2013-045 Approving a portion of the proposed Lake Crook Planned Development District (LCPDD), all of which property is commonly known as Lake CrookORDINANCE NO. 2013 -045 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE 337.7 ACRES OF LAND, KNOWN AS PROPOSED ZONE 1, THE RESORT AREA, WITHIN THE PROPOSED LAKE CROOK PLANNED DEVELOPMENT DISTRICT (LCPDD), FROM AGRICULTURAL DISTRICT (A) TO LAKE CROOK PLANNED DEVELOPMENT DISTRICT, ZONE 1, THE RESORT AREA. SAID LAKE CROOK PLANNED DEVELOPMENT DISTRICT IS COMPRISED OF 3,000± ACRES OF LAND, IN ADDITION TO 1000± ACRES OF LAKE AREA; LOCATED AT THE EXTREME NORTHWEST QUADRANT OF THE CITY OF PARIS, LAMAR COUNTY, TEXAS, DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Paris City Council desires to establish mixed -land uses represented by single- family, multi - family, commercial, resort, and recreational uses within an area known as the Lake Crook Planned Development District (LCPDD); and, WHEREAS, the Paris City Council has approved a proposed conceptual plan providing for fourteen (14) subzones within said LCPDD, comprising a total of approximately 3,000± acres of land area and also approximately 1,000± acres of water, known as Lake Crook; and, WHEREAS, the Paris City Council recognizes that the scope of establishing the LCPDD shall extend over a number of months; and, WHEREAS, the Paris City Council has directed city staff to prepare planning and zoning opportunities and requirements first regarding Zone 1: The Resort Area, within the LCPDD; and, WHEREAS, the Paris Planning and Zoning Commission has held a number of discussion sessions regarding said Zone 1, the Resort Area; and, WHEREAS, on December 3, 2013, the city staff presented and discussed said Zone 1 to the Planning and Zoning Commission, and said commission opened the floor for discussion and comment on the proposed Zone 1; and, WHEREAS, no one spoke either in support of or in opposition to Zone 1; and, WHEREAS, on December 3, 2013, following notice and publication as required by law, the Planning and Zoning Commission conducted a public hearing on the proposed amendment to the City zoning ordinance and, following said hearing, made formal recommendation to the City Council to approve the requested zoning; and, WHEREAS, on December 16, 2013, the city staff presented said Zone 1 to the City Council and opened the floor for discussion and comment on the proposed Zone 1; and, WHEREAS, the Paris City Council finds that Zone 1 of the Lake Crook Planned Development District, a copy of which is attached hereto as Exhibit "A" is in the best interest of the City of Paris and its citizens and should be adopted; WHEREAS, on December 16, 2013, following notice and publication as required by law, the City Council of the City of Paris conducted a public hearing on the proposed amendment to the City zoning ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the Comprehensive Future Land Use Plan of the City of Paris, consistent with the City zoning ordinance, and in the best interests of the public health, safety, and welfare of the citizens of the City of Paris by a vote of 7 ayes and 0 nays. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Official Zoning Map of the City of Paris, Texas and Zoning Ordinance No. 1710 of the City of Paris, as heretofore amended, is hereby further amended to rezone 337.7 acres of land, known as proposed Zone 1, the Resort Area, within the Proposed Lake Crook Planned Development District (LCPDD), from Agricultural District (A) to Lake Crook Planned Development District, Zone 1, the Resort Area, said Lake Crook Planned Development District is comprised of 3,000+ acres of land, in addition to 1000+ acres of lake area; located at the extreme northwest quadrant of the City of Paris, Lamar County, Texas. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes set forth in this ordinance. Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section S. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1 -6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above - enumerated sections shall constitute and be deemed a separate offense.
