06-MINUTES FROM VARIOUS BOARDS, COMMISSIONS, ETCParis Public Library Advisory Board Meeting Minutes April 17, 2013 Opening: The regular meeting of the Paris Public Library Advisory Board was called to order at 4:00 pm. Present: Board members present were Hilda Mallory, Alice Woodard, Pat Books, Ann Norment, Fran Neeley, Linda Vandiver, Deborah Hatley, and Director, Priscilla McAnally. Approval of Minutes The minutes of the previous meeting were unanimously approved as presented II. New Business: The Director presented a new policy for consideration, "Charging Electronic Equipment Policy," to prohibit the use the library's electrical outlets for charging personal equipment, including cell phones, electric vehicles, tablets, and laptops. Motion was made by Hilda Mallory, seconded by Ann Norment, and unanimously approved by the Board to adopt the policy, that it be posted in the library and added to official policy. III. Old Business: No old business was presented for discussion IV. Presentations a. Budget Report: No unusual b. Statistical Report: Circulation and visits were down V. Friends of the Library: No report given VI. Director's Remarks: Estimate to replace windows put into the budget for next year. It is anticipated to cost about $9,000 for double-paned windows. Received estimates from Taylor Glass and Reddell Glass. The Director will explore using social media as a marketing tool, trying Twitter to see if it can be used for promoting the library. Training was held for staff regarding used of e-Readers, Kindle, Nook, and iPad devices. Staff will start assisting patrons individually on devices, possibly during the summer. Cherry, City Block 83, Lot 38 Owner: Robert and Amanda Giberson, 1280 CR 32220 Sumner, TX 75486 Present: Robert Giberson — no back taxes owed. -- 14 Mr. Talley stated that the property at 940 W. Cherry has several holes in the roof, pieces are missing, there is missing or deteriorating wood and shingles, several boards are sticking out, the roof line has a truckers tarp laying on it, and there is a collapsed shed on the side of the house. Mr. Giberson stated that he doesn't live at the house but parts of the house are used for storage. The parts with the leaks in the roof cannot be used for storage. He doesn't have the financial means to demolish the house. He stated that he feels the property is not hurting anyone and that the inside is solid and he doesn't see the need to demolish the house. Mr. Giberson also stated that there are hot wires at the property where the electrical company pulled the meter. Mr. Giberson asked what the average cost of a demolition is and Robert Talley stated it is estimated to be $2731.83. There was discussion about continued deterioration of the property if it's not repaired and payment plans if the City demolishes the house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Wendell Moore to table the property until the Apri12013 meeting to give Mr. Giberson time to decide if he wants to repair or to work out a payment plan with the City of Paris for demolition of the property. Robert Talley showed pictures of holes in the roof, deterioration and missing wood and shingles, the structure is leaning, and there is junk and rubbish on the property. Joyce Freeman stated that the house has been leveled and she plans on repairing the structure. She stated that there is a hole in the roof but it's on the porch and she has already put new wiring in the house. Don Wilson informed Mrs. Freeman she will need a building permit to start on repairs. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a$1000 per day civil penalty. This property was in the process of being demolished and then the owner stopped cleaning it up. Motion carried unanimously. 4-0 4. Code Enforcement update. (1) Don Wilson asked about Mrs. Camsters house. Robert Talley stated that the work is being done. (2) Don Wilson asked about Kevin Kears house on 7th and Graham. Robert Talley stated that the house has sold and he is giving the new owner time to get a plan together. (3) Robert Talley went over a spreadsheet and PowerPoint that he prepared for the committee of demolitions and cost. An average demolition's cost at this time is $2731.83. (4) Don Wilson asked at what point does the City take over a property if the owner doesn't or stops paying for his demolition. Robert Talley explained that even though the property owner signs an agreement to pay for the demolition code enforcement still files a lien against the property. (5) Updates on the property at Fitzhugh that Mike Malone owned was talked about, and that it has been sold to someone else. A work order has been given to demolition crew so when they are back in East Paris the property at 424 Fitzhugh will be demolished unless the owner does it first. (6) Update on Cherry St. Manor — Jamie Jetton has purchased it and the front � - 1'7 part of the building is being demolished and the back they are going to try to repair. (7) 260 South Main update — This has been given to District Court, Will Baird. We have not received an updates at this time. (8) Kent McIlyar, Robert Talley, Joey Sleeper and John Godwin, met concerning the receivership of property. Robert Talley gave