02 City Council (12/05/02)MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF PARIS December 5, 2002 The City Council of the City of Paris met in regular session, Thursday, December 5, 2002, at 6:00 P. M., Paris Junior College, Applied Technology Building, Room 1016, 2400 Clarksville Street, Paris, Texas. Mayor Michael J. Pfiester called the meeting to order with the following Council Members present: John F. Bell, Richard Manning, Joe E. McCarthy, Francine Neeley, Willie Weekly, Sr., and Benny Plata Also present were City Manager Michael E. Malone, City Attorney Larry W. Schenk, and City Clerk Mattie Cunningham. Invocation was given by Councilman Willie Weekly, Sr. City Manager Malone presented the minutes of the Planning and Zoning Commission's meeting of December 2, 2002, and they are attached hereto as Exhibit A to these minutes. Mayor Pfiester declared the public hearing open on the petition of Mack Ross for a change in zoning from a One-Family Dwelling District No. 2 (SF-2) to a One-Family Dwelling District No. 3 (SF-3) on Lot 3, City Block 294, being located in the 200 Block of 30th Street N. E. Mayor Pfiester called for proponents to appear, and Mack Ross, 3425 Reno Drive, came forward speaking in behalf of his petition. Mr. Ross said this property is just south of the River Oak Development on Aikin Drive that he brought before Council in August, 2002, and he is asking for the same zoning for medium size brick homes on small lots. Mr. Ross explained that the minimum lot is 60' x 120', which is close to the Single Family District No. 2 size of 7500 square feet. Mr. Ross asked for consideration from the City Council regarding his petition. No one else appeared, and the public hearing was declared closed. ORDINANCE NO. 2002-059 Regular City Council Meeting December 5, 2002 Page 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A ONE-FAMILY DWELLING DISTRICT NO. 3 (SF-3) ON LOT 3, CITY BLOCK 294, ON PROPERTY BELONGING TO MACK ROSS, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A ONE-FAMILY DWELLING DISTRICT NO. 2 (SF-2); DESIGNATING THE BOUNDARIES OF THE ONE-FAMILY DWELLING DISTRICT NO. 3 (SF-3) SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EFFECTIVE DATED, WAS PRESENTED. A motion was made by Councilman McCarthy, seconded by Councilwoman Neeley, for adoption of the ordinance. The motion carried 7 ayes, 0 nays. Mayor Pfiester called for consideration of and action on an ordinance approving the Site Plan on part of Lot 2, City Block 308, Tract 2, being located in the 1400 Block of W. Washington Street. Joe Chamy, 742 East Pipe Line Road, was present in support of the Site Plan and requested approval of the ordinance as recommended by the Planning and Zoning Commission. ORDINANCE NO. 2002-060 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING THE SITE PLAN FOR A PLANNED DEVELOPMENT DISTRICT-HOUSING DEVELOPMENT (PD-b), PREVIOUSLY ESTABLISHED BY THE ADOPTION OF ZONING ORDINANCE NO. 2002-005, FOR PART OF LOT 2, CITY BLOCK 308, TRACT 2; MAKING OTHER FINDINGS AND PROVISIONS RELATED Regular City Council Meeting December 5, 2002 Page 3 TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE, WAS PRESENTED. A motion was made by Councilman McCarthy, seconded by Mayor Pro Tem Manning, for adoption of the ordinance. The motion carried 7 ayes, 0 nays. Mayor Pfiester announced that the next item on the agenda was receipt, consideration, and discussion of and possible action on goals and objectives of the City Council of the City of Paris for FY 2002-2003. Mayor Pfiester requested that this item be deferred to a later date and asked that it be tabled. A motion was made by Councilman McCarthy, seconded by Councilman Weekly, to table action on the above item. The motion carried 7 ayes, 0 nays. City Attorney Schenk presented the following petition for rezoning: Ralph Rooks, Lot 1, City Block 307-3, 3700 Block of North Main. Mayor Pfiester referred the petition to the Planning and Zoning Commission for their study and recommendation at their meeting scheduled for January 6, 2003, and before the City Council January 8, 2003. There being no further business, a motion was made by Councilman McCarthy, seconded by Councilman Bell, to adjourn the meeting. The motion carried 7 ayes, 0 nays. ATTEST: MICHAEL J.
