02 P&Z Report MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OCTOBER 6, 2003 The Planning and Zoning Commission met Monday, October 6, 2003, 5:30 P.M., Paris Junior College, Bobby R. Walters Applied Technology Building, Room 1206, 2400 Clarksville Street, Paris, Texas with the following members present: 1. Reeves Hayter 5 Louis Yates 2. Carl Lucas 6. Barbara Forrest 3. Brad Archer 7. Cleveland Thomas 4. Russell McCain Steve Methven, the building official was also present. The meeting was called to order by Reeves Hayter. 1. The minutes from the September 2, 2003, regular planning and zoning meeting were approved with a motion by Carl Lucas and seconded by Cleveland Thomas. Motion carried by a vote of 7 ayes and 0 nays. 2. Public Hearing to consider the petition of the Paris Historic Preservation Committee for a change in zoning from a Light Industrial District (LI) to a Historical Overlay District (HD), Paris Santa Fe-Frisco Depot, being number 1125 Bonham Street. The public hearing was declared open. City of Paris' Building Official, Steve Methven, spoke in favor of the petition stating that it would be a stand alone zoning district for the Depot building as approved by the Paris Historic Preservation Commission to protect the historical value of the property. Consideration of and action on the petition of the Paris Historic Preservation Committee for a change in zoning from a Light Industrial District (LI) to a Historical Overlay District (HD), Paris Santa Fe-Frisco Depot, being number 1125 Bonham Street. Motion was made to approve the petition by Carl Lucas and seconded by Brad Archer. Motion carried by a vote of 7 ayes and 0 nays. 4. Consideration of and action on the Preliminary Plat, Parr-Hull Medical Plaza, being the 3300 Block of North Main. Motion was made to deny the petition, by Carl Lucas and seconded by Reeves Hayter, until adequate sewer is provided on Lots 1, 2, 3 and 4. Motion carried with a vote of 7 ayes and 0 nays. 5. Consideration of and action on the Preliminary Plat and Master Plat of the Paris Retirement Village, Lot 2, City Block 308, being the 1400 Block of W. Washington Street. Joe Chamey, 742 Pipeline, Hurst, Texas, Owner/Developer of Paris Retirement Center asked for a waiver of curb and gutter based on drainage issue. Curb and gutter normally drains the project and Mr. Chamy thinks that the drainage is adequate because there is a ditch to the west of the property that should handle the drainage from the apartments. Mr. Chamy stated that he would take care of the right-of- way with hydro mulching and plants if curb and gutter requirement is waived. Ed Vaughn, architect for Mr. Chamy, presented a sketch of the proposed landscaping of the project. Mr. Vaughn stated that the plarmmg and Zoning Meeting October 7, 2003 Page 3 drainage is sufficient and he saw no need for curb and gutter which would require additional dirt work. Motion was made, to approve the plat, by Russell McCain, seconded by Carl Lucas, subject to the City Engineer's Memo, dated October 3, 2003, and a 20' x 20' triangle dedication of right-of-way easement in the NE corner and deny the variance for curb and gutter. Motion carried by a vote of 6 ayes and 1 nay. Brad Archer was excused from consideration of the next item. Motion was made to excuse Brad by Louis Yates, seconded by Russell McCain. Motion carried by a vote of 6 ayes and 0 nays. 6. Consideration of and action on the Preliminary Plat, Lot 3-B, Townwood Estates #3, (Quintana Honda Dealership), being the 1500 Block of NE Loop 286. Motion was made to approve the plat by Carl Lucas, seconded by Louis Yates, subject to the City Engineer's Memo, dated October 6, 2003. Motion carried by a vote of 6 ayes and 0 nays. Motion was made by Carl Lucas, seconded by Cleveland Thomas, for Brad Archer to return to the meeting. Motion carried by a vote of 6 ayes and 0 nays. It appears that the plat complies with the City of Paris subdivision regulations with the following exceptions and/or additions. 1. The engineer or surveyors name is needed on the preliminary plat. 2. Show the building lines per the requested zoning. 3. A 5-foot utility easement is required along the West boundary line of the proposed Beal St. on Lot 1. 4. Add a note on both plats that the developer shall install all sewer and water services. 5. No build'rog permits will be issued on lots 2, 3 or 4 until a plan for gravity sewer has been approved by the City of Paris and construction has begun. Lot 1 will use the existing pr/vate force main that was installed with Murray's Mis~Q. The partnership owns the Murray's Mis-Q and force main. City Engineer DATE: October 3, 2003 SUBJECT: Preliminary Plat of Paris Retirement Village I have reviewed the preliminary plat of the above referenced addition. It appears that the plat complies with the City of Paris subdivision regulations with the following exceptions and/or additions. 1. Submit a more detailed site drainage plan for review and approval. 2. Change the preliminary plat to show lots and block. 3. Provide a 15-foot utility easement for the fire hydrant and water line from 13th St. S.W. into the property and a 15-foot off-site easement for the sewer on the North side of Washington Street by separate instrument. 4. Provide a 10-foot utility easement on the North side between the two 15'foot utility easements for an existing Cox Communications underground line. 5. Revise the zoning to show the West lot having SF-3 zoning and the East lot to have PD-b zoning. 6.Provide a map inset on the preliminary plat to show the current lot configuration. 7. Right-of-Way (ROW) dedication may be required on 15th Street S.W., provide dimensions for the ROW width and distance from the center of the road to the property line. 8. The developer has requested that the curb and gutter requirement be waived on all adjacent streets (see attached letter). Approximately 300-feet of Washington Street that is East of 13th Street S.W. drains West to the intersection to a culvert under 13th Street. Part of Washington St. would require curb and gutter or changing the grade on the ditch and putting in a valley gutter on 13th Street at Washington Street. The Code of Ordinances states in the Subdivision Regulations under Section VIII. Design of Improvements A. Curb and gutter shah be constructed monolithic with the concrete pavement in accordance with section 29- 57 of the City of Paris Code of Ordinances. It shall be constructed along both sides of all streets and avenues within the subdivision and alon~ the subdivision's side of all boundary streets. The cost of this work will not be subject to any participating aid by the City. I recommend approval of the preliminary plat upon completion of the above items. cc: Michael E. It appears that the plat complies with the City of Paris subdivision regulations with the following exceptions and/or additions. 1. Show the existing Right-of-Way (ROW) widths for all adjacent streets with a distance from the centerline of the road to the ROW line. ROW dedication will be required (if necessary) when this property is platted. 2. Change the master plat to show lots and block. 3. Show existing utilities around the entire master plat and any proposed utilities for the master plat. 4. Show the existing zoning and land use. The West lot zoning is SF-3 and the East lot zoning is PD-b. 5. Provide a map inset to show the current lot configuration. It appears that the preliminary plat complies with the City of Paris subdivision regulations with the following exception. 1. Provide the address for the property owner. 2. Revise the plat name to Townwood Estates No. 3, Lot 4. 3. Show the Loop Right-of-Way (ROW) width and show Levi Lane. 4. Provide the offsite easements for the water line to Levi Lane and show the proposed water line. 5. Show the centerline of the creek. 6. Provide an inset on the plat to show the current lot configuration. 7. An easement will be required for an onsite fire hydrant and water line. The exact location has not been determined at this time. 8. Add the P&Z Commission signature block in place of the City Engineer signature block.