the BSC members some paper work to look at and they will discuss it at the next meeting. (9) Don Wilson asked Kent McIlyar to explain to the committee the outcome of the talk in the past about when a structure has been issued a demolition order and the owner comes in and wants to repair the structure and wants a building permit we should handle this. Kent said the owner can appeal the decision to a District Court or ask for a re-hearing. They can NOT get a building permit. Repair order property can be sold but the orders stay with the property. (10) Don Wilson explained that he had a meeting with City Board Members and the mayor around a month ago about property like the one on 3`d NW where there is a hole in the roof but the people are living in the house. He suggested looking into an ordinance if the property is a rent house we should tag the house and when the renter that lives in the house moves out the property cannot be rented until the violation is fixed and the structure is secure and safe. These are unsafe living conditions and we should put an order on the water or electric account that if one person moves they cannot get services until the structure is secure. (11) Wendell Moore has concerns about Mr. Giberson's statement that there are hot wires on his property left by the electrical company. Robert Talley is going to inspect this property. 5. Mr. Talley stated that this property came before BSC a couple of months ago. The house has deterioration along the bottom part of the house near the foundation and is unsecure. The north side of the house is in pretty good shape. One side of the porch has a brace that is collapsing. The original order was for the house to be demolished within 30 days. Mr. Williams stated that he is selling the house to Robert Walker through owner fnancing. Mr. Walker explained how he has secured the windows and doors. The part of the porch that was falling has been replaced with 4x4's to brace it and the house has been painted. Mr. Wilson informed Mr. Walker that any plumbing and/or electrical work that was done on the house needed a permit. Mr. Walker stated that Mr. Talley told him to wait on permits until the results of the BSC meeting and that if they would give him a 90 grace period he would get the permits required and continue to work on the house. Robert Talley's recommendation: 90 days to repair, if not the property will be brought back to the Buildings and Standards Commission. Robert Talley showed pictures of deterioration of the front and sides of the house. Inside the house some of the subflooring has been removed and there is some rot. Some of the underpinning is coming off and the garage is unsecure Mr. Lecornec stated that he bought this property as an investment. He paid a contractor to repair the house. The contractor is the one who removed the flooring. Mr. Lecornec stated that after paying the contractor he walked off the job without completing the work. He has contracted other carpenters to get bids � on repairing the property. If it doesn't make economic sense to repair the house the will contact Mr. Talley and he will have the house demolished. He asked for 90 days to repair the house. Mr. Wilson questioned the stability of the roof and Mr. Lecornec stated that it was in pretty good shape for a house that old. Robert Talley's recommendation: 90 days to repair, if not the property will be brought back to the Buildings and Standards Commission. The carport is collapsing and the house is unsecure. There is also junk and rubbish throughout the property as well as high grass and weeds. Mr. Frierson stated that this was his mother's house and he would like to fix it up but he needs some time. It needs a new roof and he has spoken to some contractors and is getting a carpenter's estimate. Mr. Wilson stated that the property looked like it needs a substantial amount of work and asked Mr. Frierson if he was committed to the time and money it was going to take. Mrs. Ballard asked what sort of time frame was Mr. Frierson looking at. Mr. Frierson stated that he and Mr. Talley discussed 90 days. Motion was made by Johnny Norris, seconded by Vicky Ballard to give Mr. Frierson 90 days to repair the property. Mr. Talley stated that he would like the give Mr. Frierson 2 weeks to secure the property. Mr. Wilson also stated that the property needed to be cleaned up of all junk and rubbish and it needed to be mowed. There are no back taxes. Robert Talley showed pictures where a large tree fell on the corner of the house. This property went before HPC and they ask that the property be repaired not demolished. Mr. Waite stated that Family Haven is a defunct organization. He is a former board member. There are immediate plans to dissolve the 501(3) (C) status and try to turn the property over to another non-profit organization. Mr. Waite stated there was some money left in a Family Haven account and that it was probably enough to have the tree removed and make minimum repairs. Mr. Wilson asked if there was any insurance on this property and Mr. Waite indicated there was not. Mrs. Ballard asked if they knew what non-profit they wanted to give the property too and Mr. Waite said that he has spoken