Walters Applied Technology Building, Room 1206, 2400 Clarksville Street, Paris, Texas with the following members present: 1. Reeves Hayter 2. Barbara Forrest 3. Brad Archer 4. Cleveland Thomas 5. Louis Yates 6. Marshall Kent 7. Bobby Myers 8. Russell McCain Steve Metheven, the Building Official was also present. The meeting was called to order by Reeves Hayter. There was no December, 2003 meeting. The minutes from the November 3, 2003, regular planning and zoning meeting were approved with a motion by Bobby Myers and seconded by Louis Yates. Motion carried by a vote of 8 ayes and 0 nays. Public Hearing to consider the petition of Wanda Whitaker for a change in zoning from a One-Family Dwelling District No. 2 (SF-2) to a Neighborhood Service District (NS), Lot 14, Block C, Lamesa Heights Addition, being number 2235 Sycamore Street. The public hearing was declared open. Wanda Whitaker, 2235 Sycamore, spoke in favor of the petition stating that she would like to put a small hair salon in her back yard. Ms. Whitaker would be the only one working there. Ms. Whitaker plans to build an extra driveway to take care of parking and there would only be 2 cars parked at a time. Jeff Merritt, 2225 Sycamore, spoke in favor of the petition stating that there are positive things to the change. Mr. Merritt stated that there Planning and Zoning Meeting January 6, 2004 Page 2 have been some thefts in the neighborhood in broad daylight and the presence of some neighbors in the neighborhood could possibly counteract some of this activity. Mr. Merritt would not like to see the neighborhood opened up to all kinds of businesses but thinks that this is not an unreasonable request and does not think that this salon will affect the traffic flow. Pat Pulmeri, 2210 Bella Vista, was concerned about being opened up to being rezoned. Ms. Pulmeri stated that there is one way in and one way out of the area and there is an exorbitant amount of traffic there and she would not like to see more traffic coming into the area. Ms. Joe Perry, 2185 Sycamore, expressed concern regarding increased traffic to the area. Joey Bristow owns property at 2270 Sycamore and 4 houses on Bella Vista stated that one of the selling points of the property in the area is that there is one way in and one way out and it is an area with little traffic. Steve Methven stated that he and Russell McCain received a call from Mr. Morrow in opposition to the petition. Planning and Zoning Meeting January 6, 2004 Page 3 e Public Hearing to consider the petition of Shirley and Donna Swindle for a change in zoning from a One-Family Dwelling District No. 3 (SF-3) to a Neighborhood Service District (NS), Lots 11 and 12, Block B, East Park Addition, being number 1730 l0th Street NE. The public hearing was declared open. Donna Swindle spoke in favor of the petition for this portion of her mother's property to be rezoned to neighborhood service for a beauty shop to be built there. Ms. Swindle is the only person to take care of her legally blind mother. The property is fenced in and parking would be inside the fence. There was no opposition, the public hearing was declared closed. Consideration of and action on the petition of Shirley and Donna Swindle for a change in zoning from a One-Family Dwelling District No. 3 (SF-3) to a Neighborhood Service District (NS), Lots 11 and 12, Block B, East Park Addition, being number 1730 l0th Street NE. Motion was made to approve the petition by Bobby Myers and seconded by Marshall Kent. Motion carried by a vote of 7 ayes and 1 nay. Public Hearing to consider the site plan approval requested by Paul Viuson, Lot 14E, City Block 249, Red River Business Park. Paul Vinson stated that his plans are to build a bee hive assisted living-a franchise growing popular around the West Coast and New Mexico. Mr. Vinson stated that they are working with all local people. Mr. Vinson's wife is an Occupational Therapist and he plans to hire home health nurses or care givers to stay with the elderly ~vho have a difficult time but does not quite need full care like a nursing home but could use someone around for 24 hours. The facility would provide meals-good home cooked meals. The facility in New Mexico is a good family-like atmosphere. The care is more specialized due to it being a Planning and Zoning Meeting January 6, 900z[ Page 4 smaller unit. The facility will be all brick and composition. Most of the elderly do not have the capability to drive, usually the family comes in and visit with the folks, therefore, there is no need for extra parking for residents. There would be 2 parking spaces in the garage and 10 spaces outside of the garage. In New Mexico there were typically 3 employees on site. There was no opposition, the public hearing was declared closed. Consideration of and action on the site plan approval requested by Paul Vinson, Lot 14E, City Block 249, Red River Business Park, being the 2900 Block of Pine Mill Road. Motion was made to approve by Marshall Kent, seconded by Bobby Myers, subject to the City Engineer's Memo dated, December 29, 2003. Motion carried by a vote of 8 ayes and 0 nays. Motion was made to approve by Brad Archer, seconded by Louis Yates, subject to the City Engineer's Memo dated, December 30, 2003. Motion carried by a vote of 8 ayes and 0 nays. Motion for Reeves Hayter to be excused was made by Russell McCain and seconded by Bobby Myers. Motion carried by a vote of 8 ayes and 0 nays. MS. GATES PLANS TO BUILD A TRUCK STOP AT THIS LOCATION WHICH REQUIRES A SPECIFIC USE PERMIT. ACCORDING TO THE CITY OF PARIS' MASTER PLAN, THIS PROPERTY SHOULD BE ZONED COMMERCIAL. I RECOMMEND APPROVAL. THE PARIS HISTORICAL COMMISSION IS SEEKING A HISTORIC OVERLAY DISTRICT ON THESE PROPERTIES THUS MAKING THE AREA TO BE KNOWN AS HISTORIC OVERLAY DISTRICT #2. Likewise, pursuant to options presented in your letter; I am hereby requesting a waiver of the construction of curb and gutter along W. Washington Street and am likewise requesting a waiver of puttlng up money for the construction of curb and gutter along W. Washington. I am presuming that when the City commences construction on W.
