MINUTES OF THE MEETING OF THE BOARD OF ADJUSTMENTS
THE BOARD OF ADJUSTMENTS MET MONDAY MAY 25,2004,5:30 PM, CITY HALL
ANNEX, 150 S.E. I ST, PARIS, TEXAS, WITH THE FOLLOWING MEMBERS PRESENT.

LARRY SCHENK, CITY ATTORNEY AND STEVE METHVEN, CHIEF BUILDING
OFFICIAL WERE ALSO PRESENT
TERRY CHRISTIAN, CHAIRMAN CALLED THE MEETING TO ORDER.
CITY ATTORNEY LARRY SCHENK PRESENTED A SET OF RULES FOR THE
COMMISSION TO LOOK OVER AND DISCUSS.
CHAIRMAN CHRISTIAN READ EACH RULE ONE AT TIME AND DISCUSSION WAS
HFLD ON EACH BY THE BOARD MEMBERS NO ADDITIONS OR DELETIONS WERE
MADE TO THE NINE RULES AND A MOTION TO ADOPT THE RULES FOR THE
BOARD OF ADJUSTMENTS WAS MADE BY RODNEY BASS SECONDED BY JOf fN
MARK SPENCER. MOTION CARRIED BY A VOTE OF 6 AYES AND 0 NA YS
MEETING WAS ADJOURNED AT 6: 15 PM
RULES OF THE CITY OF PARIS BOARD OF ADJUSTMENT
1.
Meetings of the Board may be held at the call of the Chairman or at such other times as
the Board may determine and in accordance with the Open Meetings Law.
2.
The Chairman or, in his or her absence, the acting chairman may administer oaths and
compel the attendance of witnesses.
3.
The cases will be taken in the order listed on the agenda, unless in the discretion of the
Chairman or person conducting the meeting a case may be taken out of order for good
reason.
4.
The applicant property owner shall first make his or her presentation to the Board. City
staff shall then follow with any comment or information as necessary. If further
information or clarification is desired by the Board, the Board shall request further
information or clarification. At the end of the presentations by the property owner, and
the City staff, the Board may entertain comment from the general public regarding the
request. At the conclusion of the hearing, and after deliberation by the Board and upon
motion made, seconded and passed, the Board shall make written findings of fact and shall
enter its written orders.

The Board has the right to limit the time given to each speaker and to require that a
presentation or comments not be repetitive.
6.
Any interested party or member of the public may appear before the Board in person or
by agent or by attorney. The burden of proof shall be on the applicant to establish the
necessary facts to warrant favorable action of the Board on any matter.
7.
All comments made by any person to appear before the Board shall be made to the Board
and not to another party. The Chairman shall maintain proper decorum for conduct of the
meeting.
8.
The Board shall keep minutes of its proceedings, showing the vote of each member upon
each question or, if absent or failing to vote, indicating such fact, and shall keep a record
of its examination and other official actions, all of which shall be immediately filed in the
office of the Board and shall be a public record.
9.
In the event less than five (5) regular voting members shall be in attendance, the Chairman
shall designate, at the beginning of the meeting, one or both alternates to participate as
voting members; provided, however, the number of voting members shall not exceed five
(5). Alternate members not participating as voting members shall still be entitled to
participate fully in the deliberative process.