with Sybil Colson, another former board member and they were going to try and figure it out. Mr. Talley stated that HPC does not want to put a hold on this structure just wants to give 90 days to repair it. The committee questioned why there were back taxes owed on a property that a non-profit owned. Mr. Talley was not sure that is what the Appraisal District had on file. Taxes did not start to accumulate until after 2010, that maybe that is around the time Family Haven dissolved. Mr. Talley showed pictures of extensive fire damage to the home. It is believed that the tree that fell on 625 W Washington hit a power line that caused an electrical fire at this address sometime during the 3`d week of March. Mr. Waite stated that there is an odd deed restriction on this property. It states that if Family Haven Crisis was to dissolve the property would revert back to a Mr. McIntosh in Denton. Mrs. Ballard asked if Mr. McIntosh was aware of the fire. Mr. Waite stated that he didn't think Mr. McIntosh knew about the fire. Mr. Waite only found out about the deed restriction recently. 22 Mr. Talley was asked about how much it would cost to have this house demolished. Mr. Talley stated it could be anywhere from $1200 to $3000, that the city was charged by the ton and it would be hard for him to give an accurate dollar figure not knowing how many tons it would be. Mr. Talley showed pictures where there is fire damage along the peak of the roof, there are broken windows and extensive fire damage to the inside of the house. Mr. Talley spoke with Skylar Burchinal who is doing property maintenance and asked for an extension. He agrees that it needs to be demolished but because of all of the work they are doing at the old Cherry Street Manor they are extremely busy. Mr. Talley showed pictures where the house is unsecure. There are holes in the roof that were put there by the Paris Fire Department for training purposes when it was a city property. Mr. Talley showed pictures of the property where it is unsecure, has missing ceiling tiles, lots of junk and rubbish throughout the house and yard. Mr. Talley stated that there is no water or electric at the house. The neighbors have complained about children going in the house and are worried about their safety. Sue Lancaster asked to speak and stated that this house was built from the remains of the old courthouse. The commission asked Mr. Talley if HPC knew of this and Mr. Talley stated that they did but had no plans to get involved. Due to the safety issue Mr. Talley did not feel it should be tabled. Mr. Wilson would like to go after the property owner for back taxes and if they don't pay put this property up for auction at the tax sale. He also stated that if the city could secure it there would be the possibility of saving the rock from the old courthouse. No one on the commission wanted to see this end up in the landfill. Mr. Talley gave him the names of two people to contact for estimates. Mr. Talley showed pictures where there is missing siding, roof damage, deteriorated siding and a hole in the roof. The garage is full of junk and rubbish and the house is being used for storage at this time. She stated that Christians in Action had permission to go in and take anything worth having. Mr. Ta11ey showed pictures where the add-on at the side of the house has collapsed, the house is unsecure and there is deterioration along the eaves of the house. Mr. Talley stated that this is the parsonage of the church next door. The people who purchased the church tried to purchase this building as well but the owner was asking too much for it. Mr. Talley showed pictures of the house being �� unsecure, there is water damage as well as deterioration of the siding and foundation. There have been numerous complaints of people going in and out of this structure and the Police Department has received numerous complaints as well. Mr. Talley also stated that the owners of the church are worried that people will sta.rt trying to come into the church as well. Mrs. Lancaster stated that it was not. She has been underneath and could see rotten wood as well as termite damage. Motion carried unanimously. 5-0 4. Code Enforcement update. (A) 350 NW 4'" came before BSC a couple of months ago. Tree fell, causing the entire front porch to collapse, there are holes in the roof. It had orders to be demolished within 30 days. Since that time Mrs. Verdie Williams who is listed as one of the owners of the home contacted Mr. Talley. She now lives in Texarkana, Arkansas. She stated that a neighbor called her to tell her the house had been tagged for demolition. She was upset that she wasn't informed of this. She states she received the house in her divorce. Mr. Talley asked if she ever contacted the Appraisal District to change her mailing address and she said she had not. She states she is the sole owner and had plans to repair the house and move back in it. There is $10,069.44 in back taxes owed. Mr. Norris wanted to know if she was aware of the back taxes. Mr. Talley was not sure if she did. Mr. Wilson asked that this be put on hold and Mrs. Williams be contacted and told she has 30 days to prove that she is the sole owner of the house.
