RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, APPROVING AND AUTHORIZING A GRANT
APPLICATION TO THE OFFICE OF THE GOVERNOR, CRIMINAL
JUSTICE DIVISION, TEXAS NARCOTICS CONTROL PROGRAM, FOR A
REGIONAL CONTROLLED SUBSTANCE APPREHENSION PROGRAM
GRANT IN THE AMOUNT OF $739,722.00, WITH THE CITY OF PARIS
PROVIDING $24,414.00 IN MATCHING FUNDS; AUTHORIZING THE
EXECUTION OF AN INTERAGENCY AGREEMENT; MAKING OTHER
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council finds it to be in the best interests of the citizens of the city of
Paris, Texas, that the Red River Valley Drug Task Force be operated for the year beginning June 1,
2004, and ending May 31, 2005; and,
WHEREAS, the City Council of the City of Paris has considered the proposed application
for State and Federal Assistance for said project, in the amount of $739,722.00, to be submitted to
the Office of the Governor, Criminal Justice Division, Texas Narcotics Control Program; and,
WHEREAS, the City Council of the City of Paris has agreed to provide matching monies for
the said project in the amount of $24,414.00; and,
WHEREAS, the City Council of the City of Paris has agreed that, in the event of loss or
misuse of the Criminal Justice Division funds, the City Council of the City of Paris assures that the
funds will be returned to the Criminal Justice Division in full; and,
WHEREAS, the City Council desires to authorize the Mayor, City Manager, and appropriate
City staff to accept and implement said grant (if same is received) without further action of City
Council; and,
WHEREAS, in conjunction with said grant application, it is deemed appropriate that the City
of Paris and the Counties ofLamar, Fannin, Hopkins, Delta, and Franklin and the Cities of Bonham
and Sulphur Springs enter into an Interagency Agreement agreeing to be bound by the requirements
of said grant; and,
WHEREAS, the form of the Interagency Agreement, attached hereto as Exhibit A, should,
in all things, be approved, and the City Manager should be authorized to execute the same; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That submission of a grant application for the Regional Controlled Substance
Apprehension Program to the Office of the Governor, Criminal Justice Division, be, and the same is
hereby, approved for the project entitled "Red River Valley Drug Task Force" for the period
beginning June 1, 2004, and ending May 31, 2005, in the total amount of $1,051,156.00, same being
70% federal funds totaling $739,722.00 and 30% local matching funds totaling $311,434.00, said
local matching funds being divided by nine entities, with the City of Paris's share of such matching
funds being $24,414.00.
Section 3. That the City Manager be, and he is hereby, appointed as the Authorized Official
of said project and is authorized and directed to execute, on behalf of the City of Paris, the application
for grant under the terms and conditions and in the form approved by the City Attorney.
Section 4. That the Chief of Police be, and he is hereby, appointed as Project Director and
is hereby authorized to execute and deliver, on behalf of the City of Paris, all reports,
communications, assurances, and documents necessary for the completion of said project.
Section 5. That the Director of Finance be, and he is hereby, authorized and directed to serve
as the Financial Officer for said project and to receive and distribute funds for purposes of the Red
River Valley Drug Task Force.
Section 6. That the City Manager, the Chief of Police, and any other appropriate City
officials are hereby authorized to execute any and all necessary documents incident to the grant
application approved herein and to apply for, accept, reject, alter, or terminate the grant.
Section 7. That the Mayor, City Manager, Chief of Police, and the Finance Director be
authorized and directed to execute, on behalf of the City of Paris, any and all documents necessary
for acceptance and implementation of said grant upon notice of award thereof by the Office of the
Governor, Criminal Justice Division, under the terms and conditions and in the forms approved by
the City Attorney, and to proceed with use of said funds upon receipt thereof for the purposes stated
herein and in accordance with the grant conditions.
Section 8. That the form of the Interagency Agreement between the City of Paris and the
Counties of Lamar, Fannin, Hopkins, Delta, and Franklin and the Cities of Bonham and Sulphur
Springs wherein the agencies agree to be bound by the requirements of said grant, attached hereto
as Exhibit A, be, and the same is hereby, approved.
Section 9. That the City Manager be, and he is hereby, authorized and directed to execute,
on behalf of the City of Paris, the Interagency Agreement, under the terms and conditions and in the
form shown in Exhibit A, attached hereto.
Section 10. That this resolution shall be effective from and after its date of passage.

