A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING ADDENDUM NO. 2 TO THE AGREEMENT FOR ENGINEERING SERVICES WITH BUCHER, WILLIS & RATLIFF CORPORATION FOR WATER DISTRIBUTION SYSTEM IMPROVEMENTS INCLUDING WATER TRANSMISSION LINES, WATER STORAGE FACILITIES, AND SYSTEM ANALYSIS STUDIES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris, Paris, Texas, did heretofore, on the 11 th day of February, 2002, in Resolution No. 2002-043, approve the execution of an Agreement for Engineering Services with Bucher, Willis & RatliffCorporation for water distribution system improvements including water transmission lines, water storage facilities, and system analysis studies; and, WHEREAS, the City Council of the City of Paris did heretofore, on the 13th day of January, 2003, approve Addendum No. 1 to said engineering services agreement to revise the terms in order to obtain additional on-site construction representation services from Bucher, Willis & Ratliff; and, WHEREAS, the City Engineer, Shawn Napier, acting as project engineer, recommends the amendment of the Agreement for Engineering Services to provide for the transfer of $10,000.00 in approved funds from the contract category "Sub-Consultants" into the contract category "Construction Administration," as described in said Agreement attached hereto as Exhibit A, which is covered by the allowance for engineering services, and providing for no increase in the contract price; and, WHEREAS, the form of Addendum No. 2 to the Agreement for Engineering Services, attached hereto as Exhibit A, should, in all things, be approved, and the Mayor should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the form of Addendum No. 2 to the original Agreement for Engineering Services, dated March 15, 2002, with Bucher, Willis & Ratliff Corporation, attached hereto as Exhibit A, be, and the same is hereby, approved. Section 3. That the Mayor be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, Addendum No. 2 to said agreement, under the terms and conditions and in the form shown in Exhibit A, attached hereto. Section 4. That this resolution shall be effective from and after its date of passage. PASSED AND APPROVED this 15th day of March, 2004. Box 9037 Paris, Texas 75461-9037 Re: Addendum No.2 to the Agreement for Engineering Services Water System Improvements - 24" RCCP Water Transmission Line and Water Tower BWR # 2002140 Dear Mr. Napier: Bucher, Willis and Ratliff Corporation (BWR) is requesting that the City of Paris approve an addendum to the Engineering Services Agreement between the City of Paris and BWR. This Addendum No. 2 will provide for the transfer of $10,000.00 in approved funds from the contract category "Sub-Consultants" into the contract category "Construction Administration". The original amount allocated for "Sub- Consultants" was $75,000.00, of which $35,272.85 have been billed to date. It is estimated that an additional maximum amount of $15,000.00 will be billed under this category for materials testing and quality control, leaving a balance of $24,727.15. The construction of the 24" RCCP Water Transmission Line has been extended due to several factors, resulting in additional construction administrative services provided by BWR. Additional time is being expended in the preparation of the monthly construction estimates, construction site visits and consoltation with the generaI contractor and the sub-contractors on this project. Services associated with this Addendum will be based on an hourly cost basis for all items. It is requested that a transfer in contract funds from "Sub-Consultants" into "Construction Administration" in the amount of $10,000.00 be approved as a part of Addendum No. 2 to cover the costs of these extended tasks.
