915 Margaret, stated that the car wash would be
directly behind his house and he does not want the noise that it will
bring.

Motion made to excuse Cleveland Thomas from the meeting by Bobby
Myers and seconded by Marshall Kent. Motion carried by a vote of 6
ayes and 0 nays.
Mr. Daryl Coats, Rt. 1, Detroit, stated that he owns apartments
adjacent to the property and does not allow loud music on his property,
and would not like the increased noise a car wash would create. Mr.
Coats said that if distance barriers were put in, he would consider.
Mary Thompson, 2940 Margaret, stated she had concerns about the
noise, lights, and security at the car wash.
Bonnie Guest, 2935 Margaret, opposed the zoning change.
There was no further opposition, the public hearing was declared
closed.
9. Consideration of and action on the petition of Leann Sartor for a
change in zoning from a General Retail District (GR) to a General
Retail District (GR) With Specifc Use Permit No. (3) Auto Laundry,
Lot 21, City,.Block 249, being number 2926 Lamar Avenue.
Motion was made to deny by Bobby Myers and seconded by Marshall
Kent. Motion carried by a vote of 4 ayes and 2 nays.
Motion was made by Eddie Vincent for Curtis Fendley to return to the
meeting and seconded by Marshall Kent. Motion carried by a vote of
6 ayes and 0 nays.
10. Public I3earing to consider the site plan approval requested by Maxine
Cooper, Lots 8& 9, Block 1, Pine Bluff Addition, being the 1400 Block
E. Price Street.

The public hearing was declared open.
Mazine Cooper,1915 Cope Drive, asked for approval on the site plan
stating that there would be eight (8) efficiency apartments built there.
There was no opposition, the public hearing was declared closed.
11. Consideration of and action on the site plan approval requested by
Maxine Cooper, Lots 8& 9, Block 1, Pine Bluff Addition, being the 1400
Block E. Price Street.
Motion was made to approve by Bobby Myers and seconded by Louis
Yates, Jr. Motion carried by a vote of 7 ayes and 0 nays.
Meeting adjourned at 7:30.