INTERAGENCY AGREEMENT

COUNTY OF LAMAR' §
This Agreement is entered into by and between the COUNTY OF LAMAR, COUNTY OF
FANN1N, COUNTY OF HOPKINS, COUNTY OF DELTA, and COUNTY OF FRANKLIN,
political subdivisions of the State of Texas, hereinafter referred to as "the Counties," the CITY OF
PARIS, PARIS, TEXAS, a municipal corporation situated in Lamar County, Texas, the CITY OF
BONHAM, TEXAS, a municipal corporation situated in Fannin County, Texas, and the CITY OF
SULPHUR SPRINGS, a municipal corporation situated in Hopkins County, Texas, hereinafter
referred to as "the Cities," pursuant to Chapter 791 of the Texas Government Code, concerning
interlocal cooperation contracts.
WITNESSETH:
WHEREAS, the Counties and the Cities wish to file a joint grant application with the
Criminal Justice Division of the State of Texas, for total funding (including matching funds) in the
amount of $1,051,156.00 for the period to commence June 1, 2004, and to continue twelve (12)
months as the Red River Valley Drug Task Force; and,
WHEREAS, each entity has agreed to contribute matching funds as set out herein if said joint
application is approved; and,
WHEREAS, the source of funds would not normally be used for this purpose; and,
WHEREAS, the Counties and the Cities believe it to be in their best interests to join in the
application to develop a Red River Valley Drug Task Force; and,
WHEREAS, the Counties and the Cities agree to each accept the responsibility to adhere to
all pertinent federal, state, and local laws or regulations;
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
ARTICLE I
PURPOSE
1.01 The purpose of this Agreement is to allow the City of Paris to file joint application for an
Edward Byrne Memorial Fund Program Grant with the Criminal Justice Division, which creates the

Red River Valley Drug Task Force, which application is attached hereto as Exhibit "A" and made a
part hereof for all purposes, and which will be submitted to the Governor's Office, Criminal Justice
Division.

ARTICLE II
TERM
The term of this Agreement is to commence on the execution of this Agreement and to end

CONSIDERATION
3.01 As consideration for this Agreement, in addition to the amount contributed by the Texas
Department of Public Safety, the Counties and the Cities agree to contribute a total of $311,434.00
in matching funds for the enhancement of the Red River Valley Drug Task Force in the amounts as

ARTICLE IV
ALLOCATION OF FUNDS
4.01 The specific allocation of the Counties' and the Cities' funds is set out in the attachments to
this Agreement, marked as Exhibit "A," and made a part hereof for all purposes.
ARTICLE V
OWNERSHIP OF EQUIPMENT
5.01 Upon termination of this Agreement, ownership of equipment, hardware, and other non-
expendable items will revert to the applicant for which it was acquired, subject to the approval of the
Criminal Justice Division of the Governor's Office.
ARTICLE VI
AMENDMENTS
6.01 This Agreement may be amended by the mutual agreement of the parties hereto in writing to
be attached to and incorporated into this Agreement.
ARTICLE VII
LEGAL CONSTRUCTION
7.01 In case any one or more of the provisions contained in this Agreement shall be held to be
invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not
affect any other provision hereof, and this Agreement shall be construed as if such invalid, illegal, or
unenforceable provision had never been contained herein.

ARTICLE VIII
ENTIRE AGREEMENT
8.01 This Agreement supersedes any and all other agreements, either oral or in writing, between
the parties hereto with respect to the subject matter hereof, and no other agreement, statement, or
promise relating to the subject matter of this Agreement which is not contained herein shall be valid
or binding.

