09/15/2014 MINUTESMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, September 15, 2014 3:00 P.M. 1. Johnny Norris called the Building and Standards Commission Meeting to order at 3:00 P.M. Roll was called. A. The following members were present: Johnny Norris Wendell Moore Chad Lindsey Ben Vaughan Sally McEwin B. Staff present: Robert Talley Ashley Fendley Stephanie Harris Larry Wright C. Others present: Joyce Freeman — home owner 2. Approval of minutes from previous meetings. (July 21, 2014 and August 18, 2014) Motion was made by Ben Vaughan and seconded by Wendell Moore to approve the minutes for both July 21, 2014 and August 18, 2014 meetings. Motion carried unanimously. 5 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": Robert Talley asked to go to item 3. G. due to property owner being present. G. 2255 W Austin, City Block 211, Lot 2 -A Owner: Joyce Freeman 2211 E Polk Paris, TX 75460 No back taxes owed Robert Talley stated looking at the pictures you can see junk and rubbish throughout the back and side yard and inside the house. Also, the home has foundation issues, with missing and deteriorated wood. Looking inside the front door you can see the structure is unsecure, broken windows, the electrical panel is missing wiring, and the water heater has plumbing issues. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Joyce Freeman was present. Mrs. Freeman's current address is 2211 E Polk Paris, TX 75460. Mrs. Freeman stated that the junk and rubbish was from her tenant and she was not aware of the issue. She stated that she broke one of the windows when she saw the mess that was left. Mrs. Freeman further stated one of the guys that works for her install a water heater and she was not aware of the mess the gentleman made. Mrs. Freeman stated the house doesn't have any foundation problems and she has it rented out already if she can get it back into shape. Sally McEwin asked what sort of time frame was Mrs. Freeman asking for. Mrs. Freeman stated she could have it ready in 30 to 60 days. Johnny Norris asked Robert Talley what was his main concern with the property. Mr. Talley stated that the fact the structure was not secure, deterioration at the back of the structure, junk and rubbish. Mrs. Freeman stated the property is secure now she was not aware the doors were open at the time. Mr. Talley stated to make sure she received permits before she does any work. Motion was made by Sally McEwin, seconded by Wendell Moore to allow Joyce Freeman 60 days to secure and repair property structure. Motion carried unanimously. 5 -0 A. 125 NE 12th; City Block 32 -A, Lot 7 Owner: Vicky Troutman Hart C/S C/O Terri Nugent & Jessie Smart 125 NE 12th Paris, TX 75460 No contact with owner Back Taxes Owed: $3148.77 Robert Talley stated that the tree in the front yard is growing into the front porch. The structure is unsecure as there are windows missing and foundation issues. This structure has a lot of missing and deteriorating wood; the structure is starting to sink in the front and is leaning. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Sally McEwin stated this home was a beautiful home at one point and time and it might be possible there are light fixtures someone might want. Mr. Talley stated at this point the only thing we can do is make a recommendation to either demolish the structure or repair it unless someone came in to sign a right of entry form. Ben Vaughn stated the house is leaning north and west about 12 inches and it seems to be the tree is holding it up. Motion was made by Chad Lindsey, seconded by Sally McEwin to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 B. 235 Evergreen; Neagle Addition Block 9, Lot W50' of 6 -7 The property has already been demolished. C. 386 NE 1St; City Block 58, Lot 5 Owner: John Robert & Charice Holt 3150 Dogwood Paris, TX 75460 No contact with owner Back Taxes Owed: $11266.52 Robert Talley stated this property was brought to the commission at the first of the year. At that time Mrs. Holt stated she wanted to fix it up. Presently the house has foundation damage and the outside wall has buckled and bowed at the bottom plate. The only work that he can see has been done was a little tree has been removed that was growing from underneath the house. There has been no repair to the deterioration in the roof, the foundation and broken windows. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Chad Lindsey to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 D. 1065 NE 11th; City Block 175, Lot 12 Owner: John Robert & Clarice Holt 3150 Dogwood Paris, TX 75460 Back Taxes Owed: $18788.00 Robert Talley stated that when he went to do the inspection of the home Mrs. Holt was there showing the home to an individual to rent. Mrs. Holt assured him the inside was in living condition and the outside could be patched up. The Building Official has made note to do inspection before releasing any utilities. The structures roof looks like whoever did the roofing job roofed over a sky light. The home is unsecure, its missing a window, the foundation is sinking a little bit, deterioration to the roof, and it has deteriorating wood. Robert Talley's recommendation: 90 days to repair. Johnny Norris asked if the roof was leaking and Mr. Talley stated he couldn't really tell. Sally McEwin asked if this property has been brought to the commission before and Mr. Talley stated this property has not. Chad Lindsey stated his concern is that the property is unsecure and Mr. Talley stated the only thing that is unsecure is the missing window. Chad Lindsey asked if we could make a motion to secure the structure in 10 day and repair in 90 day and Mr. Talley stated yes that's possible. Johnny Norris asked where does that put us with Mrs. Harris concern if we recommend