ZONING COMMISSION
OCTOBER 7, 2002
The Planning and Zoning Commissioo met Monday, October 7, 2002, 5:30
p.M., Paris Junior College, Applied Technology BUilding, Room 1016, 2400
Clarksville Street, Paris, Texas svith the following members present:
1. Reeves Hayter
2. Cleveland L. Thomas

4. Curtis Fendley
5. Marshall Kent
6. Louis Yates, Jr.
7. Bobby L. Myers
Steve Methven, the building official was also present.
The meeting was called to order by Reeves Hayter.

The September 3, meeting was canceled due to lack of a quorum,
minutes from the August 5, 2002, regular planning and zoning
meetings were approved with a motion by Curtis Fendley and seconded
by Bobby Myers. Motion carried by a vote of 7 ayes and 0 nays.
Public Hearing to consider the petition of Monte Moore for a change in
zoning from an Agricultural District (A) to a Commercial District (C),
Lot 8, City Block 318, being the 3300 Block of Ce~'ter Street.
The public hearing was declared open.
Monte Moore, 250 Sugarhill Road, spoke in favor of the petition stating
that he needed this property rezoned to tie in to his already existing
property for access to Center Street. Mr. Moore passed out maps of his
proposed project stating that it would be a 5 year project. He has no
immediate plan for this property but would soon be constructing a
street towards this property. Mr. Moore said this would be good
commercial property. Drainage issues were discussed. Mr. Moore
stated that he would build a detention pond if necessary.

Ms. Patsy Guest, 1815 34th Street NE, presented a picture of the
drainage problem at Center Street. Ms. Guest thought this would only
add to the problem. Ms. Guest stated that she does not want to see
Commercial zoning but would not mind Single Family (residential)
zoning. Ms. Guest stated that with Commercial zoning comes more
concrete which adds to the drainage problem. Ms. Guest stated that if
you have Commercial, you get automotive type businesses instead of a
shopping center. Ms. Guest thought that there should be a buffer there
from her property.
There was no further opposition, the public hearing was declared
closed. ~
Consideration of and action on the petition of Mdnte Moore for a
change in zoning from an Agricultural District (A) to a Commercial
District (C), Lot 8, City Block 318, being the 3300 Block of Center
Street.
Motion was made to deny by Curtis Fendley and seconded by Bobby L.
Myers. Motion carried by a vote of 5 ayes and 2 nays.
Public Hearing to consider the petition of David McLaughlin for a
change in zoning from a One-Family Dwelling No. 2 District (SF-2) to
a Neighborhood Service District (NS), Lots 45, 47, and 49 and part of
Lot 43, Block 2, Lamar Terrace Addition, being number 206 SE 24th''
Street.
The public hearing was declared open.
David McLaughlin, spoke in favor of the petition stating that he wants
to build something compatible with the neighborhood. Mr. McLaughlin
stated that what he wants to build would have a living area upstairs and
a garage and small shop for his wife's alteration business downstairs.
There would be no need for much parking. Mr. McLaughlin presented
a picture of what he would like to build. _ _

Joe Iglehart asked if this zoning would allow for a duplex if the
alteration shop failed.
There was no opposition, the public hearing was declared closed.

Motion was made to approve by Louis Yates and seconded by Marshall
Kent. Motion carried by a vote of 6 ayes and 1 nay. ~
Public Hearing to consider the petition of Donna Swindle for a change
in zoning from a Two-Family Dwelling District (2F) to a Neighborhood
Service District (NS), Lot 5, City Block 226-A, being number 664 SE
22"d Street.
The public hearing was declared open.
Ms. Donna Swindle, spoke in favor of the petition stating that she wants
to place a beauty shop at her residence. The shop would have one chair.
Ms. Swindle presented pictures of other neighborhoods where this type
of business existed, stating that she wants to be treated like everybody
else. Several letters were presented from people in favor of the shop.
Ms. Swindle stated that she would work by appointments only and the
operating hours would not be late hours. Ms. Swindle stated that she
would build a fence or whatever she may have to or be required to do.
Shirley Swindle spoke in favor of the petition stating that she wants to
see her daughter be able to stay home and raise her grandchildren...
Patsy Winn spoke in opposition of the petition stating that she does not
want the lot to be rezoned because there is alr_eady too much

