RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, AUTHORIZING THE PARIS ECONOMIC DEVELOPMENT
CORPORATION, AT ITS EXPENSE, TO PERFORM ALL WORK
REQUIRED FOR THE CONSTRUCTION OF HEARNE STREET FROM 1 ST
STREET S.W. TO 4TH STREET S.W. ON RIGHT-OF-WAY PREVIOUSLY
ACQUIRED BY THE CITY OF PARIS; CONDITIONING THE APPROVAL
OF SAID CONSTRUCTION UPON CONFORMANCE BY THE PARIS
ECONOMIC DEVELOPMENT CORPORATION WITH ALL APPLICABLE
CITY ORDINANCES, CODES, REGULATIONS, AND SPECIFICATIONS AS
VERIFIED BY CITY INSPECTORS; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, the Pace Group, in its Business Retention Survey and Flexible Incentive
Plan for the City of Paris, dated May 12, 1994, brought to the attention of the Paris Economic
Development Corporation the concern regarding access roads to Delta Logistics and Rodgers-
Wade Manufacturing; and,
WHEREAS, the current route used to access Delta Logistics, Rodgers-Wade
Manufacturing, and warehouses in the vicinity thereof is through residential areas on streets
which adversely affect the efficiency of the affected industries because they do not provide
adequate turning space for large trucks, and significant amounts of traffic by large vehicles
through residential areas not only cause deterioration to the streets but detract from the comfort
of the inhabitants of the neighborhood because of the considerable noise generated by such
vehicles; and,
WHEREAS, the Board of Directors of the Paris Economic Development Corporation
(PEDC) deemed it appropriate and in furtherance of economic development that the PEDC
extend Hearne Street from 1 st Street S.W. to 4th Street S.W., with funding authorized up to the
amount of $265,000.00, in order to provide an adequate route for large vehicles traveling to
Delta Logistics, Rodgers-Wade, and the warehouses in the vicinity thereof and to alleviate the
noise and road deterioration caused by said large vehicles; and,
WHEREAS, in accordance with said determination, the Board of Directors of the Paris
Economic Development Corporation, by formal action on the 13th day of September, 1999, in
Resolution No. 99-007, amended by Resolution No. 99-009 on the 29th day of November, 1999,
authorized the expenditure of an amount not to exceed $265,000.00 to defray the cost of the
extension of Hearne Street from 1 st Street S.W. to 4th Street S.W. for the economic benefit
derived by the industries in the vicinity as a result of said street extension; and,
WHEREAS, the City of Paris, by and through the actions of the City Legal Department,
has acquired the necessary right-of-way to extend Hearne Street from 1 st Street S.W. to 4th
Street S.W., said right-of-way being acquired in conformance with prior resolutions adopted by
the City Council of the City of Paris; and,
WHEREAS, the Paris Economic Development Corporation has received competitive
bids for the construction of said street improvements upon the right-of-way owned by the City
of Paris and seeks authorization from the City Council of the City of Paris to perform said
construction upon said City-owned right-of-way; and,
WHEREAS, the City Council of the City of Paris desires to authorize said construction,
at the sole cost and expense of the Paris Economic Development Corporation, subject to the
conformance of said construction with all applicable City ordinances, codes, regulations, and
specifications, and subject to the approval of City inspectors; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That the Paris Economic Development Corporation shall be, and is hereby,
authorized to perform all work necessary, at its sole cost and expense, to construct the extension
of Hearne Street on City-owned right-of-way from 1 st Street S.W. to 4th Street S.W. in order
to improve access for large trucks necessary to serve various industries adjacent to said street
improvements, including Delta Logistics, Rodgers-Wade Manufacturing, and various
warehouses, and at the same time alleviating large truck traffic on adjacent residential streets..
Section 3. That construction of said street improvements as authorized herein shall be,
and is hereby, conditioned upon conformance by the PEDC with all applicable City ordinances,
codes, regulations, and specifications associated therewith, and subject to the review and
approval by appropriate City inspectors..
Section 4. That this resolution shall be effective from and after its date of passage.