repair in 90 days then repairs are not done and an individual is living there. Mrs. Harris stated if they are paying rent and have a lease agreement she doesn't think this commission has any authority to make them vacate the property. Mr. Norris asked if they could table the item till the next meeting. Mrs. Harris stated you can do that but you won't gain anything from it and they can still rent the property. Mrs. McEwin wants to make a motion to demolish the structure because we have seen people move into a home without utilities before. Mr. Talley stated with that being said the letter we sent was for repair not to demolish so if that's the recommendation from the commission could we say 30 days to repair and if she hasn't done anything then send a letter to demolish. Mrs. Harris stated we need to give notice for a demolition. Robert Talley presented a new recommendation to secure in 10 day and to repair within 30 days or it will be brought back to the commission. Motion was made by Sally McEwin, seconded by Chad Lindsey to accept Robert Talley's second recommendation. Motion carried unanimously. 5 -0 E. 1609 Fairfax; Belmont Addition Block 6, Lot 9 Owner: Aimee Foster 1609 Fairfax Paris, TX 75460 Back Taxes Owed: $966.61 Robert Talley stated Mrs. Foster has contacted the east side Code Enforcement Officer Nicki Brown and said she wants to save this property. Mr. Talley have tried to contact her by phone but no response has been made. Code Enforcement and Animal Control have worked this property numerous times and when working these cases the house had no floors and was in rough shape. Due to the grass being so high you can't really see how badly the condition of the home. What you can see is the roof has holes and rafters are starting to protrude out which possible means there is a foundation issue. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Sally McEwin asked if she has ever reimbursed the city for the work that's been done and Mr. Talley stated he didn't believe so but he is not sure. Ben Vaughn asked if we were able to mail her a notice because the mailing address is the same. Mr. Talley stated he is not sure if it was forwarded to her but she is aware of the issue because she notified Mrs. Brown. Motion was made by Wendell Moore, seconded by Sally McEwin to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 F. 1850 W Kaufman; S J Wright Addition Block 4, Lot 10A Owner: Patricia Malone Smith 11603 Taos Ln Houston, TX 77070 No contact with owner No back taxes owed Robert Talley stated in the letter sent out to Mrs. Smith was to demolish the shed only. The shed has missing and deteriorating wood. Robert Talley's recommendation: 30 days to demolish (Shed Only) if not the City has the right to demolish and apply a $1000 per day civil penalty. Ben Vaughn stated when he drove by today he didn't see the shed it was gone. Mr. Talley stated just in case let's make a recommendation if it is gone he won't submit the order. Motion was made by Chad Lindsey, seconded by Wendell Moore to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 H. 3200 Clarksville; City Block 311, Lot PT 2 Owner: AMR LLC A Nevada Limited Liability Company 2430 Audoban Paris, TX 75460 No back taxes owed Robert Talley stated the Fire Marshal and himself has spoken with Mr. Ricks the property owner about the issue. In the letter to Mr. Rick it states demolition of the porch/carport only. It seems to be that a tree has fallen onto the porch/carport; they have removed the tree off the structure but haven't fixed the porch/carport, Robert Talley's recommendation: 30 days to demolish (Porch /Carport Only) if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Sally McEwin, seconded by Wendell Moore to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 I. 3200 Clarksville; City Block 311 Lot PT 2 Owner: AMR LLC A Nevada Limited Liability Company 2430 Audoban Paris, TX 75460 No back taxes owed Robert Talley stated the Fire Marshal and himself have spoken with Mr. Ricks the property owner about the issue. Robert Talley stated this property was brought to the commission before with two other homes. Mr. Ricks asked to repair this structure and demolish the other two. Since then Mr. Ricks has demolished both structures but hasn't finished his repair. Presently the house has no siding on one side of the home, no insulation, some flooring has been removed, and it has junk and rubbish. From the looks of the property Mr. Ricks hasn't done much repair in the past 4 or 5 months. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Ben Vaughn to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 4. Code Enforcement update. (1). Mr. Talley stated that they demolished 8 structures in the month of August. (2). Mr. Talley stated the Pine Bluff home was demolished and it ended up costing a little over $4,000.00 due to so much stuff in the home. (3). Mr. Talley stated he will be making changes to the report he submits to the city council and asked the commission if they would like that as well. The commission had no issue with the report changing. (4). Mr. Lindsey asked about 260 South Main where we are with that structure. Mr. Talley stated we haven't received a ruling on that issue yet. Mr. Norris asked Mr. Talley to check into it. (5). Mrs. McEwin asked how we are on funding and Mr. Talley stated he needed to check with Gene Anderson because he has two figures $73,000.00 and $82,000.00 he is not sure which one is the current amount. (6). Mr. Vaughn asked where are we on the home on 13ffi SE and Mr. Talley stated he sent them a letter for it to be demolished within 30 days. (7). Mr. Norris asked if any of the citizens have applied for the loan from the banks and Mr. Talley stated he will submit it to the commission in the next meeting. 5.