Significantly reduce the trafficking of controlled substances, dangerous drugs, and marijuana in the project
area while supporting the local law enforcement agencies with reducing drug-related crime and address any
terrorism matters related to homeland security.
PART 3: TARGET (~ROUP
a) Geographic Area: The project area is located in Northeast Texas and consists of Delta,
Fannin, Franklin, Hopkins, and Lamar counties. The two Northern counties
border the State of Oklahoma. The two Southem counties are situated on
interstate 30 between Dallas and Texarkana. The five counties make up
approximately 4,736 square miles and have a population of 128,111

districts. The remainder of the populace lives in the rural areas of the
counties and the economic base is pdmadly dedved from agriculture.

high priority emphasis will be placed on this audience to identify,
investigate, and indict all offenders whose cdminal responsibility is at issue.
Another priodty is the use of an interdiction officer/canine to interdict the
audience smuggling narcotics from the Dallas/Fort Wodh area by the way
of Inter~t3te 30 to desin3tions in the Eastem parts of the United States. A
conceded effort will be made to heighten the awareness of national security
and response, and investigate all potential terrorist activities.

4.2 DESCRIBE the activities or services your project provides as selected in 4.1.
The Red River Valley Drug Task Fome will utilize these specific activities to address the trafficking of illegal
drugs in the five-county area. All investigative efforts will focus on the persons involved in the possession,
transportation, sale, manufacturing, and growing of illegal drugs. The investigative activity is fashioned to a
three-prong approach. The first prong is the ability to take information received and develop that information
into cdminal cases. The second prong is the utilization of confidential informants to make initial purchases of
illegal drugs. From the initial purchase, the confidential informant is used to make the introduction of the
investig~0r to the trafficker ~o hand-to-hand pumha~es can be made. The third prong is to utilize interdiction
units to work the highways to support open investigations, or recent information circumstances. A pdority will
be placed on the use of the interdiction officer/canine to interdict the person smuggling narcotics from the
Dallas/Fort Worth area by the way of Interstate 30 to destinations in the Eastern ports of the United States.
By utilizing this three-prong approach, it is the goal to reduce drug use and trade, and thus reduce violent
cdmes which are consistently interrelated with drug use.
The Red River Valley Drug Task Fome has a special prosecutor who aggressively prosecutes all illegal drug
traffickers under applicable state and federal laws. This includes the abilit~ to remove an~, J~rofits gained
through the civil process (seizure and forfeiture).
In order to most effectively achieve project ~loals, it is of the utmost importance to maintain the level of
education and knowledge of both new and experienced officers. Therefore, the task force actively engages in
available educational and training opportunities.
The Red River Valley Drug Task Force will provide investigative expertise, prosecutodal assistance, and
manpower to all local, state, or federal law enforcement when needed. The drug and terrorism awareness
education programs are ongoing, which is kept at the forefront and is addressed daily. A concerted effort will
be made to heighten the awareness of homeland secudty and investigate all potential terrorist activities.

5.2 What is your histo~j of providing services in a cost-effective manner? If your pregram is new, you

1. An administrative decision by the project directors of the Regional Controlled Substance Apprehension
Program and Tactical Narcotics Team was made to consolidate the two drag task forces. The consolidation
will increase the number of participating entities from six in the Regional Controlled Substance Apprehension
Prccjram and five in the Tactical Narcotics Team to an adjusted number of eight. Three entities have elected
to withdraw their participation in the task force. Arising out of the consolidation is the new Red River Valley
Drug Task Force. The consolidation is cost-effective in the following manner:
a. The present Regional Controlled Substance Apprehenslon Program Commandeds salary and fringe
benefits ($62,240) will be used in one of the other schedules.
b. The Texas Department of Public Safety Commander's salad/and fringe benefits ($76,896) will be used
for cash match.
c. The cell phone, pager, vehicle, and gas expense for the present Regional Controlled Substance
Apprehension Procjram Commander will be eliminated. The same expenses for the Texas Department of
Public Safety Commander will be paid by the Texas Department of Public Safety.
2. To eliminate a portion of the operating expense, the investigators have been instructed to travel together
in conducting task force business when feasable.
3. To eliminate a portion of the heating, cooling, and lighting expense, all task force personnel have been
instructed on the importance of the correct setting on thermostats and turning off lights.
4. The investigators have been instructed to evaluate the payments of confidential informants in a more cost-
e~ec{Ive manner.
5. The investigators have been instructed to evaluate the mailing versus hand-delivery of evidence to the
laboratories.
6. Agency meetings have been cut from one a week to two a month.
7. The task force will be able to eliminate some of the pager expense due to two entities electing not to
participate.
