AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS,
TEXAS, ESTABLISHING A HISTORIC OVERLAY DISTRICT (HD), ON THE
EAST SIDE OF LOT 11 AND THE EAST SIDE OF LOT 12, BLOCK 5, TEXAS &
PACIFIC ADDITION, BEING LOCATED AT 60 SYCAMORE STREET, IN THE
CITY OF PARIS, LAMAR COUNTY, TEXAS IN ACCORDANCE WITH THE
RECOMMENDATIONS OF THE PLANNING AND ZONING COMMISSION
AND THE HISTORIC PRESERVATION COMMISSION; PRESERVING THE
EXISTING USE AND ZONING DESIGNATIONS OF THE PROPERTY SO
DESIGNATED; DESIGNATING THE BOUNDARIES OF THE HISTORIC
OVERLAY (HD) SO ESTABLISHED; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER
CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY
CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris, Texas, has received a request from the
Paris Historic Preservation Commission, following notice to the owner and a public hearing
thereon, for an amendment to the zoning ordinance of the City of Paris to establish a Historic
Overlay District (HD) on the east side of Lot 11 and the east side of Lot 12, Block 5, Texas and
Pacific Addition, being located at 60 Sycamore Street, in the City of Paris, Texas; and,
WHEREAS, on August 25, 2014 the Historic Preservation Commission reviewed and
recommended that the Historic Overlay District on this property be approved in accordance with
the City zoning ordinance and State law; and,
WHEREAS, on September 2, 2014, the Planning and Zoning Commission did conduct a
public hearing on said proposed amendment to the City zoning ordinance and, following said
hearing, made formal recommendation to the City Council regarding said proposed Historic
Overlay District; and,
WHEREAS, on September 8, 2014 the City Council of the City of Paris did
subsequently conduct a public hearing on the aforesaid proposed amendment to the City zoning
ordinance, and having considered the recommendations of the Planning and Zoning Commission
and the testimony and evidence introduced at said public hearing, found and determined that the
church located on the property has provided religious services for over 100 years, and represents
significance in history, architecture, and culture and that a historic overlay district would be
appropriate for the property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in all
things approved.
Section 2. That the boundaries heretofore established by City Zoning Ordinance No.
1710 of the City of Paris, Texas, as previously amended, is hereby further amended to add a
Historic Overlay District (HD) on the east side of Lot 11 and the east side of Lot 12, Block 5,
Texas and Pacific Addition, being located at 60 Sycamore Street in the City of Paris, Texas, as
recommended by the Paris Historic Preservation Commission and the Planning and Zoning
Commission, while preserving the respective existing use and zoning regulations of the property
previously designated thereon.
Section 3. That the Chief Building Official of the City of Paris be, and he is hereby,
directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes
set forth in this ordinance.
Section 4. That the City's Historic Preservation Ordinance, Art. VII, Chapter 7, City of
Paris Code of Ordinances, the City's Design Standards for Historic Districts located in the City
of Paris, Texas and the Secretary of the Interior's Standards for the Treatment of Historic
Properties, are incorporated herein by reference and shall apply to the property encompassing the
Historic Overlay district created by this ordinance.
Section 5. That all provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain
in full force and effect.
Section 6. That any person violating any provision of this ordinance shall be guilty of
a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of
Sec. 1 -6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's
continuance of any violation of the above - enumerated sections shall constitute and be deemed
a separate offense.
Section 7. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 8. That this ordinance shall become effective from and after its passage.

Sec. 7 -155. Designation of landmarks and historic districts
(a) Designation. The city council may designate sites, buildings, structures, landscapes and objects as
landmarks, and areas as historic districts, including the public rights -of -way in and surrounding them, by
adopting zoning districts designated as HD on the city's official zoning maps pursuant to procedures
incorporated into the city's basic zoning ordinance by the city council.
(b) Criteria. A historic district may be established to preserve landmarks and areas of exemplary
architectural, archaeological, cultural, or historic value provided such landmarks or areas have one (1) or
more of the following characteristics:
(1) Significance in history, architecture, archaeology, or culture;
(2) Association with certain events that have made a significant contribution to the broad
patterns of local, regional, state, or national history;
(3) Association with the lives of significant persons in our past;
(4) Embodying the distinctive characteristics of an architectural or engineering type, period, or
method of construction;
(S) Represents the work of a master designer, builder, or craftsman;
(6) Represents an established and familiar visual feature of the community;
(7) Has archaeological value because it has produced or can be expected to produce data
affecting theories of historic or prehistoric interest.
(c) Regulations. Design guidelines and other appropriate regulations concerning the exterior and site
development or redevelopment of a historic district may be recommended by the commission and
adopted by the city council as part of a district ordinance.
(d) Notice to affected property owners, hearings. Property owners of a proposed historic district
designation shall be notified by the commission prior to the commission's hearing on designation.
Testimony and documentary evidence may be presented, which will become part of the public record,
to comment on the historic, architectural, or cultural importance of the proposed historic property.
(e) Recommendations. Upon receipt of written recommendation of the commission, a proposal for
designation shall be submitted to the planning and zoning commission for its review, public hearing, and
recommendation to the city council for adoption, as provided in the city's general zoning ordinance.
(f) Designations recorded. Upon designation of a property or properties as a landmark or historic district
by the city council, the designation shall be recorded by legal description on the city's official zoning
maps, in the records of real property of Lamar County, and with the tax appraisal office.