Commercial zoning encroaching the neighborhood. Ms. Winn stated
that she is just now getting he~ house paid for and does not want
Commercial zoning. Ms. Winn stated that the neighbors do not want
Commercial zoning but are afraid to speak out.
Melissa Giberson opposes the zoning stating that she and her husband
are just starting a new family and fears that Commercial zoning would
increase traffic.
There was no further opposition, the public hearing was declared
closed.
Consideration of and action on the petition of Donn, a Swindle for a
change in zoning from a Two-Family Dwelling District (2F) to a
Neighborhood Service District (NS), Lot 5, City Block 226-A, being
number 664 SE 22ad Street.
Motion was made to deny by Curtis Fendley and seconded by Reeves
Hayter. Motion failed by a vote of 3 ayes and 4 nays. Motion was made
to approve by Cleveland Thomas and seconded by Barbara Forrest.
Motion carried by a vote of 4 ayes and 3 nays. ~'
Public Hearing to consider the abandonment of a street known as 3rd
Street SE in the Texas & Pacific Addition beginning at the north
boundary line of Paris Boulevard going North to Sycamore Street.
The public hearing was declared open.
There was no one present to speak in opposition to the petition, the
public hearing was declared closed.
Consideration of and action on the petition to consider the
abandonment of a street known as 3rd Street SE in the Texas & Pacific
Addition beginning at the north boundary line of Paris Boulevard going

Motion was made to approve by Curtis F.endley and seconded by Bobby
Myers. Motion carried by a vote of 7 ayes and 0 nays.
Public Hearing to consider the abandonment of a street known as
County Road 42602 and also known as Simmons Drive in the Suburban
Estates and Noles Drive beginning at the west boundary of
Mockingbird Lane going West approximately 150 feet to the end of said
Simmons Drive.

public hearing was declared closed.
Consideration of and action on the petition to consider the
abandonment of a street known as County Road 42602 and also known
as Simmons Drive in the Suburban Estates and Noles Drive beginning
at the west boundary of Mockingbird Lane going West approximately
150 feet to the end of said Simmons Drive.
Motion was made to approve to close Simmons Drive by Bobby L.
Myers and seconded by Louis Yates. Motion carried by a vote of 7 ayes
and 0 nays.
Motion was made by Curtis Fendley and seconded by Cleveland
Thomas to excuse Reeves Hayter from consideration of the next 2 items.
Motion carried by a vote of 6 ayes and 0 nays.

Motion carried by a vote of 6 ayes and 0 nays.
Consideration of and action on the Replat, Lots 7 and 8, Block B,
Primrose II.
Motion was made to approve by Barbara Forrest and seconded by
Curtis Fendley, subject to the City Engineer's memo, dated September
26, 2002. Motion carried by a vote of 6 ayes and 0 nays.
Motion was made for Reeves Hayter to return to.the meeting by
Barbara Forrest and seconded by Louis Yates. Motion carried by a
vote of 6 ayes and 0 nays.
Consideration of and action on the Preliminary Plat, Lots 1 thru 7,
Parr-Hull Medical Plaza, being the 3300 Block of N. Main.
Motion was made to approve with a temporary cul-de-sac on all dead
ends and confirm appropriate disposition on water as it leaves the site.
Approval subject to the City Engineer's memo, dated October 3, 2002.
Motion carried by a vote of 7 ayes and 0 nays.
Consideration of and action on the Final Plat, Lots 14A thru 14F, City
Block 259, being the 2900 Block of Pine Mill Road.
Motion was made to approve by Bobby Myers and seconded by Louis
Yates, subject to the City Engineer's memo, dated October 1, 2002.
Motion carried by a vote of 7 ayes and 0 nays.
