MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL
March 29, 2004
The City Council of the City of Paris met in special session on Monday, March
29, 2004, 6:00 P.M. at Paris Junior College, Bobby R. Walters Applied
Technology Building, Room 1206, 2400 Clarksville Street, Paris, Texas. Mayor
Curtis Fendley called the meeting to order with the following Council Members
present: Jim Bell, Jay Guest, Joe E. McCarthy, Francine Neeley, Willie Weekly,
Sr., and Benny Plata. Also present were Interim City Manager Terry Townsend,
City Attorney Larry W. Schenk and Acting City Clerk Sherian Dixon.
Mayor Fendley announced at 6:02 P.M. that the Council would go into
Executive Session pursuant to Section 551.071 of the Texas Government Code,
Consultation with Attorney, to receive legal counsel pertaining to the duty of an
attorney to his client under the Texas Disciplinary Rules of Professional Conduct
of the State Bar of Texas regarding the following matters:
A.Possible settlement with suspended City Manager Michael E. Malone.
B.City of Paris vs. Standard Life and Accident Insurance Company and
Brokers Risk Placement Services, Inc.; Cause No. 72052.
C.Billy C. Brown vs. City of Paris, el al; Civil Action No. 72322.
Mayor Fendley reconvened the City Council into Open Session at 6:18 P.M.
City Councilman Bell made a motion to offer the settlement as discussed in
Executive Session and which is attached to these minutes as Exhibit A to
suspended City Manager Michael E. Malone. The motion was seconded by
Councilman McCarthy and passed 7 ayes to 0 nays.
There being no further business, a motion was made by Councilman McCarthy,
seconded by Councilwoman Neeley, to adjourn.
